The outlet is acceptable at the 30’ width, similar to driveway in Stronghold. The road sustains limited use and will function as a private driveway with Partenwood addresses. The City will still require underlying road and utility easements and standard maintenance agreement. Lots 2 & 3 do not contain the required one acre in area but the overall area satisfies three units (3.7 acres exclusive of road deduction and road outlot - one unit per 1.2 acres). Lot 1 has 139' of lineal shoreline instead of the required 140' but again, the overall shoreline of 508' satisfies three units (169' per unit). The building envelopes are adequate. The proposed house for Lot 1 meets all setback standards for the LR-lB district. The sewer'line changes have been reviewed by the City Engineer. His comments are as follows: 1. Manhole 11-3 should be replaced with manhole IN if possible to eliminate a manhole on the City system. Outside drop required. 2. The proposed service connection should connect to a wye on the sewer line and cleanouts on the line should be provided. In additon, he raises the question of Lot 5's approval of the service change. I am not aware if applicants have consulted with the owner but bhe City will contact the Gerald Partens to assure their approval of the service change. Staff Recommendation: to approve the three lot plat, Carlwood Addition, finding all standards of the LR-IB zoning district have been maintained and that there is adequate service available to extend sewer service to two additional units subject to the following conditions: • • I' mmm m.m ft #775 - Septem! I would advise that you only ask for this information if you feel a lot line rearrangement is appropriate. I will attend the Planning Commission Meeting of August 15, 1983 as you request, although I do not understand what I can add to what you already know concerning the "common ownership" issue. As you know, I purchased the lot from J. Richard Tuthill in 1977 and haven't proceeded to build on the lot until this year. At present/ the City requires all lots held in common ownership to meet 100% of all lot standards for a zoning district as opposed to single separate lots that need only meet 80% of those same standards. Mr. Smith's application was accepted as a lot of single separate record requiring variance review because the area and width of Lot 18 did not meet the 80% requirement. Mabusth DATE:September 15, 1983 SUBJECT:#758 James Bigham, 1545 Long Lake Blvd - Conditional Use Permit - After the Fact Zoning District - LR-lA Application - Conditional Use Permit - After the Fact - Required for erection of retaining walls per Ordinance 31,700 portions of which are located within 25* public access. Bigham constructed the retaining walls in the fall of 1982 and the City staff began discussion with applicant about its removal sometime in March of 1983. In later discussions, Bigham was given the opportunity to file an after the fact application to ask the City Council to review his request and made a decision as to the disposition of the structure. The wall is constructed of 6" x 6" treated timbers 8* in length. The wall is constructed in two Tiers with an upper boxed section at"the northeast edge. This boxed separated section contains two drainage pipes ~ one from the foundation and the other from the roof. These pipes drain onto Ivy Lane. The City has held off with the review of this application awaiting the completion of a variance application by the applicant for a proposed addition to his home. The City can delay no longer and has scheduled the application for review. The delays were not caused by the applicant but rather by negative septic tests and the need to perform additional septic test. City Engineer has reviewed the location, construction and design of the retaining walls. His recommendation is enclosed for your review. Briefly, he recommends that the boxed upper section of wall containing the drainage pipes be removed and drainage directed off Ivy Lane right of way. The remainder of the retaining wall can remain as long as the owner is placed on notice that at some future date, the City may have to ask that the retaining wall be removed. Bigham appears to be planning additional alterations in his lakeshore yard - more retaining walls within 75 of Long lake. I would suggest that Bigham expand his application to include the lakeside retaining walls and that these retaining walls be located on a survey. I built these retaining walls to accomplish two basic goals. The first goal was to level out an area which was previously sloped from the edge of my driveway towards the lake. I wanted this area flat for appearance's sake, as well as to enable me to better use it. The second reason I built the walls was to help eliminate a drainage problem which was occurring both to the east and south (lakeside) of the area that I have terraced. Neither grass nor other vegetation, other than weeds, would grow in this area because of the almost totally shaded condition that exists there. Boci;;>se of this and the steepness, both to the east and south, the water running from the street and onto my driveway and down this area was washing the soil away and towards and into the lake. The building of the retaining wall has eliminated this runoff almost totally. CONDITIONAL USE AND OTHER: I use the area adjacent to my garage for both a walkway to my yard on the lake side of the house and as an area for keeping my two boat trailers. In the winter months, I keep a boat on one of the trailers and leave it parked there and I store the other trailer empty there. I also intend to use the terraced level furthest east and south for planting shrubbery which will sur vive in the heavily shaded conditions that exist there. I do not intend to change the use of the area with these walls, except that I will be able to prevent or control the runoff to such an extent that the soil from the area adjacent to my garage and porch will no longer end up in the lake. * • As I have explained in my correspondence with the City of Orono, I did not know I needed a permit to build the retaining walls that I have built. I tried to build the retaining walls in such a manner that they would be unobjectionable to both my neighbors to the east, as well as my neighbors who use "Ivy Lane" as a lake access.
