ROLL CALL
The Orono City Council met on the above-mentioned date with the following members present: City
Council Members Aaron Printup, Richard Crosby III, Victoria Seals, and Matt Johnson; Mayor Dennis
Walsh was absent. Representing Staff were City Attorney Soren Mattick, City Administrator/Engineer
Adam Edwards, Public Works Superintendent David Goman, Finance Director Ron Olson, Community
Development Director Jeremy Barnhart, Parks and Golf Course Superintendent Joshua Lemons.
Printup called the meeting to order at 6:00 p.m., followed by the Pledge of Allegiance.

FIRE DEPARTMENT REPORT
23. PURCHASE OF FIRE EQUIPMENT
Printup noted this item will be removed from the Agenda and brought back at a future date as the Fire
Department was not able to be present this evening.

PUBLIC COMMENTS
Robert Manson, 6740 Clearwater Creek Drive, Lino Lakes, has been Attorney for Brad Erickson for over
20 years. He stated many Council Members are aware of Mr. Erickson’s concerns and Mr. Manson is
hopeful to get those resolved, perhaps by meeting with members of the City Council prior to the next
meeting. If not, he will come back at that point in time.
Timothy M. Hultmann, 280 Lake View Avenue, Long Lake, is almost a 44 year resident of Long Lake
and is a former member of the Long Lake Planning Commission, EDA Board, member of the City
Council, and former Mayor. He has been following the ongoing saga of Mayor Walsh’s determined effort
to take control of the Long Lake Fire Department. Regarding the residents and businesses serviced by the
Long Lake Fire Department fire fighters, Mr. Hultmann would like Mayor Walsh to put ego aside and
accept the offer from Long Lake in purchasing Station 1 at Willow Drive in Orono. To quote a former
Excelsior resident speaking to Mick Jagger 50-some years ago: you can’t always get what you want.

FINANCE DIRECTOR REPORT
Finance Director Olson shared a slide showing monthly building revenue permits, noting May 2022 was a
bit behind May 2021 but they are up to 38.2% of the budget. He said if it stays where it is now they will
probably be just fine by the end of the year.
COMMUNITY DEVELOPMENT REPORT
20. LA22-000022 – CITY OF ORONO TEXT AMENDMENT RELATED TO DEAD AND
DISEASED TREES – ORDINANCE NO. 274, THIRD SERIES
Community Development Director Barnhart shared in May the Planning Commission reviewed a text
amendment related to dead, diseased, and hazardous trees. There is a requirement to replace live trees in
the shoreland area and there is no real requirement to replace dead trees. There is also no consideration to
hazardous trees or trees that may fall down onto another property causing damage or injury, or diseased
trees that may spread their diseases in the neighborhood. This draft ordinance is intended to provide some
guidance to these things. The Planning Commission recommended that trees should be replaced one-to-
one (one tree removed, one tree added) to continue to establish foliage and vegetation in the shoreline.
Planning Commission recommended approval of the change.
Jay Nygard, 1386 Rest Point Road, approached the podium and noted he gave public input at the Planning
Commission meeting because he went through a process where the City wanted him to put 8 trees of a
certain size in a certain area to replace a tree he took down for a boathouse the tree was wrecking. He
negotiated with the City as he did not want a wall of trees and found reasonable places to put trees so it
worked out. Mr. Nygard noted it may have gone too far here in saying that any tree of any size; he thinks
they still need to have some requirements as there will be someone saying a sapling is a tree, it is a size,
and it will work. He thinks the ordinance still needs a little tweaking and believes the Comprehensive
Plan says something about maintaining the trees around the lake to make sure the foliage does not go
away. Mr. Nygard noted a neighbor chose to cut a tree down and had his arborist “claim” that it was
severely diseased. Mr. Nygard took the stump and it was clearly not diseased severely. If someone claims
“the arborist said this” it is just like anything else, trees are important to the lake, an inspector needs to be
sent out to look at the tree, they need an inspector, a permit in advance, and to follow the process. He
thinks there should be a penalty for taking trees down without contacting the City first and they need to
find a reasonable middle ground as the previous ordinance was too onerous and this one swings a little
too far to the other side.
Barnhart noted Mr. Nygard raised an important point and in regards to his boathouse tree, it could be
deemed hazardous or diseased, but previously it was “alive” so it fell into items 1-3 in terms of
replacement size. Based on this ordinance if a tree is hazardous or dangerous the City can allow that
removal to occur and then the homeowner just needs to replace 1 or 2 trees, whatever the Council wants
to add. This draft ordinance allows a property owner to remove a diseased or hazardous tree as long as
they replace it. Barnhart noted there is not an arborist on Staff so they look for those with expertise to tell
the City whether a tree is diseased and this ordinance is intended to help people with situations like Mr.
Nygard.
Mr. Nygard bets an arborist would be more than happy to work for the City of Orono on a set fee-per-
visit.

