Once again for your information, at the time of the North Arm Estates 4th Addition subdivision (the property to the immediate south) the City asked for 17' of right-of-way, there is nothing in the records that would reveal staff researched the history of the previous Co*’ ity road. As meiiibers will remember, during the sketch plan review, the lot line rearrangement is proposed to solve the septic limitations of Lot 1, the most northern lot. In previous discussions with an on-site septic evaluator, it would appear that the lot can sustain only a 2 bedroom residence. The septic limitations result from the filling that took place to the lower eastern portions of the property preventing future septic use. Septic systems cannot be installed within disturbed or filled areas. The sloping properties to the west prevent the installation of mounds. The only suitable area for mound septic systems are located within the southern lot on Lot 2. city reguires 17' of additional right-of-way. Lot 1 will be limited to a 2 bedroom residence. In discussing the proposed subdivision with adjacent neighbors, it would appear that all ask that the City refrain from taking 17' from the east side of the roadway. Staff has enclosed a section of the conceptual transportation study recently completed by Gaffron for the City Council. North Arm Lane has been delineated as a future collector road providing access to Bayside Road, North Shore Drive and North Arm Drive. Gaffron has reconfirmed that any taking of additional right- of-way for North Arm Lane will negate any chance to develop septic systems to the west side of the property. Options of Action - Denial. Finding the proposal to be in conflict with the directives of the Comprehensive Plan of the City and the Orono Zoning Code; or Approval. To approve the proposed lot line rearrangement and lot width variance for Lot 2 of 123.87 or 61.93% and not require the dedication of 17* of additional right-of-way for North Arm Lane based on the following findings: 1. The City had previously vacated all interest in 33 o. right-of-way located within the subject property. 2. This item was on the Planning Commission agenda on Tuesday, January 16, 1990 as item #13 for a "sketch - plan review" and was presented by Mr. Don Peterson of K-P Properties, Inc. I was in attendance and heard the discussion. I thought it important for your background information to correspond with you and give you some additional information with respect to the City's request for an additional 17 foot of roadway and the corresponding hardship that this will create with respect to the property as well as Mrs. Axel personally, if the 17 feet is taken: 1. First of all, as was noted by Hon Peterson, the 33 foot strip for the present roa<l did come from the North Arm Estates property. 2. This is a private road way and is owned by Armstrong whom I believe continues to pay taxes on it although the City has apparently maintained the road. 3. With respect to the Olson property. T think at such time as a subdivision is requested, obviously as a precondition the City can get the 17 feet it needs for the road from the Ol.son property as opposed to the North Arm Estates property. 4. At such time as Armstrong property is developed, I assume as a precondition, the City can extract the present 33 foot strip as a dedicated road as well as its cul-de-sac, etc., that they may need on the Armstrong property. This wv,'1 then automaticnlly render unworkable the solution Don Peterson presented with respect to the septic tank and, in fact, my client's property is in reality virtually unsaleable and unbuildable due to the lack of an adequate septic tank site and probably diminishes in value by $40-50,000. This presents a hardship to the property and also to Mrs. Axel personally as this is the one significant asset that she received in a marriage dissolution proceeding approximately 2-3 years ago. From an equitable standpoint, I also think it is perhaps appropriate that tljo additional 17 feet needed for the road way come from the other side since from a historically perspective, they have contributed nothing and this property has already contributed 33 or approximately 2/3rds of what will ultimately be the 50 foot. 1 believe the scenario that is outlined in this letter will allow the City ultimately to achieve its goal, l.e., a 50 foot dedicated road, since, at some point in the future, 1 assume that the Olson property will be subdivided and also the Armstrong property will eventually be platted and subdivided. Pertinent Ordinance - Section 11.03, Definition 66 (B) - Class II subdivision. Section 10.20, Subdivision 3 (L) - Conditional use required for crops/nursery - minimum of 10 acres of area required. In February 1982, Cliff Otten the owner of the property was granted a conditional use permit for nursery stock. Plantings from the nursery are located within Parcel B. The required area is still satisfied as the proposed area consists of 15.81 acres. All lots satisfy the lot standards for the FR-lB zoning district. Each parcel satisfies the 2 acre dry contiguous area. Parcel A is shown to have 2 accesses. The primary access off of Highway 12 and a secondary access exiting through an easement through the property to the west at County Road 6. In review of the survey submitted, there appears to be no existing access provided to Parcel B where the nursery is located. The owner of remaining Parcel B should provide the City with direction regarding how access will be provided to the site. The subdivision is currently under review by MnDot and the County Department of Transportation. In Exhibits C & G, staff notes a discrepancy in the rights-of-way shown for both Burlington Northern and Highway 12. It .