meeting Garfield Clark, President of
the Poxhill Homeowner's Association advised
tnat he was unable to attend the rescheduled
meeting. Commission members felt that as long
ff proposed in the dock layout for
> season that they could act on the
^ application. Frahm moved to recommend approval
of a 1983 joint use dock license for the Poxhill
Homeowner's Association. Goetten seconded.

The representative for the Minnet nka Power
Squadron was unable to attend the rescheduled
meeting. Prahm noted that although the Power
squadron proposes no changes in the dock layouts
he has questions related to the existing on-site
system. Prahm moved to table the license
application until the next regularly scheduled
meeting of the Marina Committee. Goetten
seconded. Vote: Ayes (3), Nays (0),
Maciosek the applicant and owner of Sandy
Beach Shore was present. Members questioned
staff as to the current status of the year round
rental unit complex still referred to as Sandy
Beach Resort. Mabusth advised that in 1987, at
the time of the rezoning, the seasonal resort
obtained a conditional use permit for a non-
conforming use. In review of the files, during

seasonal to year round use. Bach cabin was
approved for 1 sewer unit. The City did not make

Mabusth reported that Maciosek has owned the
property since 1978 and has continued to improve
the site. The City has received no complaints
concerning its use.,.s=

'The applicant stated that his application asks
for a seven slip dock based on previous years'
level of use. Aslipt#ould be available for each
of the rental units. Mabusth advised that in the
absense of a survey, it was impossible to
determine if there was sufficient dock use area
to permit the seven slip use. Staff reviewed the
plat map of the immediate neighborhood noting
that if the side property lines of the neighbor to
the northwest were extended that it severly
limits the "Resorts* dock use area. Mabusth
noted that this is a new application and that the
L.M.C.D. would have to apply the formula of 1 boat
per 50* of shoreline. The subject property has
185* of shoreline limiting the density level* to 4
slips.
Grabek'^uestioned the real need for a survey
since Maciosek had reconciled the encroachment
problem on the south side of the property two
seasons ago and that unless the neighboring
property owners were still complaining, the City
should be able to make a recommendation without a
survey. Prahm questioned to what degree the
City would be held legally responsible if there
was an accident and the City approved the license
without some type of approval from the neighbors.
The docks are far removed from the heavily
trafficked area of the lake and the area is
limited to local boat users. Prahm moved to
table action on the licnese application subject
to the applicant obtaining letters from the two
adjacent property owners noting approval of
proposed 2 dock, 7 slip layout. If the applicant
is unable to obtain the necessary letters then a
survey of the shoreline and dock use area will be
required prior to any action of the Marina
Committee. Goetten seconded. Vote: Ayes
(3), Nays (0).

that once again the application involves no
changes from last years level of use nor in the
dock layout. Prahm moved to recommend approval
of a 1983 commercial dock license for the
Minnetonka Boat Works. Grabek seconded.

James Rivers the applicant was present. The
Chairman noted that he had no proolem with the
proposed application but advised the applicant
that a current letter from the Minnetonka Boat
Works approving the setback of the most southern
dock on Tanager Bay was required to complete the
review. Rivers staced this was no problem.
Frahm moved to approve a 1983 commercial dock
license for Windward Marine subject to the
applicant's submitting the required letter
prior to Council action. Grabek seconded.
Vote: Ayes (3), Nays (0).
Jon Vogt represented Sailors World. Frahm asked
if the Marina maintained a fire extinguisher at
the gas pump. Vogt stated that they did not, but
would be happy to Install one. The applicant was
asked why he had not complied with last years
license by designating each parking stall.
Grabek advised that a chain device was easier and
cheaper to install than the individual post
method agreed upon in last years license.
Members stated they had no problem with whatever
method is decided upon but that parking stall
designation must be completed in early spring.
Grabek moved to approve a 1983 commercial dock
license for Sailors World subject to the
following conditions:
1. Fire extinguisher must be installed at gas
pump
2. Individual parking stall designation to be ^
completed by May 1983.
Goetten seconded. Vote: Ayes (3), Nays (0).

advised that the applicant purposes no change iit
the level of use nor has the City received any
complaints about the use of the property.
Grabek moved to recommend approval of a 1983
commercial dock license for Crystal Bay Service.
Goetten seconded. Vote: Ayes (3), Nays (0)
The applicant was unable to attend the
rescheduled meeting of the Marina Committee.
Frahm moved to table action on the license
application until the applicant could be present
at the review meeting. Goetten seconded.
Vote: Ayes (3), Nays (0).
The Marina Committee adjourned at 5:45 jF.M.
