The City does not require septic testing for lots in excess of five acres in area. There is approximately 3/4 to 1 acre of wetlands in the northeast corner of the property. The City will as)c for a Flowage & Conservation Easement over that portion of the wetlands located within Parcel A. A 50' wide corridor has been creo'^ed providing access to the new lot via Stubbs Day Road. Note that sections of the Cram property run to the center and at points over the entire designated rights-of-way of Stubbs Bay and Watertown Roads. Since we are dealing with a metes and bounds division, the City will as)< for dedication of roadway via a quit claim deed. The City must address the issue of the two residences on Parcel B. The second residence cannot be designated as a guest house because it is a rental unit and so should be recognized as a non-conforming use and subject to all pertinent ordinances. The second residence shall become a conforming use at the time of a future subdivision of the property. MM I ► k ; staff Recommendation To approve the metes and bounds subdivision of the property located at 3760 Watertown Road for Catharine Cram creating one new residential, unit finding all standards of the RR-IA Zoning District have been satsified. Approval of the subdivision is subject to the following conditions; 1. Quit claim deed right-of-way for Stubbs Bay and Watertown Road. 2. Conservation and flowage easement over wetlands in Parcel A. 3. Payment of Park fee for Parcel A of $100.00. 4. Second residence on Parcel B is a non-conforning structure and subject to all pertinent ordinances. The division request is consistent with and a result of the discussions applicant had with former City Planner, Alan Olson when the Big Island ordinance was adopted. This lakeshore strip was somehow divided and torrensed as two parcels about 1970, but never approved by Orono and never divided for tax purposes. The City suggested that the applicant now bring this in for formal approval since ho is selling the involved projicrties. Please refer to Exhibits D and F. Record Lot #22 includes Lots 9, 10, and 11 of Me se Island Park (Parcel C on the survey) and the northerly portion of the lakeshore strip (Parcel A on the survey). The lot area of Record Lot #22 is 1.03 acres. Record Lot #16 includes Lots 6, 7 and 8 and both portions of Lot C in Morse Island Park, and the southerly portion of the lakeshore s^rip (Parcel B on t)ie survey). The lot area of Record Lot #16 IS about 2.01 acres. Although not a part of this application, note then that Lot 15, Morse Island Park will become Record Lot #70, and that the northerly portion of Lot 7, Morse Island Park 2nd Addition, will become Record_Lot_£71_. Both of these are u>ibuildable by themselves. This application is serving to tie up some loose ends left over from the adoption of the RS Zoning District ordinance. Note that the ordinance itself includes some errors in that Parcels 23-117-23 32 0013, 14, and 15 arc included in both record Lots 16 and 22. These protected waters of the City have been classified by the Commissioner of Natural Resources as follows: Natural Environment Lakes 1. French Lake Marsh 2. Lydiard 3. Dickey 4. Classen : .in r Recreational Development Lakes 1. Mooney 2. Tanager 3. Long General Development Lakes 1. Minnetonka 2. Forest General Development Streams 1. Long Lake Creek Staff reviewed the classification data used to determine these designations last year and concurred with the DNR findings. Review Exhibit A, this list notes the various criterias used in the study. The DNR has cstabli&ed a deadline of 1985 for all cities with protected shoreland waters to update their ordinances providing the standards and procedural implementation for their management. For our City, it will involve the amendment of Section 10.55 of the Zoning Code to include a shoreland overlay district that would govern future development of the areas immediately surrounding the specified protected waters. In the process of amending Section 10.55, staff suggests a review of the existing wetlands and flood plain sections to determine if there are omissions or a need to clarify or expand. Staff recomends altering Section 10.55, Subdivision 8, Develop­ ment Restricted; Prohibition, to delete the 26 feet setback from flood plain elevation. A flood plain and wetlands area are two different entities; if a flood plain is also a wetlands area than the , ■' < ■jfi' L 26 feet setback standard applies. Flood plains can bo grassed lawns, brush and treed areas - they do not serve to filter run-off as the wetlands. If there are wetlands within a flood plain then the wet­ lands setback will apply. Review Exhibit B, the model ordinance submitted for the City's consideration in the process of amendment. Refer to Page 6 of Exhibit B and Exhibit A, staff notes the following: 1. Residence on R.D. Lakes - Mooney, Tanager and Long which meet current 75' structure setback would become non-conforming. 2. Structures and septic systems on NE lakes - French Lake, Lydiard, Dickey and Classen - which meet the current 75 feet setback would become non-conforming. 3. Orono is more restrictive in required lot sizes. 4. Our setbacks from County roads in urban areas are less restrictive. 5. May have to review our hardcover standards with DNR's 30% maximum. 