Goetten, Kelley, Sime, Callahan. Planning Commis
sion members Adams and McDonald were absent.
Councilmember Prahm was present. Councilmembers
Adams and Grabek were present for the McDonald's
review. Mabusth and Olson represented the City
staff.

Three separate hearings were scheduled and advertized
for these three separate applications. At 7:30, 7:45
and 8:00 it was c mounced by Chairman Rovegno that all
three hearings ifould be' held concurrently. The
combined hearing was opened by Chairman Rovegno at
8:00. City Planner Olson presented the affidavit of
publication, public hearing notices and certificate
of mailing for all three applications.W:
Present were landowners Rebers and Wear, McDonald's
Corp representatives Gary Meyers and Randy Berg, and
their engineer Larry Hanson. Attached to these
minutes is a li^sL vi neighbors and other interests
persons who also attended.
City Planner Olson presented an overview of all three
applications indicating what exists nowand the nature
of each separate application. The rezoning is
intended to align the zoning boundary with existing
and proposed lot lines. The subdivision is intended
to create a site for the proposed McDonalds
restaurant, and to divide the remainder of Rebers
property along the zoning district boundary.
Kelley asked City Planner Olson if the entrances of
McDonalds would line up witiv Virginia Avenue?
Olson stated that they would not. The loop driveway
is proposed to be on an easement. Olson presented a
letter from the Hennepin County Highway Department
stating that they would approve one curb cut at the
proposed location.

Rovegno asked what type of future development was
planned for the Rebers property?
Olson noted that the rezoning of Rebers property was
preliminarily approved in 1979 by the Council but
Rebers never came back in for final approval by the
City Council. So essentially it is the same
application for rezoning. Olson stated there are no
current plans for the rest of the commercial property.
The large residential lot will obviously be subdivided
and developed in the future.

Discussion was opened to the public.
George Johnson of 879 Brown Road North noted his
concern with traffic flow. He noted that the traffic
already has increased with the new Long Lake Bank. He
asked for the traffic count of five years ago compared
with the traffic count of a week ago. Johnson
requested the size of Brown Road compared to Willow.
Olson noted that he didn't have the traffic count of
five years ago. He stated that the past week count of
Broim Road was 1,439. Re noted that from a year ago
prior to the banks opening the count was 1,434 with
only a difference of five. Olson noted that Brown
Road is 22* wide and a residential street and is not
designed for commercial traffic which is why staff has^^
a problem with the proposed commercial access of
Brown Road.
Mike Johnson of 490 Virginia Avenue (Long Lake
Resident) presented a petition of 21 signatures from
Virginia Avenue residents who are concerned with the
increased traffic. He noted the bad situation now and
that McDonald's would just aggravate it. He asked
that before Orono approves this, Virginia Avenue
residents request that a complete traffic study be
done first.
The petition presented by Mike Johnson is attached to
these minutes.
Richard Busted, owner of the commercial property south
of the proposed McDonald's site (corner of Virginia
Avenue and Highway 12), noted his concern for the
increased traffic.
Gabr iel Jabbour asked if the City of Orono was planning
provide sewer and water to this property?
Olson stated that any commercial development is going
to require sewer and water. He noted that the City was
in receipt of a petition by McDonald's for sewer and
water service on that property. He stated that the
City Council is being asked to act on the queLtion of
sewer and water.

Rovegno asked if the Wear properties are sewered?
Olson stated that they are but he has a direct
connection to the Long Lake sewer systen. Olson noted
that the Rebers property would also have to be served
through the Long Lake sewer system. Olson noted that
a new Orono lateral would have to be provided which
will require new agreements between Orono and Long
Lake.
Lynn Shaughnessy, owner of Shaughnessy Circle
subdivision, noted that they had approval from the
Highway Department to put in a driveway similar to that
proposed by HcDonalds. She suggested that the
HcOonalds driveway be located directly across from
theirs.

George Johnson asked why McDonald's wanted this
particular corner lot, when Willow has a better
location and Willow would have a better chance for a
future stop signal than Brown Road.
Randy Berg, representative of McDonald's Corp, stated
that they have placed McDonalds restaurants in all
different cities that have greater traffic problems
than Orono. McDonalds feels that this particular
location is a good one and that this store will not be
drawing more traffic from other cities but using the
passing traffic on Highway 12. Berg noted that the
McDonald's proposal meets and exceeds the City's
requirements for this type of use, so the main
questions are sewer and water availability and
traffic.
Mary Adams of Brown Road asked why they picked a site
with so many problems concerning traffic and access.
Randy Berg stated that no matter «rhere they pick a site
at there will be someone that thinks that they should
move it to another site.
George Johnson of 769 Brown Road feared that
increased garbage along Brown Road would be due to this
new restaurant. He didn't like a 24 hour restaurant.
Randy Berg stated that McDonald's proposed hburs would
be from 6:30 AM to 10:30 PM on the weekdays and 6:30 AM-
12:00 PM on the weekends. Berg noted that McDonald's
is one of the cleanest corporations around. He noted
that staff goes out and cleans up the parking area and
also the property around it, including litter from
others.

