Rovegno moved, Kelley seconded, to approve the partial vacation of Park Avenue subject to the Public Works Coordinator and City Engineer to revierw this applicat i on and appl icant showing all hardcover on the survey. Motion, Ayes (7), Nays (0). Doug Klint and Tom and Bea Bernier were present. Assistant Zoning Administrator Gaffron noted the certificate of mailing and the affidavit of publication. Klint stated that one lot line would be moved 50' and another lot lino would be moved lUO’. Rovegno stated that the Planning Commission should see where the lot lines are going to be before they apprevo the application. Crowding Principal Building. No acces.^ory building or structure, unless an integral part of the principal building, shall be erected, altered, or moved within ten feet of the principal building. Subd. 13. Garages. Accessory buildings which arc for the storage of automobiles shall have the doors thirty feet or more from the property line when said doors face on a public alley or street. Subd. 14. Yards and Open Spaces. A. Reduction Prohibited. No yard or other open space shall be reduced in area or dimensions so as to make such yard or other open space less than the minimum required by the Zoning Chapter and if the existing yard or other open space as existing is less than the minimum required, it shall not be further reduced. B. Application to Only One Dwelling or Group. No required yard or other open space allocated to a building or dwelling group shall be used to satisfy yard, other open spaces, or minimum lot area requirements for any other building or dwelling group. Subd. 15. Non-Encroachments. The following shall not be considered to be encroachments on yard requirements: /i.Chimneys, flues, belt courses, leaders, sills, pilasters, lintels, ornamental features, mechanical devices, cornices, eaves, gutters and the like, provided they do not extend more than 1-1/2 feet, off-street parking except as hereinafter regulated. Essential Services. This Zoning Chapter shall require a permit for all structures including utility polos, and right-of-ways which are an integral part of a system for public transportation, as for transmitting power, water, heat, communica tions, gas or sewage by any public utility. The Council shall grant a conditional use permit only after a showing that the public safety, health and welfare will not be harmed by the essential services. Subd. 18. Farming. All farms in existence on January 1, 1975 shall be permitted to continue operation subject to the following conditions: A. No new "stock farms" shall be created or existing stock farms enlarged more than twenty-five percent (25%) in animals over one year old except under the provisions of a conditional use permit. In considering any such permit, the maximum number and type of animals to be kept shall be determined. The site design and method of operation shall bo reviewed and the Council shall find that the proposed "stock farm", if in existence, will not in its opinion be detrimental to the public safety and the general welfare. B. The establishment of any new building for the housing of animals or fowl shall be located 150 feet or more from the nearest offsite residence. C. Products produced on the farm may be sold at retail. One (.emporary roadside stand may be established Cor conducting such business. Except in the ease of Planned Residential Developments as provided for hereinafter, no more than one principal building shall be located on a lot. Subd. 8. Lots to Face Streets. Each lot shall face on a public street or appropriate private easement. Subd. 9. Accessory Buildings. A. Time of Construction. He requests a variance to the size standard because he claims that at least two of his immediate neighbors have boats over 20 feet in length stored in their yards. (Note areas designated as 2 & 7 on staff survey - Exhibit E.) In addition, he calls attention to the "numerous boats stored on private p)roperty throughout the City of Orono". The applicants consider staff’s actions highly discriminatory in singling them out for actions deemed appropriate, natural and completely acceptable on other neighbors’ lots and in other neighborhoods throughout the City. A second varianc<> to the exterior storage section is sought by applicant claiming there is no other area on the property to store the boat because of the sloping topography. The boat is stored less than 35' from Pheasant Road and possibly less than 10’ from the side property line - survey does not confirm setbacks. The ordinance allows a boat of less than 20 feet in length stored in a rear yard 10 feet from any property line. How does our code determine or define applicants’ rear yard? The area between the lagoon and the house is the front/lakeshore yard; the area between the house and Pheasant Road is the street/side yard; the area between the house and street is the front/street yard; the area between the house and east property line is the side yard. The applicants' boat is stored in what effectively is the extended front yard areas of the Pheasant Lawn neighborhood along Pheasant Road. The boat is the first thing observed as you enter the neighborhood and the last thing observed as one exits. 