6. DNR must review all variances to shoreland regulations; all plats that are inconsistent with shoreland regulations must be submitted to DNR 10 days before Public Hearing at Planning Commission; copies of all plats involving shorelands must be sent to DNR; all PRDs and PUDs with altered zoning standards (greater density credits) must be approved by DNR. Staff will present the enclosed model ordinance and Planning Commission recommendations to Council within the next month for fur­ ther Council direction. GENERAL PROVISIONS A) Statutory Authorization: This ordinance is adopted pursuant to tne authorization containeo in the Laws of Minnesota 1973, Chapter 379, and in furtherance of the policies declared in Minnesota Statutes 1976, Chapters 105,116,116 and 462. B) Policy: Tne uncontrolled use of shorelanos of tne city oi affects the public health, safety ano general welfare not only by contributing to pollution of public waters, but also by inpairing tne local tax base. Therefore, it is in tne best interests of tne public health, safety and welfare to provide for tne wise aevelopmer»t of shorelanos of public waters. Tne Legislature of Minnesota nas delegated responsibility to the municipalities of tne state to regulate the subdivision, use and development of the snorelanos of public waters and thus preserve ano ennance the quality of surface waters, preserve the economic and natural environmentai values of snorelands, and provide for tne wise utilization of waters anc related land resources. Tnis responsibility is nereoy recognized by the City of _ _ _ _ _ _ _ _ _ _ _ _ _. C) Definitions: For the purpose of tnis ordinance, certain terms or words used herein shall be interpreted as follov.s: Tne wora "shall" is mandatory, not permissive. All distances unless otnt.-r.;ise specified snail be measured horizontally. "Boathouse" means a structure useo solely for tne storage of boats or boating equipment. "Builoing Line" means that line measured across tne width of tne lot at the point where tne principal structure is placed in accoruante with setback provisions. "Clear-cutting" means tne removal of an entire stand of trees. "Conditional Use" means a use of snorelands whicn is permitted within a zoning district only when allowed by the city after a public hearing, if certain conditions are met wr.ich eliminate or minimize the incompatibility of tne conditional use with otner permitted uses of the district. "Governing Body" means the city council by wiiatever name known. "Hardship" means the property in question cannot be put to reasonable use under the conditions allowed by the official controls; the plight of the landowner is due to circumstances unique to his property, not created by the landowner; and the variance, if granted, will not alter the essential cnaracter of tiio locality. Ecunomic considerations alone shall not constitute a hardship it a reasonable use for the property exists under terms of the ofticial controls. i if' J:' • m #■ r "Lot” means a parcel of lane designated by metes and bounds description, registered lana survey, «iuoitors plot, or other accepteo means and separated from other parcels or portions by said description for the purpose of sole, lease, or separation thereof. For the purposes of these regulations, a lot shall be considered to be an individual building site whicn shall be occupied by no more than one principal structure equipped with sanitary facilities. "Nonconforming Use" means any use of land established before tne effective date of this ordinance whicli does not conform to the use restrictions of a particular zoning district. This should not be confused with substandard dimensions of a conforming use. "Ordinary High Water Mark" means a inarn delineating tne nignest water level which has been maintained for a sufficient period cf time to leave evidence upon the landscape. "Cluster Development" is considered to be a type of Planned Unit Development and is subject to the same review criteria. Planning Agency" means tne planning corviiission or planning department as created by tne governoring boay. "Protected Waters*" means any waters of tne State as defined in Minnesota Statutues 19b0, Section 105.37, Subdivision 14. However, no lake, pond or flowage of less tnan ten acres in size and no river or stream having a total drainage area less tnan two square miles shall be regulateo for the purposes of tnese regulations. "Setback" means the minimum norizontal distance between a structure or sanitary facility ano the ordinary hign water mark or between a structure or sanitary facility and a road, well, nignway, or property lines. "Public Waters" has been changed to "Protected Water". All regulations and requirements remain tne same, only tne name nas been changed. - a “Shoreland" means land located within the following distances from protected waters: (1) 1,000 feet from the ore inary high water niaric of a lake, pond, or flowage; and (ii) 300 feet from a river or stream, or the landward extent of a flood plain on such rivers or streams, whichever is greater. "Variance" means any modification or variation of official controls where it is determined tnet, because of narasnips, strict enforcement of tne official controls is impractical. II. IV. SHORELANO ALTERATIONS The removal of natural vegetation snail oe restricted to prevent erosion into protected waters, to consunte nutrients in tne soil, and to preserve shoreland aesthetics. Any work which will change or diminish the course, current or cross-section of a protected water or wetland shall be approved by the Commissioner of Natural Resources, ano sucn approval shall be construed to mean the issuance by the Comtnissioner of Natural Resources of a permit under the procedures of Minnesota Statutes, Section 105.42 and otne related statutes. V. SEWAGE TREATMENT Any premises intended for human occupancy shall oe provided witn an adequate metnod of sewage treatment to be maintained in accordance witn acceptable practices. Copies of all plats within