The subdivision is currently in the process of rev'iew in the City of Medina. The current plat will not invol\-* residential construction within the 125 feet deep corridor within Medina. The obvious building sites fall within the Orono nortions. The septic test sites for hot 2 are within Medina. The existing houses' septic syst cm on Lot 3 i s 1 ocat ed somewhere within the Medina portion. All other septic test sites are within Orono. The lots all satisfy the standards of the RR-lB zoning district. The existing structures on Lot 3 al 1 meet the require setback from the newly created lot linos. Access Access to LotJ« 1 and 2 wi 11 be via Outlet A in the form of a private driveway. A private road must be constructed at the time PHillips develops the remainder of the lands in Medina. I will rtgxMt tlu*ir findings at our meeting. #913 Phillips Pago 2 May 15, 1985 Septic Lots 2 and 4's septic tests confirm suitable area for on-site septic systems. Lot 1 will require additional septic testing to confirm an alternate site. The currtint test conf i rms suitable area for one mound system. Staff suggests future testing shouId be done to north or east of test area. Perming should bo required along road edge to prevent runoff from draining over mound area. Berms will also protect mounds during toad construction. Alternate testing has not been provided for Lot 3; we will require the necessary tests. Drainage Concerns - Review Exhibit L) The wot area to the north of the culvert is created by the runoff from County Road 6. The area serves as a temporary retention area until runoff drains to south side of road to the wet land area on the northwest side of Dickey Lake. To protect the integrity of the building envelope, it will be necessary to determine the effects of a 100 year storm on the bui Idi ng envelope with the present elevations . Once» the capacitv of the retention area is determined, we may recommend specific land alterations to either raise the building site at the stage of site planning or berm around the retention area. A drainage easement will be taken over defined retention area. The area of that retention basin must be excluded frorti dry buildable area for Let 1. Recommendation To reconimend approval of the Ineliminary plat application of Paul Phillips finding all standar<is of the RR—IB zoning district and on site septic code have been satisfied based on the following conditions: 1. Proposed Lot 2 has maintained the required lot width along the lakeshore at 148.58'. The dock has not been designated, applicant should be advised of setback requirements and possible need to relocate dock. The areas of both lots have not been diminished but maintained at 1 acre minimum. The only unfortunate aspect about the application is that the owners had to pay the additional costs of a plat. Staff recommends approval of the proposed plat of a lot line rearrangement for G.W. Krimmel and Bruce W, Engelsma based on the following findings; 1. The lots each contain the minimum required 1 acre in area. 2. All existing structures meet the required setbacks from the newly created lot line. The well and septic system for Lot 2 are not affected by the lot line rearrangement. Lot 1 will gain frontage on Salem Court, which will all ow a house placement facing the road, uniform with the remainder of the neighborhood. The sites previously tested for the septic system occur in the northern portion of the lot. Although a portion of the test holes are just over the proposed boundary line, a review of the boring and perc test logs indicate that the soils are fairly uniform throughout, and with the existing fairly level topography, there should be no [problem in sliifting the drainfield sites sliglitly to the south. These will be mound systems due to a seasonal high water table. No further soil testing is required. A footing drainfield tile currently extends from the house on Lot 2 to the northeastern boundary of Lot 1, discharging to the road ditch. A drainage easement should be granted by Lot 1 in favor of Lot 2. There are no wetlands on either property. In the metes and bounds survey, the apf)licant should show the four parcels A, B, C, and D an shown in Exhibit G. Parcels A and B wi 1 1 be combined and C and D wi 1 1 be combined. Most of the work proposed is within the 0-75' setback area. His existing slope is about 38% according to the existing grade topographic submittal. The proposal would decrease the slope to about 25% on the averme, but would eliminate the flat plateau which currently acts as runoff percolation area. City Engineer, Glenn Cook, has reviewed the proposal and made these comments: 1.The proposed contours as shown do not accomplish the stated pui pose of conforming to the neighl>oring property contours . Note tliat the property to the north has extensive retaining walls. How will the grading conform to these? On the south side, where slopes are less severe, it would likely require less removal of material to conform to the neighboring grades. 