Revised total plan showing access roads and an attempt to reduce number of accesses onto surrounding collector streets. Vote: Ayes (5), Nays (1). Adams Nay. Adams stated he felt we should give some direction to the applicant about the number of access roads. Zoning Administrator Mabusth and Mr. Mills reviewed the application for the Planning Commission and adjacent property owners Mr. and Mrs. Ehalt. Zoning Administrator Mabusth suggested to Mills to consider a shared driveway with the newly created lot. Adams moved, Kelley seconded to table this application until septic testing and an alternate drainfield site has been selected. Vote: Ayes (6), Nays (0) MCLAIN ILWlltllC f PART OP BROOK'BT RING P.M. Planning Commission v»as informed that no adjacent property owners would lose access to their property. Adams moved, Sime seconded to cpprove the vacation of the westerly 100 feet of the 20 feet wide unimproved platted right of way of Brook Street as platted in the Bayside Addition to Lake Minnetonka based on the following findings:' 1. Rovegno stated he would add number 3 to the conditions in his motion. 3. If necessary the City call in a health authority to insure health standards. Sime seconded. After discussion with the Commission and the neighboring property owner who stated that after the problem with histoplasmosis the board of health inspected that area they asked to church to put in a cement platform leading out of the church so that if bat droppings and pigeon droppings did occure they could be washed away. Then the bacteria doesn't grow and the church did do that. ^ Rovegno withdrew condition number 3 of his motion. Sime seconded his withdrawal. Rovegno restated his motion to include intital staff recommendations 1 and 2. Vote; Ayes (6), Nays (0) • #817 STEVEN EASTER 2675 POX STREET VARIANCE - CONDITIONAL USB PERMIT Mr. Raster and Don Hess from Landplan who did the basic design for the project were present. Gordon Buhrei of 2620 Fox Street, across the street from Mr. Raster was also present. • Mabusth read the engineer's letter regarding this application which stated; We have reviewed the Raster application for the dredging of a duck pond in the wetlands area. The application is in violation of the City Comprehensive Plan relative to dredging of wetlands areas. The Raster marsh is located upsteam from the French Lake marsh which is approximately 140 acres and serves as a ponding area for watershed of approximately 850 acres. The dredging of the Raster marsh for the duck ponds would have an insignificant effect on the over all assimilation of nutrients from the watershed and therefore the water quality being discharged into Lake Minnetonka. The dredging for duck ponds in the Raster marsh is vary similar to the work completed at the Orono public school marsh a few years ago. I view this application as a real unique opportunity for someone to possibly restore that marsh, an upland water retention area. I would like to ask the Planning Commission reaction to the possibility of filling or at lease partially filling that drainage ditch so that the entire marsh could become an upland water retaining pond. And of course the ponds that you propose I view as an improvement. If the dredging is approved for these ponds I would be more comfortable with the application if the dredged material were hauled away to another site or deposited on high land because they will have an effect of eliminating some existing marsh land. Goetten stated that she felt that 160 truck loads of dredged materials was not insignificant. This particular project is in direct violation of our comprehensive plan. Sime stated he felt this would be an improvement to the existing situation. Rovegno stated he was with Sime and Adams and he stated that Hennepin Soil and Water Conservation District has no adverse comments, DNR is generally in favor of projects, our city engineer says it is probably insignificant. The only thing that anybody said here that's a problem with this is that it violates our ordinance. Kelly stated that if we are going to give variances to designated wetlands I think we should establish very strict standards, because we are going to be inundated with applications from all over the city for dredging for wildlife ponds. Rovegno moved, Adams seconded to recommend approval of this conditional use permit conditioned on the findings is that we have professional testimony from Hennepin Soil and Water Conservation District, the DNR, our city engineer all finding that the effect on water quality and additional runoff is quote unquote insignficigant. That our comprehensive management plan item 7 of the general policy "protection of the City's marsh lands, wetlands, drainageways shall include protection of adjoining land prevention of drainage . filling, dredging, vegation removal ordinances will establish setbacks for all land alterations and construction possible. The City will acquire open space and flowage easements.