The City Council and Barnhart discussed the item including hazardous trees, amount of trees to be
replaced, other cities’ Codes on trees, one-for-one tree replacement, penalties, and consideration for trees
blown over during storms.
Seals suggested if someone is touching a tree, whether dead or alive, a tree permit should be required
across the board.
Barnhart stated the City Attorney could draft something.
Crosby does not think the City needs it for a dead tree.
Johnson noted there are also property rights and if there is a dead tree on someone’s property one should
not have to call the City and get their permission to take down the dead tree. He thinks they are getting a
little deep in the philosophical concern about the City not having a lot of power when people are taking
advantage and taking down trees.
Johnson moved, Crosby seconded, to approve LA22-000022 – City of Orono text amendment
related to dead and diseased trees – Ordinance No. 274, third series, as written. VOTE: Ayes 3,
Nays 1 (Seals).
PARKS AND GOLF COURSE REPORT
24. ORONO PUBLIC GOLF COURSE KITCHEN UPDATES
Golf Course Superintendent Lemons stated the Park Commission has requested the City look at a kitchen
update at the golf course. Over the past year and a half they have been looking at how to improve the
kitchen to get architectural drawings and proposals to move forward with those designs. They have two
proposals from Oertel Architects ($9,080) and JDD Studio ($6,600); Staff is recommending JDD Studio’s
proposal.
Seals stated it is a very small and limited kitchen right now and because the golf course has been pretty
popular and paying for itself, reinvesting money into it is a good idea.
Printup thinks it will pay for itself in future years with more use of the golf course and kitchen.
Johnson moved, Crosby seconded, to approve Orono Public Golf Course kitchen updates and
signing a contract with JDD Studio. VOTE: Ayes 4, Nays 0.
Lemons shared a general Parks update sharing a slide on golf course revenue. He noted they had a terrible
April due to weather with only four decent golf days as the average temperature was 40 degrees. In May
and June they have been moving very strong and are sitting about 11% behind where they were the
previous year. They have really increased on concessions and alcohol sales and are ahead of the previous
year in that area. Rounds played are slightly down but season pass rounds are up and they are selling more
season passes, as well as junior rounds. Lemons noted they will have some Junior PGA tournaments in
June and July and it is another busy year for golf.

Attorney Mattick had nothing to report.
CITY ADMINISTRATOR/ENGINEER REPORT
Edwards updated the City Council, noting they had a pre-construction conference for roads this year and
road projects are set to begin on July 5 with an expected completion date of September 5. The vast
majority of roads are mill-and-overlay which are fairly quick with minor disruptions to residents.
Edwards also acknowledged Mr. Barnhart for seven years of service as the Community Development
Director.
MAYOR/COUNCIL REPORT
Seals noted it has been on the docket to look at a Fire Consultant/Chief and some work has been done.
After discussing with the Mayor, he thought it would be good to punt it over to the Re-organization
Committee.
Edwards asked for direction at this point as anything that needs approval will come back to the City
Council.
The City Council shared their support for the direction to direct the Re-organization Committee to look at
it.
Seals stated they are coming up on budget season and the Council tries to jam much of that into work
sessions and do not get through all of it. The Mayor thought it would be a good idea to create a budget
committee to allow more time to dive into those line items before City Council approval.
Edwards would bring to the City Council’s next meeting an amendment to the standing committee list
and formal approval would be at that meeting.
The City Council shared their support for the suggestion.
Seals said the City Council received a letter earlier in the day from the City of Long Lake in response to
the City of Orono’s letter. Being married to a fireman she received the letter earlier in the weekend and
has thought about it a lot, talked to other firemen, talked to the Mayor of Long Lake, and she does not
think the negotiations need to stop. After talking to Long Lake Mayor Miner today she thinks there is
misalignment in communication and an opportunity to sit down with Long Lake staff to look at what the
two cities can agree upon. Seals thinks they all owe it to themselves and residents to chill out for a
moment and have a sit down and that both cities can do better regarding communication. She thinks there
is some middle ground that they just have not found yet and this is not in the best interest of the
firefighters, either, as they do not know where they are going. The majority of the firemen and firewomen
are Orono residents which puts them in an odd situation. There is a reason Station 1 is built in Orono and
much of this is short-sighted for the City to act and not try to sit down with Long Lake, pause for a
second, and try to figure it out. She does not think any of the fire people think Orono or Long Lake are
great right now.
Crosby stated the thing to understand is that this is a business decision. There has been a lot of rhetoric
thinking it is about their performance or the way the fire department has done something and that is not

the case. It is a math decision – if Orono pays 85% of the bill, they are going to have their name on the
door. Crosby would not vote for Long Lake to buy Station 1 in Orono. As stewards of taxpayer dollars,
how do they spend 85% of the money for a fire department and have no say? He respects the history and
he was part of that history at Long Lake Fire. Cosby stated they need cohesiveness within that fire
department and it is not a performance thing, it is a dollars and cents thing. He shared that he and his wife
renewed their vows the previous week and are celebrating 30 years of marriage on the 16th of the month.
Johnson is not opposed to Long Lake deciding to have their own smaller fire department. He is not going
to close the door to any concept including selling the building over there. The City Council’s goal and
responsibility is to have the best fire service for Orono residents; he noted they all hope it includes Long
Lake.
Seals thinks there is probably a better end-point and would like to talk with Long Lake.
Johnson noted they cannot piecemeal everything. What Orono asked for was to get their own appraisal
and for Long Lake to also get an appraisal. He thinks Orono needs to develop a plan for communication
as he would like to get rolling. He hopes Orono is covering Long Lake and “Long Lake Fire” is still on
those trucks while having a different level of influence over the budget and management to use Orono’s
size, scope, and police to be more efficient than it is right now with centralized communication. This
would also bring costs down. He noted it is not that complicated but it is about sitting down and figuring
it out to make decisions. He congratulated Community Development Director Barnhart.
Printup said there is history, people love the fire department, and it becomes an emotional issue with heels
being dug in which is normal. He agrees they need to be able to talk with the facts and that in the future
costs could come down.