2.The proposed grade changes vi11 eliminate the existing 30-40' "plateau" area of 6% slopes or less, which now functions as slow- runoff and infiltration area, and change the entire lakeshore yard to slopes of 24-30%. From a runoff i nfi11ration standpoint, this is not necessarily a beneficial project. One-third of the lakeshore yard which formerly had relatively good infiltration characteristics will be retluced in infiltration capacity. i #910 Hoff Page 2 May 17, 1985 From a maintenance standpoint, the applicant is correct in that the flatter grades will make maintenance easier. The "safer access” concern may be valid, but with a minimum slope of 25% after the proposed grading, won't a stairway still bo the preferred method of getting to the lake? Perhaps the applicant can shed some light on his intent with this project. V\’e would suggest that if you fed some or all of the work proposed should be al lowed, that the appl icants enqinecr should revise his proposed contours to indi cate what will be changed the north and south property lines to conform with the neighboring lots. When you review this site, it may be helpful in your visualizing of the proposal that the final grade at the point where the steep slope starts downward will be 6 ' below that point in the area midway between the side property lines. The lot is partially in the LR-lB and partially in the LR-lC zoning districts. Which set of performance standards do you feel should apply? There are a number of factors which affect the buildability of the lot: 1. 2. Access - The property is located on the "S" curve on County Roads 19 and 51. Located within the 75-250' setback zone, the property is limited to 2,383 sf of hardcover, which should allow for the 1,000 sf house proposed, plus a driveway. Please review the study of neighboring developed lot sizes. The study includes all developed properties within 100' of this lot. Note that 91% of the existing developed lots are larger than this lot. The median lot size is 0.46 acres (half greater than 0.46 acre, half less than 0.46 acre) for the 78 properties in the study area. Lot Width - Depending on which boundary is considered "front" yard, and depending on which set of performance standards are chosen, a lot width variance may be necessary. History of Use and Ownership of the ProtH^rtv. - A seasonal cabin existed on the lot until fall of 1968 when the owner, Gary Setterstrom, tried to put a basement under it and destroyed the cabin in the process. Setterstrom subsequently asked for and w'as granted a variance to rebuild or sell the lot (parcels 5200 and 6000 combined) as a building site per Council approval on April 28 , 1969 . Setterstrom owned the lots until 1977 and 1978 when they were forfeited for nonpayment of taxes. The City approved the release for sale of the easterly lot via Resolutions #937 and f944 in 1976, and Resolution #1046 in 1979. The westerly lot was released in February, 1981, via Resolution #1250. The fjond will serve as a collector basin for all runoff froma small local i zed watershed--house to south, front yardof Schultze house and area to the immediate north (see Exhibit D). He proposes to remove the garage, the dirt under it, and the existing failing foundation walls, and replace with actual living space. In the process, he proposes to "square off" the left rear corner of the house, and will no longer have a garage on the property. In tact, he would requ i re extensive variances i f he ever wanted to place a garage on the property in the future. He also proposes to arid a screen porch on the lake side of the house, and a deck waIkway along the lef t side of the house (see Exhibit F). There is no question that the proposal will improve the appearance, livability, and safety of the property. However, portions of the proposed additions fall within the 0-75' setback area and will increase the hardcover slightly in the 0-75' setback zone. I also do not see a stai rway leading to the ground f rom the deck, and wonder if one is planned. Mr. Fegers and his builder have questioned the measurement of the lakcshore setback as shown on the survey, noting that the water is at a high level at this time. Indeed, by Code the lakeshore yard is measured f rom elevat ion 929.4 MSI., whi ch in this case is located at some i ndet ei mi nat e point in the marsh vegetation bord<?ring the open water . In discussing this with the surveyor, he noted that it is not feasible to determine a 929.4 contour in marshlands such as this because the hummocks and mucky soil material ("loon poop" if you will excuse the expression) <lo no yiel<l a st.ible, uniform bottom. If the water elevation were at 929.4 right now, it might still be very taxing to define the contour. Since the surveyor he-’s stated that 929.4 could be as muc'h as 