-..r- Zoning File #1495 February 14, 1990 Page 2 of 2 The plat map shows 150' of right-of-way for the railroad and €6' for state Highway 12. The survey shows the railroad at 100' and an 83' right-of-way for state Highway 12. As of this writing, staff has not received any responses from both reviewing agencies and will be able to provide reports at your meeting night. Gaffron confirms that septic testing submitted for this review finds adequate area for an alternate on-site septic system and confirms that the current system serving the house. Installed in 1982, is satisfactory. Pending receipt of the reports from the State and County Departments of Transportation and resolve of the discrepancies in the right-of-way shown on the survey, staff would recommend approval of the proposed 2-lot plat finding that the subdivision satisfies all standards of the RR-IB rural residential zoning district and on-site septic codes of the City. Each lot has adequate frontage on both State and County roadways. Such approval is subject to the following conditions: 1. The subdivision is defined as a plat. All lots created must be defined as lots with block designations. 2. Drainage and utility easements shall be dedicated 10' along all perimeter property lines and 5' along the shared lot lines of proposed Lots 1 and 2. 3. Right-of-way for State highway and County roadways shall be resolved by both the agencies and the City. Such dedication shall be consistent with previous subdivisions along these roadways. 4. Payment of a park fee for Parcel B of $100.00. There is no charge for Parcel A because it is a developed lot. 5. Owner of Parcel B is hereby advised that the creation of a new curb cut to serve the nursery property must be approved by either the State Highway Department or the County Highway Department depending upon where access is achieved. 6. The City reaffirms its approval of the original conditional use permit for the farm/nursery stock use on proposed Parcel B and that the original condition that no stock shall be sold from this site is still in effect. : f fOl. She recommended that this application be reviewed with similar considerations as the Johnson application off North Arm Drive, in that approval be conditioned upon the existing foundation being used. The general concensus of the Planning Commission was that they were in favor of the proposed house not extending as close to the lakeshore as the existing house. They were also in favor of the reduction in hardcover in the 0-75' setback area from 15.8% to 13.3%. The new structure would be right on the average lakeshore setback line, and will have an attached garage. The detached garage will be removed. It was moved by Planning Commissioner Hanson, seconded by Planning Commissioner Cohen, to recommend approval of this application granting the lakeshore setback variance required for new construction on the existing foundation. The setback shall be allowed at 59' to accomodate the 2' upper story deck extending into the lakeshore protected area; the main part of the house shall be at 61'. Assistant Planning and Zoning Administrator Gaffron informed the Planning Commission that there had been a revision to this proposal. There will be no Increase in hardcover in the 0-75' zone due to the removal of an existing storage shed. Mr. Lumry also explained that there would not be any additional terrace area as originally proposed. There is no encroachment of the 75' setback area proposed. The increases in hardcover resulting from the proposed lakeside improvements have been matched within the same setback area by removals of 660 s.f. of non-structural hardcover in the street yard. Please review Exhibit F, the neighbor most impacted by the proposed improvements claims their opposition to the proposal. The neighbors suggest that possible landscaping could remedy the above concerns. Lightly 3585 Frederick Street, Wayzata MN ^ j DESCRIPTION OF REQUEST .1 i • ‘ we are proposing the installation of' a 384 square foot below grade swinnming pool with concrete decking as well as a 600 square foot single story addition and 150 square foot two story addition to the existing house. The majority of the pool, decking, and structural addition is located within an area which is an existing concrete patio. The existing house, patio, and most of the driveway as well as the proposed addition are within the 75-250 foot lakeshore setback zone. The existing hardcover calculation of this zone is 47%. A portion of the proposed concrete decking and house addition is outside of the existing patio area and has an impact on hardcover; however, we are proposing the removal of some existing hardcover on the east side of the house and in the driveway area resulting in a net hardcover reduction to 45% of total area. A portion of the single story addition exceeds the average lakeshore setback by approximately 13 feet maximum. By designing the floor level of this addition to be below existing ground level, limiting the addition to a single story and proposing a low pitched roof line we have minimized the view obstruction from neighboring houses. Through the use of aerial as well as ground level photographs we can shew that the design of the proposed addition in conjunction with existing vegetation and the curvature of the lakeshore result in no significant impact on lake views from adjacent properties. HARDSHIP/PRACTICAL DIFFICULTy/UNUSUAL PROPERTY CONDITIONS There are several reasons for proposing the pool and house addition in the position and location being requested. 1) The property is a narrow, triangle-shaped lot with the existing house "crowded” into the center portion of the lot preventing any expansion to the sides. 2) The interior design of the existing house is such that an addition on the street side of the house would not be practical. Currently the garage, utility room, and 2 small bedrooms face toward the street. 3) The swimming pool is proposed on the south side of the house both for exposure to the sun and to allow ful1 view of the pool area from existing living areas of the house for safety purposes. 