1. Purpose. The purpose of this item is to amend the 2022 Annual Appointments.
2. Background. The City Council amended the annual appointments list at the January 10th City Council
Meeting. Based on direction received, staff prepared the attached draft of the amended resolution. The
amended resolution appoints Mayor Dennis Walsh, Council Member Victoria Seals, Finance Director
Ron Olson, and City Administrator/Engineer Adam Edwards to the Budget Committee.
Also amended were the portions of the 2022 Annual Appointments where Jeremy Barnhart was appointed
to serve. The title of Community Development Director was placed in the position in lieu of a name.

An opening exists for a full-time police officer.
2. Background. An opening exists for a full-time police officer.
3. Recruitment. . The selection process for the position involved advertising the position,
application screening, and interviews. First round interviews are completed by a panel of
currently swerving officers and second round interviews by the Chief of Police. Police Officer
applicant must also successfully complete a Psychological Exam, a Physical (Pre-employment
medical) exam and has pass the MN Peace Officers Standards and Training (POST) licensing
exam.
4. Recommended Candidate. Julia Knapek earned an associate’s degree in May 2022 from
Alexandria Technical and Community College. Julia recently passed the MN P.O.S.T. licensing
exam to be a peace officer in MN. Julia was previous employed by Stearns County as a water
patrol park officer for the past two summers. Julia is excited about the opportunity to work for
the Orono Police Department. Julia has completed and passed a comprehensive background
investigation, a Psychological Exam, a Physical (Pre-employment medical) exam.
5. Staff Recommendation. I recommend to hire Julia Knapek as a full-time police officer at
the with a start date of June 28, 2022.
a. Salary. Starting rate will be $33.66 per hour and per the union contract this will be
$34.00 per hour as of July 1, 2022.
b. Benefits. As a full-time employee the position is eligible for benefits as outlined in the
LELS Local 40 Agreement and personnel handbook. This includes enrollment in the Police and
Fire Plan of the Public Employees Retirement Association (PERA).

1. Purpose. The purpose of this action item is to meet the requirements of the City’s Municipal Separate
Storm Sewer System permit. (MS4)
2. Background. The City of Orono holds a MS4 permit under the National Pollutant Discharge
Elimination System (NPDES) program for operation of the City’s stormwater drainage system. The
NPDES is a national regulatory program under the jurisdiction of the US Environmental Protection
Agency (EPA), and is administered at the State level by the Minnesota Pollution Control Agency
(MPCA).
3. Requirement. A requirement of the permit is that an Annual Report be prepared and submitted
to the MPCA. Staff has prepared the report, and will submit to the MPCA after this meeting. One
component of the report is that the City must hold a Public Meeting. The meeting must provide a
summary of the City’s Storm Water Pollution Prevention Program (SWPPP), the activities of the
City for the past calendar year in regards to the permit requirements, and must afford the opportunity
for public input and comment.
4. Action. There will be a short presentation as part of the public hearing.

1.Purpose. To review the variances for building, hardcover, and retaining walls in the 75’ lakeyard
setback, side yard setback, as well as a lot area variance for the construction of a new house. As well as, a
wetland setback variance for new entrance monuments.
2.Background. This property has a unique lakeshore inlet (“French Lake Creek”) from Lake
Minnetonka on the west side of the property establishing an additional 75-footlake yard in addition to the
75-foot lakeyard from the lake on the south side of the property. The applicant is proposing to build a
new home and is working to utilize some of the existing footprint of the current house. The existing
home sits about 18 feet from the Lake Minnetonka and 50 feet from the inlet on the west. The applicant
proposes to construct the new home further from the lake, 36.5 feet from the OHWL of the lake, and 53
feet from the OHWL of the inlet. The proposal includes the removal of hardcover on the west and south
sides of the property. To minimize the inlet encroachment, the applicant proposes to move the home
closer to the east side property line, into the east side yard setback. The applicant has designed the home
to improve the current setbacks and hardcover encroachments.
The application depicts a new location for entrance monuments. The property currently has entrance
monuments that can be rebuilt or maintained. If the existing entrance monuments are removed, the new
monuments would be required to meet all city code standards. The new entrance monuments in the
proposed location create a larger setback from North Shore Drive, however the proposed monuments are
approximately 5 feet from the edge of the wetland where 25’ is required and completely within the 75’
foot lakeyard setback.
A variance was approved for a new home in 2019 (#LA19-000049). The 2019 approvals have expired.
The new application is reflecting similar variances. The home in the 2019 approvals had a 19’ side yard
setback, the current application is showing a 21’ side yard setback.
3.15.99 Deadline. The application was received on May 18, 2022 and was deemed complete on June 7,
2022. The 60-day review period will expire August 6, 2022.
4.Planning Commission Vote and Comment. On June 21, 2022, the Planning Commission held a
public hearing. The commission discussed the proposed variances and discussed the benefit of moving the
proposed house further away from Lake Minnetonka. The commission talked at length about the proposed
entrance monuments and provided feedback, noting that the proposed placement of the monuments does
not meet practical difficulty standards. However, the commission was open to a redesign of the existing
monuments within the existing concrete pad.
The commission voted 6-1, on a motion to follow staff’s recommendation to approve the building,
hardcover, and retaining walls in the 75’ lakeyard setback, side yard setback, and lot area; and to deny the
wetland setback and 75’ foot lakeyard setback request for new entrance monuments.
5.Public Comment The applicant submitted two neighbor signatures for the project. No comments
were made during the public hearing.

