Zoning Administrator Mabusth noted that the subject property is a 72 acre parcel; 6 acres of wetlands. Mabusth noted that applicant is proposing a 20 unit PRD subdivision. Mabusth noted that it is currently zoned 5 acres and the applicant is proposing 2 acre rezoning with the current plan showing 3.3 unit density. Bastyr stated that substantial berming would be placed along their proposed roads within the subdivision. Bastyr stated that right across the street is a 2 acre zoning district and that most of the lots around there are under 2 acres, so that their proposal would fit right in. ■-• .1 wmmaAmF"Bernard Hames of 4455 Bayside Road (10.34 acres) asked what market research has been done in the ability to sell these homes and at what price do they intend to sell the homes at. Jeff Nartineau, realtor, stated that the price range of the homes would be from $200,000-500,000 homes. Martineau stated that from his experience in real estate that there is a great demand for these types of horns and for this type of well-done development. Martineau stated that the square footage would be approximately 2,500 for a one story home and 1,200- 1,400 per floor for a two story home. Bastyr stated that in this type of development they have no experience. Lucy Yogerst of 4740 Bayside Road Stated if the object was to keep everything in character, why 20 homes instead of 13 home sites, why rezone it to 2 acres when 5 acre minimum would be dense enough. Ron Bastyr stated that they chose the lots individually and that they felt that 13 was too few. Zoning Administrator Mabusth stated that that application was formally withdrawn. I Margaret Olson of 4645 Bayside Road (18 acres) stated I that she wasn't in favor of the rezoning and feared that it might invade their privacy. Ron Bastyr stated that this development would be unique because of the substantial berming which would keep the privacy. i>-V. Margaret Olson of 4645 Bayside Road stated that it is not just the privacy but also the possibility of sewer coming down Bayside Road. Wi Chairperson Goetten stated that is why it would be 2 acres which would allow enough room for septic systems. Peter Achey of 4720 Bayside Road (1.06 acres) stated that Orono's own Zoning Code paragraph 34.001* says that "R-IA requires that districts shall have immediate access to highways and public sanitary sewers.” Achey stated that the RR~1A requires a 5 acre minimum lot size to stear away from sewer. Achey stated that is the reason that there still is the 5 acre zone so that sewer won't be required. .• .21 2 . yyv:; -"v y , yf ;.' A Zoning Administrator Mabusth stated that there are -^sections in the Comprehensive Plan where it specifically states that the City is aware that to really sustain a rural lot* 2 acres is completely adequate to satisfy a septic system with an alternate site. Mabusth stated that the 5 acre zone is there because the people in the area wanted it that way and that it really isn't a necessity* but that it was the peoples desire. Mabusth stated that there is no worry of sewer going down that street. ^ ■xm. Peter Achey of 4720 Bayside Road stated that in the city's own publications that it was estiiMited in 1975 that it would cost approximately $10*000 per acre to sewer that area.m ■ ■.J. • Zoning Administrator Mabusth stated that it would cost ¥mm.nore today. sm m: Chairperson Goetten stated that she didn't think inyone has given* or will give any indication* that they want sewer in this area. Carlson stated that he was opposed to the resoning to 2 acres. Carlson stated that after a ong study the Council zoned that area for 5 acres for the benefit of the community only 10 years aqo. Poison stated that between his property and the subject property it is undeveloped land. Poisson stated that it has always been his understanding that zoning is changed because of a philosophical change on Tk ® part or because there is a real hardship in the case of the property owner. Poisson stated that there is no hardship here and why should it be resoned t® help someone make money. Poisson stated that it ^ helping the City. Poisson stated that any PRD that comes in has to meet current standards. Poisson stated that his concern is acreage next to him ready to have the same thing happen to it* Poisson stated that right now the neighbor can put one house on the property next to him and if it was rezoned the neighbor could put two houses. Mabusth stated that the thrust of this specific rezoning application was that it had natural boundaries built in. Mabusth stated that it is indeed on the edge of the 5 acre zoning district. Mabusth stated that it is bounded by McCulley Road, luce line on the north and the nature conservancy, that they felt it was a locked in area. Mabusth noted that it is two acres zoning district to the south or right across the street. V •.• • ‘V-'< .:■• Martineau stated that they have talked on many different occasions about these lots, and the developer has stressed that he wants to do it right. Zoning Mministrator Mabusth stated that there'was feasibility study being done. 4- Bo^Cuff of 4660 Bayslide Road stated that he had inside information that a feasibility study has been done by Commission and that It this development goes in as proposed, there will be sewer going down there. ^ Zoning Administrator Mabusth stated that the City knows nothing about such a study being conducted. Bob Cuff of 4660 Bayside Road stated that he didn't want sewer and water being installed. Why not leave it at 5 acres. Zoning Administrator Mabusth stated that there is « feasibility study being done on County Road 84 but not for this ared# bu^ for bho Stubbs Bay area* McDonald stated that when you talk rezoning with the Met Council that you do start waiving flags for services such as sewer. McDonald stated that Orono needs a rural area and that she is sure that those lots would sell. Chairperson Goetten read for the record a letter from the Assistant Director of Land Stewardship from the Nature Conservatory (attached to these minutes). Bastyr stated that if the rezoning wasn't approved that the lot would be sold and that this development probably wouldn^t go through. Rovegno moved to table the conditional use permit an<f the subdivision application until Council decides whether the rezoning will be approved or denied. McDonald seconded* Vote: Ayes, (5),i?Nays (0). Rovegno moved to deny the rezoning based on the finding' that it is not in the best interest of the physical development of the City and based on the neighbor opposition, but further ask the applicant to continue with this type of plan but with a lesser density. McDonald seconded. Vote: Ayes (4), Nays (1). Adams minority opinion - Adams felt that this was a' reasonable development for Orono. Adams noted that the school districts encourage development because it increases the number of students. Adams stated that the Planning Commission is often biased in keeping Orono at the lowest possible density and that may not always be in the best interest of the community. Zoning Administrator Mabusth ?,tated that Bill Gagne wanted to subdivide his property and that Hennepin County wanted to construct a library. Mabusth stated that under the present zoning code that libraries are only allowed in the B~4 commercial zoning district. Mabusth noted that Council suggested amending the existing RR-IB zone to include library use as a conditional use rather than iezoning. David Smith stated that they were planning on closing the Long Lake and Medina libraries. Smith stated that the Maple Plain library may eventually be phased out. Earl Johnson stated that he would prefer amending the current conditional use standards rather that rezoning the property. Johnson stated that Mabusth had informed him if they amended the conditional use standards that they may be subjected to the 2 acre minimum rather than the proposed 1.51. m m : ■ • 'icelley asked how they determined the parking spaces and what the h*^rs of operation would^^. ^ David Smith staged that he figures 5 spaces pir 1,000 sguare feet for a suburban library. Smith stated that they have provided more than enough parking area. Johnson stated that 1.51 acres is plenty of room for a library. ^ Rove^^o stated that he would rather amend the conditional use section rather than rezone the property. Rovegno felt this was an ideal location for the library, ^ | Kelley stated that he would rather see the whole sito^ plan for that corner along with the libraries. Kelley | - felt that this was a good area for the library. ^ Bill Gagne stated that the library prol^bly wouldn’t want to wait that long and that his development 1.8 not the application right now.
