approval process involved with our overlapping jurisdictions. The City of
Orono is particularly concerned that applicants he made aware of the need
for approval by All affected agencies prior to beginning any work requiring
a perni t . For t Z . ity, this means any fi l l inp , g rati- t rig, dredging, excava-
tion or construction within the floodplain or wetlands aiul lakeshore conser-
vation areas or on lauds abutting, adjoining or affecting such areas.
Our suggestion is that, upon initial application to any agency, the party be
informed of the other jurisdictions having possible interest in the proposal.
Secondly, any agency approval should 'be subject to approval of all other

to the final plat approval for the Clout S

exactly what we needed, but he felt they shouldn't have to submit the mylars and

COUNCIL HEETING - December 13, 1976
Council first approved. However, after discussing the Upper Watershed Storage
item on the agenda, there appeared to be some question as to the location of
the proposed duck pond.
Cane i 1 reconsidered the request and tabled the matter until the applicant
conferred with the Watershed District as to whether the proposed location
would, in fact, conflict with the proposed watershed storage zone in this area.

Wetlands Variance - Dredge Duck Pond
Mr. Ledstr= is considering purchasing the area adjoining his p=+oQerty for grazing
purposes. He also would like to oontitwe with the wild life aspect of the
property. In fact, he is requesting approval of a wetlands variance for dredging
of a duck pond which he feels will improve conditions for wildlife purposes.
His request consists of approval for dredging of an area of about 5/8 acres to a
depth of fran 4' to S'. His proposal also requires approval of grading of the
excess excavated material slang the edge of the wetlands area adjoining Lake
Clasen .
This would require approval of e. qd Whtershed District also.

Mr. Ledstram was Present. lie reflected his concern for the safety of the horses
in this pasture. A horse barn is currently located only 50' from this proposed
duck pond. The soil in this area is very soft and mucky, and therefore a hazard
to the horses. :'! pond would eliminate the Lazard and also provide a pond for
ducks.
His proposal includes using the dred!Yed material for fillinn and Pradinp; of a
steep grade to the east between the proposed pond and Lake Cl ass en . M i s } i e
contends would eliminate the hazardmis steep slope. Ile then Proposes to plant
various grasses on the freshly graded slope to provide a feedinc ground for
the natural animal hab i tat in the area.
The Planning Commission instructed the applicant to review the proposal with the
Watershed District to verify the location in relation to the proposed location
of the Designated storm water storage area.
If he wished to pursue with the proposal, he would be expected to submit a
certified topog of the land with existing and proposed elevations shown on the
map.

affecting the health, safety and welfare of the general public.

Urbanization of this area will have a deleterious effect on the environment
and ecology of the Village and once again affect the health, safety and wel-
fare of the general public.

work on May 29, 1973. The condition of the permit was
that the dredging be done in accordance with the Mirnehaha
Creek Voater Shed District, the Lake Minnetonka Corservation
District, and the Departzent of rraturai Resources Permit,
They also provided that there should be no placement of
any dredge material in any of the wttl.ands.
Bill bli l l s advised the property owner, Robert Di.rkeland,
of these and other conditions in a lettr�r of June A, 1973.
He instructed him to contact his office when the dredging
was begun.
lie received notice on February 26, 1974 that the project
was in progress. On the following morning we inspected
the progress and found that the dredging was nearly complei:ede
We also found that contrary to all instructions the fill
had been placed in what appeared to be wetlands. This was
.i.tirlicated by the markings on the USGS naps as well as
cattails and other marsh type grasses in the area c)f his
fill deposits. Mr. Birkeland advised us that he had
cleared this with Bill Mills and had deposited the fill
w:"re they had agreed.
v � a contacted Bill and made the inspection of the site
with him and he conf irmed our observations that this was
i n fact wetlands. Mr. Birkeland was ins tru:i••to::1- AL.e rer:ove
the fill. He has agreed to do this in the spring as soon
as we `rer permits . He will remove the fill and sp:r e-ad a thin

Lot Rearrangement
Mr. Skarp is requesting approval of a lot rearrangement to regain 4-6' of the
Rovick property which was originally his. fie lost this through torrensing
procedures by Hr, McCaffrey at the time Council approved the division of RLS
013720
At the time Council approved this subdivision, they did not insist on mylars
and ha.rdshells so we had no certified property descriptions - only sketches.
However, once Council approved this subdivision as described, Mr. McCaffrey
tor rensed the property. �fr. Skarp missed the court hearing notice of publica-
tion relating to the torrE-ns ing of the adjoining property. Little did he know
that the new property description was moved eastward from 4 to 6 feet. His
west lot line now nuts right through his house.
Mr. Skarp has been ve fortunate in having such a cooperative new neighbor
Mr. Mrs. Odd Rovickhowever,, They have agreed to convey this strip of
property back to Mr. Skarp.