WHEREAS, on May18, 2022, Eskucke Design (hereinafter the “Applicant”), applied
for variances from City Code for the property addressed 2605 North Shore Drive and legally
described as:
That part of Government Lot 4, Section 9, Township 117, Range 23, described as
follows: Commencing at the North quarter corner of said section; thence on a
bearing of South (the North line of the Northeast Quarter of said section being

to Orono Municipal Zoning Code Section 78-1279 to allow for a new home, retaining walls, and
entrance monuments be located within the 75’ lakeyard setback; and
WHEREAS, the Applicant has made application to the City of Orono for variances
to Orono Municipal Zoning Code Section 78-1680 to allow new hardcover within the 75’ lakeshore
setback; and
WHEREAS, the Applicant has made application to the City of Orono for variances
to Orono Municipal Zoning Code Section 78-72 to allow for construction of a new home on a
substandard parcel; and
WHEREAS, the Applicant has made application to the City of Orono for variances
to Orono Municipal Zoning Code Section 78-1605 for a wetland setback variance for new
entrance monuments, and;
WHEREAS, on June 21, 2022, after published and mailed notice in accordance with
Minnesota Statutes and the City Code, the City Council held a public hearing, at which time all
persons desiring to be heard concerning this application were given the opportunity to speak
thereon; and
WHEREAS, on June 21, 2022, the Planning Commission recommended approval
of the building, hardcover, retaining wall, side yard setback, and lot area variances; and
WHEREAS, on June 21, 2022, the Planning Commission recommended denial of
the wetland and lakeyard setback of the variance for new entrance monuments, and
WHEREAS, on June 27, 2022, the City Council reviewed the application and the
recommendations of the Planning Commission and City staff; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota
hereby approves and denies the requested variances as described above based on one or more
of the following findings of fact concerning the Property:
FINDINGS OF FACT:
1. This application was reviewed as Zoning File # LA22-000028. The analysis contained
within staff memos and the exhibits attached to the aforesaid memos, all minutes from the
above mentioned meetings, and any and all other materials distributed at these meetings
are hereby incorporated by reference.

2. The Property is located in the LR-1A Zoning District.
3. The Property contains 1.86 acres in area and has a defined lot width of 230 feet at the
OHWL.
4. The Property is within Tier 1 and hardcover is limited to 25% according to the Stormwater
Quality Overlay District.
5. Applicant has applied for the following variances:
6. In considering this application for variance, the Council has considered the advice and
recommendation of the Planning Commission and the effect of the proposed variance
upon the health, safety and welfare of the community, existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, and the effect on values
of property in the surrounding area.
ANALYSIS:
1. The variance is in harmony with the general intent and purpose of the Ordinance.
The proposed variances are in harmony with the intent and purpose of the
Ordinance. The goal of the ordinance is to reduce or eliminate improvements in the
lake yard, the proposal shifts away from the lake yard as much as practical. This
criterion is met. The new entrance monuments are not in harmony with the
ordinance to prevent improvements within the wetland and lakeyard setback; this
criterion is not met.
2. The variance is consistent with the comprehensive plan. The proposed variances to
develop a nonconforming lot of record are consistent with the comprehensive plan.
3. The applicant establishes that there are practical difficulties.
a. The property owner proposes to use the property in a reasonable manner not
permitted by the official controls; The request to permit construction of the
home on the substandard lot, in the proposed location within the lake, and
side yard setbacks, appears to be reasonable considering the Property’s
reduced size and orientation with respect to the lakeshore. The hardcover
and retaining walls proposed within the lake yard appear to be reasonable.