Jerry Sivets of 468 Virginia Avenue asked what the peak
hours of their business would be?

somewhere between 4:30 - 7:30 PN.

Jerry Sivets noted that that is the high volume time
for Highway 12 and it is very difficult to access onto
Highway 12 from Brown Road North or any of the other
periferal streets right now.

Sid Rebers, owner of the land in question, stated that
he has owned the property for 14 or 15 years and has had
many offers to buy his land and develop it. He picked
McDonalds because they are a quality operation, they
have consideration for landscaping, and they build a
quality building, as compared with other businesses.
He noted with the adjoining 33 acres that he stands to
lose the most if he sells to someone with no
consideration of the land at all.

Kelley asked how many cars typically go through a
McDonalds of this size on a given day?

Gary Meyer, engineer for McDonalds, stated that
approximately 1,100 a day would go in and out of this
facility. He noted that they don't anticipate much
use of that Brown Road North access except for a matter
of convenience for the residents to the north.

Minnesota Department of Transportation's proposed
plans for Highway 12 in the future. Traffic volume
today suggests need for improvements soon. And
volume is expected to increase when 1-394 is completed

As to Brown Road, Olson noted that it is classified as a
collector street because of its location and function
but that it is built as a narrow residential street
Consisting of a oiled-surface over a gravel base.
This is similar to many of Orono's rural streets. In
the long range (5-10-20 years) this street and others
will need widening and upgrading to current traffic
safety and load capacity standards, even without any
commercial development. What staff is saying here is
that if commercial access approved on Brown Road,
and it does make good traffic planning sense to do so,
then that part of Brown Road between Highway 12 and the
new commercial access needs to be upgraded now to
current standards. The section north to County Road 6
would then be evaluated separately later.
Chairman Rovegno recognized Bill Wear and Judd
Ringer in the audience and asked for their opinions.
Bill Wear noted that he was in favor of the proposed
application. ^
Judd-Ringer stated that McDonald's is very thorough
and that that property is going to be developed
eventually, so why not have the best.

Rovegno noted that the main problems are with access to
the property and the increased traffic problems.
Also availability of sewer and water. Rovegno noted
the Police Chief's report concerning past accidents
from Brown Road to Willow. Rovegno requested that a
I map be made showing exactly where the accidents
I happened along Highway 12
The public hearing was closed at 9:04 PM and discussion
of the proposal was continued by the Planning
Commission members.
Olson noted staff's concern with the drainage plans.
He noted that there are three watersheds that cover
this property. One to Dickey Lake, one to Dickey Lake
outlet, and one to Highway 12 in a drainage ditch.
Staff has placed the applicant on notice that approval
of drainage plans will be subject to careful review of
pending capacity and discharge rates because of
existing downstream problems with flooding.
Kelley asked if there is storm sewer in Long Lai

and that the highway department maintains part of it

Orono, City of Long Lake, the Highway Department, the
Watershed District and the developer, for solving the
drainage issue

Rovegno asked if the City of Orono has had any
discussion with the City of Long Lake about this
proposal?
Olson noted that the City has provided Long Lake with
notice of this project and we have talked with the
Mayor of Long Lake although they have given us no
official response.
Rovegno asked for staff to ask again for the City of
Long Lake's comments about the whole project.
Gary Meyer, engineer for McDonalds, stated that
McDonald's was willing to submit that drainage plan
and noted that McDonald's has no problem retaining the
water that will come off their property.
Rovegno asked if the Orono Schools had been notified
about this proposal?
Mabusth stated that the public hearing was published
and that an off the record comment had been made by the
school district that they were happy to see it further
down in Long Lake and not on Willow where the students
would have easier access to the restaurant.

Kelley noted that his concern was with the increased
traffic that Interstate 394 will cause by bringing out
more traffic to this area. He noted that a traffic
study is very important.

Sime noted that he has had dealings with McDonalds in
the past and that if that property is going to be
developed that McDonalds is a good outfit to develop
that area. He noted his concern for the cost of the
sewer and water availability for McDonalds that it not
be assessed against the tax payers of Orono.
Olson stated that in all past Orono sewer projects 10i%
was assessed against the benef itting property owners.
Olson stated that it would take approximately 5 seirer
units for this size restaurant. Olson stated that
Judd Ringer had asked for sewer service at one time,
and that this application may bring him to ask again.
Olson noted that an engineering feasibility study is
necessary to answer all sewer availability questions.
Goetten felt that the sewer and water service for thi
property was the most important issue because without
sewer and water there can be no restaurant.
Kelley noted that there was no problem with the
rezoning or the McDonald's restaurant going in.
General overview of the proposal is fine and that staff
should look into the access off Highway 12.