15' furthf'r out than the ('dge of the low ground, staff ft'ols it IS accei-tabJc to measure from 15' past the low ground in this li i #920 reqerc Page 2 May 15, 1985 specific case. Note that the wctlaiifis maps show this ar. marsh area. (I have based my hardcover ca1 ('ulations on the setback measured 15* past the low ground.) Please review Exliibit D. Applicant has stated ho is willing to remove certain items of hardcover to help compensate for the proposed additional hardcover. In tlte 0-75* zone, hardcover will increase from 125 s.f. (3.2%) to 194 s.f. (5.0%). In the 75-250* zone, hardcover will increase from 1,319 s.f. (53.8%)tol,J9ls.f. (56.8%). Note also tliat this application requires a variance to the code sect ions which proliibit structures in the 0-75* setback zone, and also to the average setback with the neighboring structures. The neighboring property owners have been notified of the public hearing, but have not commented on the project. Note that the structure to the west does not appear habitable, and that the proposal will not affect views of the lake from either structure. In summary, the following variances arc requested; A. Hardcover 0-75* - increase from 3.2% to 5.0% 75-250* “ increase from 53.8% to 56.8% B. Lakeshore Setback - proposed 63'; 12* variance C. Average Setback - approximately 8* variance One of the options you have is allowing the squaring off of the house without the screen porch or deck. I think this is comipletely justifiable. The proposed tradeoffs in hardcover decrease the impact of the added deck hardcover. 1 also feel that this is not a realistic site to consider the "deck ground ticatment for non-hardcover", since the decks for the most part wi )1 be 3* or niore above ground. Note that the proposed deck along the west wall is 3* wide, leaving about a 4* setback for the deck. The non-encroac:hment section of the code allows an uncovered dock at ground f Icor level ’■o extend to wi t hi n 2 ' of a side lot line. The section does not discuss whether railings are an encroachment; railings will certainly be required in this case. Apparently, the footing excavation had been done for the house portion only, not the garage, and the contractor had started to pour footings prior to inspect ic;n. V\’hcn the inspector arrived midway through ♦^he pour, he had the contractor expose portions of the poured area to verify the soil base, and he noted that the setbacks appealed to be OK. Some days later, presumably when the garage footings wcie excavated, :t became obvious that the footing contractor had actually mtHde a . stake and had located the house so that the garage would end up 11 ‘‘rom the pro perty line. At this point, some work had been starter on the block foundation walls, but the foundation was not complete, accv^rding to the building inspector. At this point the applicant canie to the City to discuss the problem, and suggested that ra«.her than start over, because he had sizable investment in the work done* so far, that he would prefer either a lot lin* rearrangement with t b.c' adjacent lot (which he owns), or would request a setback variance. Staff advised apf>licant that he would l>e proceeding at his at his own risk in continuing work on the house portion; that he und*?r no circumstances would be allowed to pour the garage foot infjs until tfie prol)lem was reiiol vod; cind that theie was no guarantee that a variance or lot line rearrangemerit wculd be granted under the circumstances. Applicant thor subniit.tecl the* application for a variance, notincj that because of the likely location of the house to the north, a variance would not have a visual crowding effect on the properties. As of this writing, he has continued with the house (framing appears completed) but has not poured the footings for tlie garage. Considering the specific circun;stances, a lot line rearrangemnt would be possible that would create the required 30' side setbacks while maintaining over 2.0 acres on each property and not affecting either lot from a septic site or aesthetic standpoint. The applicant would prefer the granting of a variance. Obviously a variance is a less costly procedure. Please consider v/hether you are comfortable granting a variance for new construction, or whether you would prefer a lot line re arrangement . The addition is proposed to include additional 2nd story dock, portions of which are proposed to extend into the 75* lakeshore setback zone. It is likely that this deck could be redesigned to eliminate the encroachment. Applicant proposes tradeoffs in hardcover so that there will be no net increase in hardcover on tlie property. Existing 75'-250' hardcover is 44%. As noted above, in reviewing the construction plans staff noted a second kitchen proposed to be installed in the lower floor. Applicant states that he plans to buy the home frem his parents since they are near retirement, and his parents