4) The "living" areas in the existing house are relatively small and the proposed addition would improve the livability of the house and also increase its value significantly. The addition will protrude well beyond the uniform setback of neighboring homes disrupting the symmetrey of the area when viewed from the lake. 2. The addition will block our view to the west. We will be looking down cn a roof from our deck and into the addition from our lower level patio rather than out across a lawn to trees and the lake. This will diminish the appeal and value of our property. Perhaps some provision for landscaping could remedy the above concerns. The property currently contains the former residence, caretaker house, and garage. The 6+ acre parcel is made up of 5 independent properties (review Exhibit B). Note property 5 is located within the waters of Forest Lake. Property 4 contains the principal residence and #2 contains both garage and caretaker units. The applicant has reviewed the question of access and applicant's responsibilities for upgrading roadways with the Public Works Director. Applicant will be responsible for construction of a road (possible public road dedication) from the intersection of Wildhurst Trail and Highview Lane through to the proposed cul-de-sac. It is the applicant's intent to have all 4 parcels served by newly improved Highview Lane. Please review Exhibit E, the plat map locating developed parcels served by Highview Lane. The seven residences are served by an unimproved 30' right-of-way currently maintained by residents. The applicant proposes rededicating 30* of additional right-of-way for Highview Lane. Drainage is a major concern for this property. Please review Exhibits C, D and ?. Major portions of the property are involved within the flood plain (those areas designated below 931.5 elevation) and a designated wetland. The wetland serves as a detention area for portions of this watershed prior to entering into the lake. Major drainage comes from the west over the roadway through a drainageway along the south lot line of Lot 4 (please review Exhibit F). Additional culverts are installed northward along Wildhurst Trail directing drainage to wetland. The property is sewered, applicant can seek directing credit for the wetland areas as long as 1/2 acre contiguous dry buildable envelope is maintained. The ordinance also requires that legal access must be provided to these limited sites. The access issue appears to be no problem based on the current proposal. The preliminary plan must designate the 931.5 elevation to determine the actual impact of the flood plain and wetland areas. Upon filing the preliminary subdivision application, the applicant must provide the necessary hydraulic information for the engineer to determine an appropriate elevation for the wetland area which would be at or above 931.5 elevation. Lot 4's building envelope will be severely Impacted by the wetland designation. It may be appropriate to allow Lot 4 to be served by the existing access off of Wildhurst Trail. The obvious building envelope will be to the southeast of the lot. It is difficult to determine the impact on Lot 3 by the information submitted to this date. There may be major impact if the wetland elevation is determined above the 931.5. I Zoning File #1496 February 16, 1990 Page 3 of 3 Hardcover standards would appear to not be a problem for this property as wetland and flood plain areas are included in the area allowances. It should be noted that Lot 1 as proposed would require a lot width variance as it does not meet the required 140' width to the rear of the front yard setback line at 35' in from the cul-de-sac. The Public Works Directos has advised that there is a lift station within proposed Lot 4. The City will ask that the lift station be located on the preliminary plat. The City will ask for utility easement over the lift station. Prior to applicant filing a formal subdivision application, staff would suggest that the flood plain elevation and resolve of the wetlands elevation be determined because of the potential impact on this 4 lot proposal. The Planning Commission should comment on the issue of the lot width of Lot 1. Approval would appear consistent with the previous actions of the City when dealing with the lots on cul- de-sac. If it is determined that there is enough dry buildable on Lots 3 and 4 to meet the 1/2 acre dry contiguous standard, would Plannir.'S Commission approve access to Lot 4 via Wildhurst Trail using existing driveway access? The Planning Commission may have other comments/directives for applicant prior to filing the formal subdivision application. Lots 2, 3 and 4 dry buildabie area must be exclusive of designated wetland areas. Access is the crticlal issue for this subdivision review. Staff has been advised that the applicant does not wish a road extension to the south, nor to the west. Staff would ask members to review Exhibits B and F. Exhibit B should be familiar to Planning Commission members as it was used during the review of the White subdivision application in late 1988 (preliminary subdivision approval expired 9/89). The County found access to the property to be extremely difficult. The only acceptable access to the site was at the western edge of the property on Baystde Road. Access from North Shore Drive was not feasible to the White property. If the white property is to be subdivided at some future date, it would make good planning sense to acquire access to the White property through a west corridor from the subject property. Please review of Exhibit F, a conceptual road plan for this immediate area. It will be staff's strong recommendation to take a future linking access corridor to the south of the property to join in a future network of roadways linking North Shore Drive and North Arm Drive. Applicant need only provide future road outlots to the west and south. The plat itself may be a cul-de-sac road. Planning Commission should provide directives to the applicant concerning the following issues: 1.Future access corridors: A) to the west; B) to the south. 2. Will the City allow owner of Lot 7 (previously Lot 1), Bayview Farms to retain access onto Bayside Poad. 3. Resolve of structure referred to as pole barn: 75', 150' or will it remain as merely a storage structure? If it remains as a storage structure, it must be 50' in from the plat road. 4.