Rovegno noted that this is a good opportunity for good
planning and that this should be looked into
carefully. He noted the need for a drainage plan for
the subdivision application and suggested that the
application be tabled.
Rovegno moved to table this application on the
Planning Commission's agenda sending the application
to the Council with consensus that the project seems
reasonable if the technical details are capable of
being accommodated and that whatever studies are
necessary be done so that the Planning Commission can
do a complete review and particularly the public
comments raised on safety.

Dick Conry was present. Mabusth noted the certificate

Wear of 36 Hackberry Hill was present from the audience
for this application. _
Mabusth noted staff's only concern was the access
issue. She noted the proposed plan for 13 lots
^achieving access onto the surrounding collector
p streets with a total of 8 new curb cuts with Some shared accesses.
Kelley noted his concern for so many lots gaining
access onto the surrounding collector roads. He
noted that in the future Watertown, Willow and Old
Crystal Bay Road will get more traffic than they do now
and that the City should start planning for that now.
He noted that some of the proposed accesses should gain
accesses from the through road or a new cul de sac.
Dick Conry noted that he had spent a great deal of time
to make the most marketable plan. He stated that the
proposed roads now added up to a mile and a half, and if
he was asked to add more road it would cost him more.
Mabusth noted that the City Engineer stated that the
surrounding collector roads could handle the
additional traffic which would develop from this plat.
Bill Wear of 36 Hackberry Hill noted bis concern with
the drainage. He stated that there is a blocked
culvert and that blocked drainageway raised the water
level within Hackberry Hill.

Kelley noted that with Interstate 394 coming out in

the remaining lots and that this phase II could be the
last plan reviewed by the City for him.
Kelley moved to deny the Lake Minnetonka Homes
subdivision application finding that it may affect the
health, safety and welfare of the public in Orono.

Rovegno noted that the City could approve just phase II
of this plat approving so many curb cuts for the
property and that irhen the developer comes in for
developing the rest then that will be a whole new
subdivision.
Rovegno moved to approve the four lot plat (phase II)
of Lake Minnetonka Homes, Inc. finding all lot
standards of the RR-IB zoning district and the Orono
On-Site Septic Code have been satisfied and that the
overall road plan for the Countryside Manor plat of 40
lots is acceptable. Based on the following

lots exclusive of roadways, drainageways,

Applicant to assume risk of the buildability of a

Kelley minority opinion - Kelley noted that there is a
need to address the appropriateness of the curb cuts in
the northeast corner of this plat and also the total
development. He felt there request was in excess of
what the City should grant.
Guenther Roth's plant manager, George Stodola, was
present. Mabusth noted that Mr. Roth cannot accept
the garage going on Lot 8 and Mr. Roth prefers the
garage to go on Lots 17 and
George Stodola noted Mr. Rothes concerns with the

*khat Mr. Roth doesn't want to be so limited that he
cannot update his property. He stated that Mr. Roth
requesting that the garage be put on Lot 17 and 18.

Rudolph Hoch was present. Gabriel Jabbour was
present from the audience for this application.
Mabusth noted that this involves a standard in the
L.N.C.D. code, which the City has adopted, regarding
setbacks for docks based on the extended side lot lines
for Nr. Hoch*s property, which converge at a 63' point.
Mabusth noted at a 60' point his dock should be 15* from
those extended lot lines therefore he is asking for 0
setback variance. Mabusth noted that in this
neighborhood that all the lots have this problem.
Mabusth noted that the LNCD limits the applican^to one
boat. She asked when Nr. Hoch constructs th4<dock,
based on the understanding of the neighbors as stated
in the signed affidavits, that the dock and boat will
not extend beyond their lot lines.
Mr* Hoch noted that it would include the width of his
boat and that both the beat and dock would not encroach
over the extended lot lines.
Gabriel Jabbour noted that heli^iS no problem with Mr*
Hoch's placement of the dock, but that in the future if
Nr. Hoch sells, a new owner could come in there with a
bigger boat. Jabbour noted that he has no problem
with the proposed dock placement provided that the
neighbor next to him has no problem and so on.
Rovegno moved to approve a variance for the boat/dock
setback requirements in the authorised dock use area
at 875 Partenwood Road based on the following
conditions:

boat location when applying for a building permit.
