Committee members reviewed with the applicant, Charles Maciosek the written responses from the abutting property owners and most affected property owners by the encroaching docks. The Committee advised Maciosek that they would require updated written approval from each property owner with every annual license review# Grabek moved to recommend approval of a 1983 joint use dock license for Sandy Beach Shores subject to the following conditions: 1. IA:A'V^ Ws-: Robert Snook represented the Power Squadron. Mabusth advised the applicant of the rec#nt deficient payment with the application for a proposed level of use at 45 slips. Snook stated that he %#ould submit the additional payment. Prahm asked the applicant to review the existing septic system serving the facility and the program of maintenance. Applicant stated It was a sealed vault system and that the clean up maintenance crew were responsible for annual maintenance. Frahm advised that a sealed vault system was in violation of the City’s codes and per that same code would have to be replaced by 1988. Member Grabek vacated his seat on the Committee so that he could represent the application of the Forest Arms Homeowners Association as their current Chairman. Frahm stated that it would appear the agreement between the Association and the City pretty well determined the course of action for the Committee. Grabek stated the shared docks have been is use for several years and that all interior lots were sold as riparian to Lake Minnetonka via the shared dock area. Frahm advised that although the agreement approved a total of 14 slips (subject to resolution of common ownership issue for one property owner) that he would recommend that current approved level be given for 12 slips based on the number of developed lots. The agreement would assure the applicant of a future level of 14 slips. Frahm asked that in lieu of a survey that applicant submit letters from abutting property owners affirming their approval of the proposed dock layout for 1983. i-sPi - .'V!' It’i - i; Kiii&i The applicant, Larry Hork was present. Hork reviewed the current status of the proposed agreement between North Sh.re Drive Marina and the LMCD. He advised that all discussion had come to a halt. Steve Pauly, Dennis Keating and Jack McDonald represented Chaska Marina. Mabusth noted that the service slips and rental slips had not been designated on the proposed dock layout. She advised that because of the two slips on the east shore that encroach Straley's dock use area it is not clear if the Marina plans to use the t%#o slips in the '83 license year. Pauly advised that the subject slips are to be in use in the '83 season. Mabusth advised that once again the City will ask that Str^leys approve their use. Frahm asked why the landscaping had not been completed as required in last year's license. Pauly advised there was a plan to change the access drive and location on the east side. Pauly stated that the plantings should^ be completed by the end of May. P Frahm moved to approve a 1983 commercial dock license for Chaska Marina subject to the following conditions: 1. Prior to scheduling the application for Council action the following must be submitteds a) letters from abutting property owners (Kane and Straley) approving dock plan for 1983 season. b) dock plan designating service and rental slips 2.