would live in the basement unit. This second dwelling unit requires a conditional use permit. The property is only 0.27 acre, not meeting the 1.0 acre which would normally be required in the 1/2 ‘^cre zor.e for a guc;st house use. Applicant is willing to agree to never renting out the second unit. Perhaps a "temporary ” guest apartment conditional use permit would be in order, such as was granted to Edward Bcck on North Arm Drive. (A copy of that resolution is attached.) The average setback variance required is due mainly to the location of the house to the south an average of 100’ from tlie shoreline. The neigh bors to the north and south (Christianson and Hartwell, respectively) have given written approval of the project. Staff would suggest tliat the average setback variance be granted based on the hardsJiip of the location of the existing building; that the 76'-250' hardcover variance be granted subject to removal of an equivalent amount of existing hiardcover; that the deck be redesigned to not encroacli into the 0- 75' setback zone; and that t)ie applicant be required to file for a condi tional use p«.*rmit for the temporary guest house use, for public hearing at your May meeting. Chairman Callahan announced that now was the time and place for the public hearing concerning Jon Scherven's variance. Assistant Zoning Administrator Gaffron noted the certificate of mailing and the affidavit of publication. There was no one present from the public for this application. Assistant Zoning /administrator Gaffron noted that the appli cant is proposing to bui Ida two-story addi t ion over the existing concrete slab and deck on the lake side of his parents home. Gafiron noted that in the construction plans a second kitchen is proposed to act as a second dwelling unit that his parents would live in. Gaffron noted that the applicant proposed equal amounts of hardcover tradeoff. Rovogno noted that ho has no problem with the variance because of the trade off factor but that he has a problem with the condit iona 1 use permit because the property does not have adequate area to support a second dwelling unit. Kelley felt that the City could place the same restrictions on Schorven’s application as they did in the Beck's applicatioi.. Kelley felt that the resolution should be filed in the chain of title and require* that the conditional use permit not transfer to a new cwner. MlNUTF.r. This use is subject to City review at the end of four years. Jon Scherven stated that he will need more than four years as his parents plan to retire there. Scherven noted that the house needs upgrading and he proposes to do that. Zoning Administrator Kabusth asked if there was a separate entrance to the guest apartment use. Jon Scherven stated that there is the main entrance to the vestibule and then a door leading downstairs and a door leading to the upper level of the house. Rovegno noted that this would bo like a duplex on a quarter of an acre. Rovengo felt that this was not enough area. Chairman Callahan closed the public hearing at 10:00 p.m. Taylor move, Sime seconded, to recommend approval of the variance based on the hardship of the location of the existing building and that such approval of variance is subject to removal of an equivalent amount of existing hardcover and the deck may not have concrete underneath the deck if it extends into the 0-7S' setback area and to further recommend that the applicant he required to pay the fee for a conditional use permit subject to the following: 1. The guest apartment is for use of family members only. 2. This guest apartment use may not bo conveyed to a purchaser of the property. This parcel of just under six acres contains a small existing house and the foundation remains of the Andromeda Church parish hall. The proposed lots would each require a lot area variance to the subdivision code beacuse they are slightly less than two acres. All three lots appear to meet the 200' lot width requirer'ent (proposed Lot 3 is 1/4" less than 200') A drainage easement bisects proposed Lot 1 where a small intermittent creek runs through f rom cast to west. This creek drains the pond on the church property and a wetland just east of Leaf Street. The drainage easement comprises approximately 11,000 square feet within the proposed Lot 1. A conservation and flowage easement was not granted over this area as part of the original subdivision, nor was one granted over the pond on the church property to the east. The drain.age easement should be excluded from the lot area leaving a total of about 5.65 acres, or an average lot size of 1.88 acres. No septic testing has been done yet, but having walked the site, it would seem there could be problems locating suitable septic sites on proposed Lot 1. The applicant requests your direction as to whether he has a feasible application. Would you consider granting the lot area variances required?