The entrance monuments are permitted by the city code but the proposed
location is not reasonable within the wetland buffer and lakeyard setback.
b. There are circumstances unique to the property not created by the landowner; The
lake and its inlet limit the building envelope for the property. The
surrounding lakeshore is unique property feature of the lane and
c. The variance will not alter the essential character of the locality. The variances
are requested in order to permit construction of a home designed to fit the
character of the neighborhood according to the submitted information.
4. Economic considerations alone do not constitute practical difficulties. Economic
considerations have not been a factor in the variance approval determination.
5. Practical difficulties also include but are not limited to inadequate access to direct sunlight
for solar energy systems. Variances shall be granted for earth-sheltered construction as
defined in Minn. Stat. § 216C.06, subd. 2, when in harmony with Orono City Code Chapter
78. This condition is not applicable.
6. The board or the council may not permit as a variance any use that is not permitted under
Orono City Code Chapter 78 for property in the zone where the affected person's land is
located. This condition is not applicable, as the use for a single family home is an
allowed use in the LR-1A District.
7. The board or council may permit as a variance the temporary use of a one-family dwelling
as a two-family dwelling. This condition is not applicable.
8. The special conditions applying to the structure or land in question are peculiar to such
property or immediately adjoining property. The Property’s substandard size and
orientation with respect to the lakeshore creates difficulties which may also apply
to properties in the same neighborhood.
9. The conditions do not apply generally to other land or structures in the district in which the
land is located. The Property’s substandard size and orientation with respect to the
lakeshore creates difficulties which may also apply to properties in the same
neighborhood. However, the location of the lake surrounding the building envelope
is very unique to the Property.
10. The granting of the application is necessary for the preservation and enjoyment of a
substantial property right of the applicant. Granting a lot area, side yard and lake
setback variances are necessary for the preservation of the property right of the
application. The variances for retaining walls and hardcover in the lakeyard
facilitate the use of the Property for the new home and are necessary for the
preservation of the property rights of the owners. The wetland buffer setback and
75 foot lakeyard setback variances for the new entrance monuments are not
necessary for the enjoyment and use of the Property.
11. The granting of the proposed variance will not in any way impair health, safety, comfort or
morals, or in any other respect be contrary to the intent of this chapter. Granting the

requested variances in this unique situation is not contrary to the intent of the
zoning chapter.
12. The granting of such variance will not merely serve as a convenience to the
applicant, but is necessary to alleviate demonstrable difficulty. The variances do not
merely serve as a convenience to the Applicant. The variances are necessary as the
Property has considerable practical difficulties affecting development. The
entrance monuments are accessory structures to the principle building and
granting the requested variance would be a convenience and not necessary for the
use of the Property.
CONCLUSIONS, ORDER AND CONDITIONS:
Based upon one or more of the above findings, the Orono City Council hereby grants
variances to Orono Municipal Zoning Code Section 78-305, 78-72, 78-1279, 78-1680 to allow
construction of a new house and hereby denies the variance to Orono Municipal Zoning Code
Section 78-1605 and 78-1279 for new entrance monuments, subject to the following conditions:
1. Council approval is based on the entire record, above Findings.
2. The approved project shall conform to the survey and building plans submitted by the
Applicants and annotated by City staff, attached to this Resolution as Exhibits A.
3. Any amendments to the plans which are not in conformity with City codes may require
further Planning Commission and City Council review.
4. Authorities granted by this resolution run with the Property not with the Applicants, but are
permissive only and must be exercised by obtaining a building permit for the new
construction and commencing construction of said project. A framing inspection must be
completed within one year of the date of Council approval, or the variances will expire on
that date (June 27, 2023).
5. Violation of or non-compliance with any of the terms and conditions of this resolution may
result in the termination of any authority granted herein.

Background
This is a unique property in that an inlet from Lake Minnetonka encroaches into the lot,
establishing an additional 75 lake yard into the side of the property. The applicant is proposing
to build a new home, replacing the existing structure. The existing home sits forward of the 75’
lakeyard setback, about 18 feet from the Lake Minnetonka and 50 feet from the inlet. The
applicant proposes the new home further back away from the lakeshore, 36.5 feet from the
Lake, and 53 feet from the inlet. The proposal includes the removal of hardcover on the west
and south sides of the property. To minimize the inlet encroachment, the applicant proposes to
move the home closer to the east side property line, into the east side yard setback. The
applicant has worked to design the home to try and improve the current setbacks and maintain
some of the same footprint of the existing home. The proposal includes new expansions with
the house and hardcover within the 75’ lake yard.
Minnehaha Creek Watershed District (MCWD) was contacted regarding the proposed house
floor elevations. The proposed survey notes a low opening at the storage and lower garage at
925.5. MCWD noted they require the lowest opening of the house must be 933.5. This
information was shared with the applicant. MCWD will complete a review at time of permitting.
The application depicts a new location for entrance monuments. The property currently has
entrance monuments that can be maintained. New entrance monuments in new a location
would require them to come into conformance with the city code. The applicant is suggesting a
5 foot setback from the edge of the wetland where 25’ is required.
Application Summary: The applicant is requesting the following variances:
• Hardcover in the 75’ lakeyard
• Buildings in the 75’ lakeyard
• Retaining walls in the 75’ lakeyard
• Side yard setback
• Lot area
• Wetland setback for the proposed entrance monuments.
Staff Recommendation: Planning Department Staff recommends approval of the proposed
hardcover, building, retaining walls in the 75’ lakeyard, side yard setback and lot area variances.
Staff does not support the wetland setback for the proposed entrance monuments.