the shoreland overlay district shall be submitted to the Commissioner of Natural Resources within ten (10) days of final approval by the City. Planned Unit Development (PUD). The existing house is located 40' from the lakeshore. At the nearest point, the new house would be located 60' from the shoreline, with the bulk of the house behind the 75' mark. Note on the site plan the locations of existing trees just east of the proposed garage area, which applicant would have to remove in order to place this house fully meeting the 75' setback. Applicant also notes that tofjography influences the possible feasible house locations. Given that the house to the south is 55' from the shoreline, and a proposed house to the north (building permit application filed) will be at 75' from the shoreline, and given the shape of the shoreline at this site, it appears that average setback will not be a factor at this site. A 10' X 15' concrete block building exists near the lakeshore. Plans show it as remaining in place. Note also that some grading in the 0-75' zone will be needed as a result of the demolition and construction. This is shown on the site plan, and would appear to a normal amount of grading to make this an attractive walkout site. It is their opinion that in order to succeed in this venture and to, hopefully, make profits, that the original scope of the retail operation be amended to include a mini bake center and delicatessen like operation that would involve the preparation of party trays. They advise that it is not their intent to encourage consumption of foods on the premises. The bake center will occupy 100 to 150 square feet of existing retail space. The preparation area for the delicatessen will probably be located in the area designated as Work Area 1 - the kitchen of the former residential unit. The delicatessen operation will require a license from the Hennepin County Community Health Department. The building staff sees no problem with the installation of the oven - all standards of the Uniform Building and Fire Code will apply. fa m .. fa (^1^- i t * f k The pertinent question for this review is will these added uses in the retail operation be considered an intensification of a non­ conforming use. Staff can report that we have had no problem with this operation. The applicants have never violated a condition of their permit. At various inspections of the site and upon personal visits to the store, staff has never noted parking problems or a lack of suitable parking area. The current operation does not appear to be an intense use of the physical plant. Both new uses will not result in expansion of the retail area. As a result the parking needs and requirements remain constant. There are no major permanent structural alterations invol­ ved with the new uses. The changes deal only with the retail use - elimininating or cutting down in one phase of retail and replacing it with another retail use. The proposed new uses appear consistent with the original intent and plan for the Summerfield Farms Market. Staff Rec ndations To recommend approval of the conditional use permit application of Glenn Nellist and Lowell Schaper to permit a mini bake and delica­ tessen operation at the Summerfield Farms Market at 3800 Wayzata Blvd. based on the following findings: 1. Council has approved applicants request to remove the residential unit within the existing structure finding no intensification or extension of the commercial use of the residential property based on the following findings: a) The area occupied by the residential unit shall be used solely for storage, lunch room/employee lounge and new office. The approximate 450 sf of the residence apartment may never be used for commercial sales area. b) The structure has not contained a residence since late 1970’s. c) The City Inspector has never issued a certificate of occupancy for the rehabilitated apartment. d) The previous lessee and current applicants note the’ following drawbacks in renting such a unit to an employee or owner: (1) The existing apartment is too small and cannot provide adequate living area. (2) A responsible agent of the store would never want to live there. (3) Since the applicants all own their own homestead farms, they could not claim the apartment legally as their residence. Designated parking stalls must be maintained so as not to interfere with required building exit doors, service doors or required space for delivery trucks and/or trash containers. Prior to reopening the business to the public, the applicants or their contractors shall obtain all required permits to correct any code violations on the property specified by the Building Official. The applicants and owner are hereby notified that the City Council will not consider any future building construction, additions or expansion for commercial uses because to do so would extend or intensify the non-conforming use contrary to the intent of the Zoning Code and contrary to the intent of the Comprehensive Commmunity Management Plan. Council Member Barbara Carlson said she tears that the high-rise buildings could diminish the land­ scape on Calhoun's north shore. “This area could become the Cedar- Rlvenide for the rich," she said. But Ccuncil Vice President Tony Scallon said, "The area back from the lake Is a good place for hlgh- densHy bousing. It hopefully gets people closer into the city rather than forcing them to drive in from the suburbs." He also pointed out that most of the city's lakeshores are zoned for only single-family or duplex structures. “We’re using the 10 percent of the lakeshore to help pay for the other •0 percent," Scallon said.
