Lehman 2450 Carman Street - Variance List of Exhibits Exhibit A Exhibit B Exhibit C Exhibit D Exhibit E Property Owners List Plat Maps Engineer's letter Density - existing vs proposed Preliminary Plans Review of Current Subdivision Proposal 1.Notice of Public Hearing - Legal notice was once again published in the Minnetonka Sun and notices mailed to all property owners within 350' of the boundaries of the subject property. Review the enclosed plat maps and the lists of notified property owners com­ piled by staff. 2. Proposed Density Lots 1,2 and 3 Lydiard Park have been included in current plat as Lot 1. The subject property was approved for a duplex in December of 1977. Lot 7, Lydiard Park is combined with proposed Lot 3 removing potential building site as combined Lots 7 & 8. Lot 8 remains as the driveway to the Edwards home. A total reduction of 2 potential residential units. Note, density is not a real issue since setback variances and the conditional use permit were issued in 1977 under exactly the same ordinances existing now. The applications expired and must be renewed but denying them now with no change in facts from 1977 would never be upheld in court. Sewer The Lehman house and Edwards' properties are not hooked up to sewer. The septic systems do not conform to any kind of current code because of proximity to the lake. These three properties and the Paul Smith cabin on Dunwoody are the last lakeshore houses in the urban part of Orono that are not connected to sewer. Council has ordered Smith to connect. These two houses (plus the vacant lot of Edwards) were not included in the 1964 Carman Street sewer project because they did not abut the street and because a pump is needed. They should have been included in any number of projects over the years, especially when the rest of Casco Point was done in 1965, but they were not. Cost has been the obvious factor discouraging voluntary participation. Lehman May 12, 1983 Page -2- I have asked the City Engineer to review the plat relative to sanitary sewer service. He recommends that all parties use the same trench to minimize excavation in the area. This would be fine if the Edwards' were part of this plat but they have not shown any interest in con­ tacting my office as of this writing. Lehman has continued to update them on the status of the subdivision review. I will write a letter for the record advising them that the City will require that they connect to municipal sewer sometime within the next year. Lehman as a result of this subdivision will be required to hook up prior to the sale of his current residence as a condition of plat approval. The individual grinder pumps are the best method for serving all involved properties. They run about $2500.00 each. Cook recommends that the City plat a utility easement of 20' along the south side of the exist­ ing driveway serving the Edwards house. Lehman may use that connection route or choose one more economical. Riparian Issue The proposed narrow platted corridors to the lagoon obviously require shoreline width variances. But the factual reality is that Lehman owns 360' feet of shoreline on the lagoon, plus another 120 feet on the main lake. Thus, he has 480 total feet of shoreline for four lots. This averages out to be 120 feet per lot, which is more than the 100 feet required by the City or Lake Minnetonka Conservation District. Thus, from staffs' objective position, there is no factual reason to recommend approval or denial of the application. The question of whether or not to approve this averaging is a question of policy for the Planning Commission and Council, not staff, to answer. There is precedent for both. What is the ordinance intent? Is it to regulate overall density on the lake? If so, the averaging would conform to the intent and the variance would be appropriate to address Lehman's unique lagoon situation. Or is it to rigidly specify 100 feet for each and every dock to space them out for maneuverability or appearance or whatever? If so, then the averaging would not conform and the lot width variance should be denied. The Lehman plat of 1977 left many issues unresolved for the subject property, sewer service to existing house, creation of lots with unbuildable building envelopes, potential illegal use of the lagoon by owners of lots not abutting the lagoon - it exists now and will continue to be used through devices that appear conforming to enforcing agencies. Staff would suggest that the intent of Orono's lakeshore preservation goals might better be served by the sewering of these houses than by denying two or three more docks. Riparian use for 4 lots of the subdivision is based on the total 480' of lineal shoreline footage and hereby approve a shoreline width variance of 60' for lots ^and3- 4. Sewer is available to the property. Approval is subject to the following conditions: 1.Lots 2 and 3 are to share a single dock located in Outlet B or Lots 2 and 3 will each be permitted a dock with one slip at the 40' wide shoreline. 2. Lot 1 is not riparian to Lake Minnetonka 3. Lots 3 & 4 must maintain allowed hardcover allowance as follows: Lot 3 - 3175 sf Lot 4 - 2725 sf 4. Applicant to quit claim deed Outlet A to the City as part of the public waters. 5. Applicant/owner of Lot 5 must hook up to City sewer prior to final plat approval. The sanitary sewer line on Carman Street Is quite shallow and we would antici­ pate that the basements north of the channel will be constructed at an eleva­ tion below the sanitary sewer line. The existing homes south of the channel can also be best served Individually but It may be beneficial for them to con­ struct their service lines In the same trench to minimize excavation In the area. The five lots In question could all be served by one public grinder pump but we would not anticipate a significant cost savings for the property owners* The benefit to the property owners would be the elimination of a pump mainte­ nance problem. Edgewood Place plat was approved by Council on August 24, 1981. White has been trying to sell the estate house since that approval date with no luck. This current subdivision application is an attempt to make the house more saleable. White has been advised that a plat would be required and that Tract 1 must be included in the plat as new access to Lot 1 must be shown. Tract 1 was always to be sold with Lot 2 - Tract 1 is substandard and should be tied in with larger land parcel with this subdivision. I am not an expert on the sale of estates but if the applicant must plat, there are several options now available to the applicant. I have asked him to consult with "experts" in the field and come back with his decision. He has advised that he will be unable to attend the public hearing because he has been called out of town. There will be an expansion of the livingroom on the second level (18* X 10’)• The gravel drive and parking area on the west side and rear of the house will be removed and seeded. The applicant's hardship claim is that the City requested an additional 5' of lot width from Lot 18 back in 1972 on the east side creating the need for the variance. Please review Exhibits D, E, & F. Also present: James Grabek Councilmember, Zoning Administrator Mabusth, and Deputy Clerk Woytcke. Chairman Rovegno announced that now was the time and place for the public hearing concerning the final subdivision request of Larry Bader, 420 Brown Road South. Zoning Administrator Mabusth presented the Affidavit of Publication. Mr. Larry Bader was present to review chis application with the Planning Commission. No persons from the public were in nr tendance regarding this application. Chairman Rovegno closed the public hearing at 7:40 P.M. Member Sime moved. Member Callahan seconded, to approve the preliminary and final subdivision of Mr. Larry Bader at 420 Brown Road South. The ueighbors were opposed to Mr. Schneck*s subdivision because the were under the understanding that the property in their area was to maximum density and that it could not be subdivided. The neighbors were told bv the Commission that there was no such document on record with the County or City and that there was no legal reason to not grant this subdivision. Chairman Rovegno moved, Member McDonald seconded to approve the subdivision request of Robert Schneck, 3155 Jamestown Rd. based on the following conditions: 1. Payment of Park Fee in the amount of $200.00 per current fee schedule ifl two acre lot 0 $200.00. 2. Access construction to Lot 2 must be reviewed by City staff at time building permit is issued. 3. Mr. Lehman was informed by the Planning Commission at this time that all the information was not correct and therefore this public hearing had to be closed and tabled until such time the staff was presented the correct information.