A variance application was approved for a new home in 2019 (LA19-000049). That application
has expired. The new home is asking for similar variances. The 2019 home was approved for a
19’ side yard setback, today’s application is proposing a 21’ side yard setback.
Practical Difficulties Analysis
Applicants Submittal information: The applicant has identified the unique existing lakeshore and
inlet lake yard as practical difficulties supporting the requested variance. Additionally, they have
provided supporting documentation regarding Practical Difficulties attached as Exhibit B, and
should be asked for additional testimony regarding the application.
Planning Staff Practical Difficulty Analysis: Regarding practical difficulty, Staff finds the inlet is a
practical difficulty supporting variances, and notes the applicant is working to improve the site
by working within the existing building footprint and massing of the proposed home. The new
home is further from the lakeshore compared to the existing home. The applicant is also
reducing the overall hardcover of the property. Due to the location of the existing home in the
lakeyard, grading will need to be done to remove the existing home and restore the lawn and
for the new proposed
Staff finds the wetland buffer setback variance a convenience and not necessary for the use of
the property. Staff does not support the wetland buffer setback variance request for new
entrance monuments.

Lot Area and Side Setback Variance (78-305 & 78-72)
The zoning district requires a lot to be 2 acre and have a 30’ side yard setback.
The property is 1.86 acres in size, substandard to the zoning district. The property is unique due
to the inlet of Lake Minnetonka and substandard size creating a limited building envelope.
Zoning Code Section 78-72 provides options for the redevelopment of lots which do not meet
the minimum area or width requirements for the respective zoning district. Substandard
properties within the Shoreland Overlay District, like the subject lot, are able to be redeveloped
without variances if specific standards are met; such as:
1. All setback requirements can be met; Not Met
2. A Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, can
be installed or the lot is connected to a public sewer; and
3. The impervious surface coverage meets all hardcover location and square footage
restrictions of this chapter and the total square footage of hardcover does not exceed
25 percent of the entire lot area. Met
4. All other zoning district standards can be met. Met
The applicants request for additional variances results in the property’s inability to conform to all
of the standards above. Therefore, lot area variances are required in order to redevelop the
property. The ability to develop the property consistent with other existing developed properties
in the neighborhood would be limited if the area and width variances are not granted.
Buildings and retaining walls in the 75’ Lakeshore (78-1279)
No building or retaining walls are permitting within the 75’ lakeshore setback.
The existing home sits almost entirely within the 75’ lakeyard setback. The new home will take
advantage of the existing homes footprint and massing. The retaining walls will establish some
usable lawn space along the side of the home. Retaining walls are also shown within the 75’
lakeshore along the front/lakeside of the home. Some of the walls will sit in the same footprint
and the existing deck. Some of the wall are proposed to support the driveway and some
proposed walls will be used to create the patio/terrace area.

The new home is proposed to meet average lakeshore setback but the building will encroach into
the 75’ setback along the eastern and western edge of the home due to the property being
almost entirely surrounded by lakeshore. Roughly 880 sq.ft. of the 5349 sq.ft new home is
located outside of the existing massing and is a new encroachment in the 75’ setback.
Hardcover in the 75’ Lakeshore (78-1680)
The property allowed 25% total hardcover. No hardcover is permitted within the 75’ lakeshore
setbacks.
The exiting home covers over 21% of the lot in hardcover the new proposed home will decrease
the overall hardcover to 16.79%. The meeting the overall hardcover requirements. Within the 75’
lakeyard setback; the new home is proposing a new deck/ terrace which takes advantage of the
existing patio footprint. The application will be removing the large existing driveway and
reconfigure the access to the house. The new driveway will take advantage of the existing
location but will reduce the overall driveway size. The new hardcover and building
encroachments are considered new hardcover within the lakeshore setback.
Wetland Buffer Setback (78-1605)
Where the MCWD does not require a buffer, a 25 foot setback shall be required between the
edge of all wetlands from any building (principal or accessory) or other structure, septic
systems, or wells. The wetland edge shall be determined as required in section 78-1604 of this
Code.
The applicant did not submit a wetland delineation or any findings that a buffer was established
through MCWD. The 25 foot setback buffer is a required setback for the site. The current
entrance monuments are nonconforming at roughly 6’ from the edge of wetland. These
improvements can be maintained but not expanded in any way. The applicant is proposing new
monuments in a different location roughly 5’ from the edge of wetland.
Governing Regulation: Variance (Section 78-123)
In reviewing applications for variance, the Planning Commission shall consider the effect of the
proposed variance upon the health, safety and welfare of the community, existing and
anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect
on values of property in the surrounding area. The Planning Commission shall consider
recommending approval for variances from the literal provisions of the Zoning Code in instances
where their strict enforcement would cause practical difficulties because of circumstances unique
to the individual property under consideration, and shall recommend approval only when it is
demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning
Code. Economic considerations alone do not constitute practical difficulties. Practical difficulties
also include but are not limited to inadequate access to direct sunlight for solar energy systems.
Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. § 216C.06,
subd. 2, when in harmony with this chapter. The board or the council may not permit as a
variance any use that is not permitted under this chapter for property in the zone where the
affected person's land is located. The board or council may permit as a variance the temporary
use of a one-family dwelling as a two-family dwelling.
According to MN §462.537 Subd. 6(2) variances shall only be permitted when:

1. The variance is in harmony with the general intent and purpose of the Ordinance. The
proposed variances are in harmony with the intent and purpose of the Ordinance. The
goal of the ordinance is to reduce or eliminate improvements in the lake yard, the
proposal shifts away from the lake yard as much as practical.
The new entrance monuments are not in harmony with the ordinance to prevent
improvements within the wetland buffer.
2. The variance is consistent with the comprehensive plan. The proposed variances to
develop a nonconforming lot of record are consistent with the comprehensive plan.
3. The applicant establishes that there are practical difficulties.
a. The property owner proposes to use the property in a reasonable manner not
permitted by the official controls; The request to permit construction of the
home on the substandard lot, in the proposed location within the lake, and side
yard setbacks, appears to be reasonable as the property’s reduced size and
orientation with respect to the lakeshore. The hardcover and retaining walls
proposed within the lake yard appear to be reasonable. The entrance
monuments are permitted by the city code but the proposed location is not
reasonable within the wetland buffer.
b. There are circumstances unique to the property not created by the landowner;
The lake and its inlet limit the building envelope for the property. The
surrounding lakeshore is unique property feature of the lane and
c. The variance will not alter the essential character of the locality. The variances
are requested in order to permit construction of a home designed to fit the
character of the neighborhood according to the submitted information.
Additionally City Code 78-123 provides additional parameters within which a variance may be
granted as follows:
4. Economic considerations alone do not constitute practical difficulties. Economic
considerations have not been a factor in the variance approval determination.
5. Practical difficulties also include but are not limited to inadequate access to direct sunlight
for solar energy systems. Variances shall be granted for earth-sheltered construction as
defined in Minn. Stat. § 216C.06, subd. 2, when in harmony with Orono City Code Chapter
78. This condition is not applicable.
6. The board or the council may not permit as a variance any use that is not permitted under
Orono City Code Chapter 78 for property in the zone where the affected person's land is
located. This condition is not applicable, as the use for a single family home is an allowed
use in the LR-1A District.
7. The board or council may permit as a variance the temporary use of a one-family dwelling
as a two-family dwelling. This condition is not applicable.
8. The special conditions applying to the structure or land in question are peculiar to such
property or immediately adjoining property. The property’s substandard size and
orientation with respect to the lakeshore creates difficulties which may also apply to
properties in the same neighborhood.
9. The conditions do not apply generally to other land or structures in the district in which
the land is located. The property’s substandard size and orientation with respect to the
lakeshore creates difficulties which may also apply to properties in the same
neighborhood. However, the location of the lake surrounding the building envelope is
very unique to this property.

10. The granting of the application is necessary for the preservation and enjoyment of a
substantial property right of the applicant. Granting a lot area, side yard and lake setback
variances are necessary for the preservation of the property right of the application.
The retaining walls and hardcover in the lakeyard variances facilitate the use of the
property for the new home and are necessary for the preservation of the property. The
wetland buffer setback variance for the new entrance monuments are not necessary
for the enjoyment and use of the property.
11. The granting of the proposed variance will not in any way impair health, safety, comfort
or morals, or in any other respect be contrary to the intent of this chapter. Granting the
requested variances in this unique situation is not contrary to the intent of the zoning
chapter.
12. The granting of such variance will not merely serve as a convenience to the applicant, but
is necessary to alleviate demonstrable difficulty. The variances do not merely serve as a
convenience to the applicant. The variances are necessary as the property has
considerable practical difficulties affecting development.
The wetland buffer setback for entrance monuments are accessory structures to the
principle building and granting this variance is a convenience and not necessary for the
use of the property.
The Commission may recommend or Council may impose conditions in granting of variances.
Any conditions imposed must be directly related to and must bear a rough proportionality to the
impact created by the variance. No variance shall be granted or changed beyond the use
permitted in this chapter in the district where such land is located.
A review of the new home will be completed when a building permit is submitted.

The applicant submitted two neighbor signatures for the project. It is included as Exhibit G.

1.Purpose. The applicants are requesting lot width variances for both lots with the goal of a boundary
line adjustment.
2.Background. Ressler and Plachecki are neighboring property owners at 3683 and 3685 North Shore
Drive. The applicants are looking to complete an administrative boundary line adjustment (officially
called a Subdivision Exception) which can be completed by staff and recorded by the owner. Moving the
property boundary is a staff administrative action as long as no new non-conformities are created or an
existing non-conformity is not increased. The requested variance, if granted, would allow the City to
administratively adjust the boundary line.
Each property will require a lot width variance in order to allow the boundary line adjustment. Lot width
is measured in 2 places on lakeshore properties, at the ordinary high water level (OHWL) and at the 75’
lakeyard setback. Properties in the LR-1C district require 100’ lot width.
Similar to other nearby properties, both of these lake-front properties are nonconforming to lot width, area
and setbacks. Due to the angle of the proposed lot line, the lot width will decrease at the 75’ lakeyard
setback from 54’ to 52’ at 3683 North Shore Drive and at 3685 North Shore Drive it will decrease from
92’ to 82’ at the OHWL. The new property boundary will maintain the same lot areas overall. Most
relevant to the City Council’s consideration, the proposed new property line will improve many non-
conformities on the both parcels. The building setback, overall hardcover and lot width at the OHWL
will improve for 3683 North Shore Drive and the new property line will be move off of the existing
driveway bringing the driveway setback closer to conformance for 3685 North Shore Drive. These results
will, therefore, further the goals of protecting against overcrowding at the lakeshore in this zoning district
and lessen difficulties created by historical development in the neighborhood. Furthermore, the decrease
in hardcover at 3683 North Shore Drive serves to mitigate the impacts of hardcover runoff and improve
storm water management in the area.
3.15.99 Deadline. The application was complete on May 5, 2022. The 60 Review Period expires July
2, 2022.
4.Planning Commission Vote and Comment. On May 16, 2022, the Planning Commission held a
public hearing. The commission reviewed the application and discussed support for the application.
They noted the improvement to the hardcover calculations and building setbacks were important
improvements to the sites. No comments were made during the public hearing. The commission voted 7
to 0 to approve the lot width variances for both properties.

