Absent: Planning Commission Members Callahan and Kelley. Also present: Zoning Administrator Mabusth, CounciImember Hammerel, and City Clerk Strom. Zoning Adminis­ trator Mabusth presented the Affidavit of Publication. / f/ ,* ■h~y Mr. a Mrs. Edward Lehman were present. Zoning Administrator Mabusth reviewed the new survey with the Planning Commission members. Discussion included lake footage for the proposed lots, riparian rights for the lots, and access to County Road 15. . After all persons present were afforded an opportunity to be heard. Member Goetten seconded, to approve the lot line rearrangement request of Edward Lehman, 3525 Shoreline Drive, per the following findings: 1. There are no changes in the factual findings made at the time of the 1977 subdivision review. 2. The applicant has added additional land and has greatly improved the proposal from the original subdivision. > ^ 3. Sewer is available to the property. Approval is subject to the following conditions: 1. Lots 2 6 3 are to share a single dock located in Outlet B. 2. Lot 1 is not riparian to Lake Minnetonka. 3. Lots 3 6 4 must maintain allowed har^over allowance as follows: Lot 3 - 31‘;5 sq. ft. Lot 4 - 2725 sq. ft. •. • 4. Applicant to quit claim deed Outlet A to th^ City as part of the public waters. # 5. Applicant/owner of Lot 5 must hookup to City sewer prior to final plat approval. i;w 6. At present, the lagoon is navigable and the approval of this plat by the City does not permanently v«st each approved riparian lot with future boat navigation to the main lake but doeR encourage general riparian uses. Member McDonald stated that Lots 2 6 3 do not qualify for riparian use as the total lagoon shoreline of approximately 360' does not meet 100* per four lots. I At 8:20 P.M., Chairman Rovegno announced that now was the time and place for the public hearing concerning a metes and bounds subdivision request of Richard Ogle, 2765 Shadywood Road. Zoning Administrator Mabusth presented tha Affidavit of Publication. mMm % Mr. Richard Ogle was present. Chairman Rovegno seconded, to recommend approval of the metes and bounds subdivision request of Richard Ogle, 2765 Shadywood Road, per the following conditions: «s»:: 1. Applicant submit a copy of easement agreement granting existing dock ownership to Parcel B. | w. . % 2. Parcel A a Parcel B may have one dock each either on lagoon or main lake.