1 If you review the staff exterior boat storage survey of tlie surrounding area, note th.at only one other Pheasant. I-awn resident stores an oversized boat on their property (area 1). The boat is stored 10 to 1 [j feet off Pheasant Road screened by a small shrub. The remaining residents of Pheasant Lawn store their boats out of site. The boat stored in area 2 is located in the front/street side yard. The boat stored in area 7 is located in a lakeshore/front yard. Hy windshield survey reveals a total of eight oversized boats storc'd in the Pheasant I.awn, Shore Hi 1 Is and Narrows area of the City. This is the first variance application to the exterior storage section of the code to be reviewed by the City. I have included an article by Ruthanne Lange in your packets. She approached the City staff seeking information on the ordinance and the City's normal proceedure for dealing with violators. She adv.ised that petitions were being circulated in the Navarre area asking that the City enforce the ordinance. In her closing paragraph she posed the City's dilema. VJhether to enforce or amend an ordinance that does not reflect the boat storage habits within the City. If the City upholds the current code and responds to only the complaints of neighbors, the City will continue to bo charged with acting in a discriminating manor because the violator will point to other violators. A City cannot just single out a few for enforcement when it is obvious there are several violators. It is not difficult to locate boats over 20 feet in length stored on a property. How realistic is our ordinance when the majority of lakcshore lots do not possess rear yards? Are not the boats under 20 feet stored in lakeshore and street yards in violation of the ordinance? If we recomiiieded amending the code and remove the size limitcition, what kinds of exterior storage patt€*rns would be encouraged? Is a limit on size necessary? Is the 20 feet length realistic? If rear yards are not applicable for lakeshore yards, what placement standards are acceptable? The intent of any amendment of this code must bo to protect not only the property rights of residents but at the same tim.e guard against creating undue financial hardships for its residents and legislating unrealistic, or confusing and unpractical standards to live by. Around Minnetonka most neighborhoods sport at least a cou ple of properties with boats of various sizes cuddled up next to a tree, trying to look Inconspicuous. Manv of them are assuming the low profile because the zoning or dinance covering exterior storage in residential districts says boats stored over the winter on private property must be under 20 feet in length. That ordinance further states that all mobile materials and equipment shall be stored Arithin a building or fully screened so as not to be visible from adjoining properties, except boats and unoccupied trailers, less than 20 are stored to the rear of the house and a distance of ten feet or more from any property line. _ That ordinance was written m 1975 but the habit of storing boats in private property, whatever .heu size, is deeply ingrained in the peo pie of Orono. According to the ci ty's zoning administrator. Jean Mabusth. until recently ‘h* "■ dinance has not been strictly enf^- ed because nobody ever complained. In the past few months, however, there have been two complaints of large boats stored on private tv and the residents making the compI«'"« r/.the ordinance and make the boat cont. on page 3 Orono boats from front page owners move their boats. The city staff and some of the council members believe that the or dinance as it is written is not en forceable. For one thing, there arc too many offenders to enforce it equally, they feel. Building Inspec tor Tom Jacobs went over the pro cedure for answering a complaint. When a complaint is filed, the first thing the city does is make an inspec tion of the property, and. if necessary, write a letter to the of fender asking for compliance. That letter if followed by a seconad letter if the first one is ignored. The of fender is then tagged, if that does no good, the offender can be charged with a misdemeanor which carries up to a S750 fine or 90 days in Jail. The question seems to be. should the city of Orono make a concerted effort to enforce the boat storage or dinance by inspecting and tagging the considerable number of of fenders. or should u.s council amend or change the ordinance to reflect the boat storage habits within the city.