I am enclosing a copy of an earlier memo I sent to Council in regards to the

this and kept calling and we kept returninje.
Mr. Benson and I finally met with Mr. kicCaffrey anti `lr. l ovick at 9:00 a.m. on October
S, 1976. .Also . present were the following - flick Sathre; Cerry Qietrkow, contractor;
Gary Gabriel, contractor's engineer anti two of his field men; and the Iandscapina man.
New elevation readings were taken and all parties expressed their satisfaction with the
proposed grade changes. Both McCaffrey anti Rovick have assured Us they would notify us
of this agreement by letter (none received as yet). We spent 3 hours there.
Now to add a little frosting to the cake - - .Test recently I was approached by Henry
Sk-arp, the neighbor at 1045 West Fenidale. Ile is complaining; about Rovick's east lot
line as it now nuts through his house. It does, in effect, remm in a legal 1 o t line
through his house as 1cCaffrey torrensed the original property before obtainirif, Council
approval on the new subdivision. Skarp's attorney has also paid me a visit in regards
to this although I haven't disclosed any of the previo«s information to him. Skarp is
complaining because lie was never personally notified of the court torrens ink hearings
and never saw them as advertised, so lie Claims lie never had the opportim i t v to object
to the innrorwr property tescription.

Metro System Statement. I am well aware that Orono is in the forefront of
communities with effective comprehensive planning. The Metro System
Statement process provides a means for all of the 189 municipalities in the
region and the Metro Council to get their plans in step with one another, so I

hope you will patiently bear with us in a process that may be repetitive of some
of your past involvements with the Council. At the conclusion of this process
the Development Framework's urban service area will be adjusted to be con-
sistent with local planning.

As to your specific concerns:

1. I will instruct the staff to send you a copy of the preliminary System State-
ment for Minnetonka Beach when it is completed. Your comments on it
will be welcome,
2. The Metropolitan Land Planning Act directs that System Statements include
not only information about the four metropolitan system plans, sewers,
transportation, airports, and parks, but also "population, employment,
and housing need projections which have been used by the Council as a ;.
basis for its metropolitan system plans." The housing need projections
are given quantitatively as household projections in the table on page 1 i
of your preliminary System Statement. Our housing need projections also
have a qualitative dimension, namely a mix of housing types and prices '

to accommodate a broad socio-economic spectrum of the population. That
qualitative dimension is the reason for the discussion of housing for

low and moderate incomo people. The Metropolitan Land Planning Act
requires communities to include a housing element in their comprehensive
plans. See Section 9, subdivision 2 for the specific requirement.

This letter is in response to your letter of November 22, 1976,
forwarding the preliminary draft of. the Metro System Statement
for Orono. The Council has asked me to make this reply informal,
in keeping with the request of the metro Council Staff indications
at the recent area meeting in Medina.
Orono is a supporter of Metro Council goals involving the need
for consistency between local plans and Metro systems. As your
staff is probably well aware have devoted considerable time,
money and effort to make Orono's .-omprutiensive Plan a reasonable
one in relation to areawide plans.
It is because of this involvement that the following inconsisten-
cies give us considerable concern:
1. Orono and .Long Lake are logically put in one System
Statement but Minnetonka Beach is left out. Since
Minnetonka Beach is like Long bake, a municipality
completely .encircled by Orono, it's difficult to
see how it's systems statement can be dealt with
separately. Is this an oversight?
2 e Your letter of the l 2 nd specifically limits the
systems statement to the four Metro Systems cited.
Then the statement, itself, expands the area of
mandatory planning to housing, On which statement
do we place reliance?
3. In this specific area of development, the statement
says, "The Council's major aim is for the sum total
of local plans to accommodate the region's urban
growth in a manner that can be served by existing and
planned metropolitan systems without overloading them."

provide new low and moderate income housing. In a
rural community, like Orono, this can only mean
expansion of Metro systems, Which policy do we
follow? (Incidentally, Orono has a relatively
large amount of low to moderate income housing

in this regard and the covering letter of November
22nd is in direct contradiction with the Systems
Statement itself.

inconsistent with:
a. Orono's Comprehensive Plan
b. The Metro Council's own Rural Service Area
Line (See Agricultural Planning Handbook,
July, 1976) .
c. Your personal assurances that this rural -
urban line is largely a local decision.
