GRANT OF PERMANENT EASEMENT
FOR UTILITY PURPOSES
David Bicker, a single person"Grantor", in consideration of One Dollar($1.00) and
other good and valuable consideration,the receipt and sufficiency of which is hereby
acknowledged, do hereby grant unto the CITY OF ORONO,a Minnesota municipal corporation,
the Grantee,hereinafter referred to as the"City", its successors and assigns, forever,a permanent
easement"Permanent Easement"for public sanitary sewer system("Sanitary Sewer System")
purposes over, across, on, under, and through land situated within the County of Hennepin, State
of Minnesota, as described on the attached Exhibit"A" and depicted on the attached Exhibit"B"
(the "Easement Premises").
INCLUDING the rights of the City, its contractors, agents, servants, and assigns,to enter
upon the Easement Premises at all reasonable times to construct,reconstruct,inspect,repair, and
maintain said Sanitary Sewer System over, across,on,under,and through the Easement Premises,
together with the right to grade, level, fill,drain, and excavate the Easement Premises, and the
further right to remove trees, bushes,undergrowth, and other obstructions interfering with the
location, construction, reconstruction, maintenance,repair and operation of said Sanitary Sewer

System and to restore the surface of the ground of said Easement Premises where such is
physically possible and practical,to approximately the same condition that existed prior to any
construction, reconstruction,maintenance, repair and operation of said Sanitary Sewer System.
The above named Grantor, for himself,his heirs and assigns,does covenant with the City,
its successors and assigns,that he is well seized in fee title of the Easement Premises; that he has the
sole right to grant and convey the Easement Premises for the use of the Sanitary Sewer System over,
under and across the Easement Premises to the City; that there are no unrecorded interests in the
Easement Premises; and that he will indemnify and hold the City harmless for any breach of the
foregoing covenants.
IN TESTIMONY WHEREOF,the Grantor hereto has signed this agreement this

A strip of land 20.00 feet in width for sanitary sewer purposes lying over, under, and across Tract
B, Registered Land Survey No. 1420. Said centerline is described as commencing at the
northwest corner of said Tract B; thence South 03 degrees 45 minutes 25 seconds West along the
west line of said Tract B, a distance of 78.70 feet; thence South 88 degrees 53 minutes 58
seconds East, a distance of 15.63 feet to the actual point of beginning of said centerline; thence
South 01 degrees 08 minutes 06 seconds West, a distance of 142.93 feet and there terminating.

Mortgage("Mortgage")on all or part of the property more particularly described in the foregoing
Grant of Permanent Easement,which Mortgage is dated July 14, 2021 and recorded on August 26,
2021 as Torrens document number 5873334 with the office of the Registrar of Titles for Hennepin
County,Minnesota, for good and valuable consideration,the receipt and sufficiency of which is
hereby acknowledged,does hereby join in, consents to, and is subject to the foregoing Grant of