6.Staff Recommendation. Staff finds there are some practical difficulties to support the lot width

supporting documentation regarding Practical Difficulties attached as Exhibit B, and should be asked for
additional testimony regarding the application.
Planning Staff Practical Difficulty Analysis: Regarding practical difficulty, Staff finds that the proposed lot line

The request to realign the shared property line between two nonconforming lots
improves nonconforming lot width, hardcover and building setback as applied to for
the adjacent properties. The use of the property is established with the existing
homes on the properties. The variance does not impact this use.
b. There are circumstances unique to the property not created by the landowner; The unique
shape, size, and orientation of the subject properties present challenges. The properties have
been developed over time not exclusively by the property owners. The proposed boundary
line adjustment follows the historic development pattern. The suggested reallocation of
property would result in more improved nonconforming city codes on the property bringing
the property closer to conformance for the neighborhood. There should be consideration for
variance approvals from the lot width as the applicants are proposing improvements on both
lots.
c. The variance will not alter the essential character of the locality. The lots are both
nonconforming as they pertain to lot width. Altering the lot line between the parcels
improves the lot width as one point of measurement but increase the nonconformity at
another point of measurement creating an even trade between the two nonconforming
parcels, so there is little impact to the character of the area.
4. Economic considerations alone do not constitute practical difficulties. Economic considerations have
not been a factor in the variance approval determination.
5. Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar
energy systems. Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. §
216C.06, subd. 17, when in harmony with Orono City Code Chapter 78. This condition is not applicable.
6. The board or the council may not permit as a variance any use that is not permitted under Orono City

WIDTH VARIANCES AS PART OF AN ADMINISTRATIVE BOUNDARY LINE
ADJUSTMENT BETWEEN THE TWO PROPERTIES. (STAFF: LAURA OAKDEN)

Jon Ressler and Frank Plachecki, Applicants, were present.
City Planner Oakden noted Ressler and Plachecki are neighboring property owners at 3683 and 3685
North Shore Drive. The Applicants are looking to complete an administrative boundary line. Moving the
property boundary is a staff administrative action as long as no new non-conformities are created or an
existing non-conformity is not increased. Each property will require a lot width variance in order to allow
the boundary line adjustment and the existing lot width non-conformity will increase. Lot width is
measured in 2 places on lakeshore properties, at the ordinary high water level (OHWL) and at the 75 foot
lakeyard setback. Properties in the LR-1C district require 100 foot lot width. Both properties are
nonconforming to lot width, area and setbacks. Due to the angle of the proposed lot line, the lot width will
decrease at the 75 foot lakeyard setback from 54 feet to 52 feet at 3683 (the smaller property on screen)
and at 3685 the lot width will decrease from 92 feet to 82 feet at the OHWL. The new property boundary
will maintain the same lot area sizes. Oakden stated the new property line will improve many of the non-
conformities on the both parcels. The building setback, overall hardcover, and lot width at the OHWL
will improve on the smaller property; currently all of those are non-conforming and all will improve and
come closer to the City Code. The new property line will move off the existing driveway bringing the
driveway setback closer to conformance for 3685 North Shore Drive. Oakden showed a slide on screen
showing the proposed adjustments. The Applicant has primarily identified the existing conditions and the
improvement of many non-conformities to the city Codes for each property as practical difficulties
supporting the requested variance lot width variances and boundary line adjustment. Additionally, they
have provided their supporting documentation regarding practical difficulties attached as Exhibit B, and
should be asked for additional testimony regarding the application. Staff finds that the proposed lot line
adjustment improving existing non-conformities on hardcover, building setbacks, and driveway setbacks
is a positive improvement. The lot width variance requested may be supported by practical difficulty.
Staff finds there may be some practical difficulties to support that lot width variance.
Jon Ressler, 3683 North Shore Drive, stated the reason for this application is to apply how the property
has been used in practice for over three decades.

Kirchner stated it seems that there are slight improvements to hardcover and he does not have a lot of
issues with the application.
Bollis sees that it is clearing up an issue as far as how the properties have been used. He agrees that part
of it is getting smaller and the other getting bigger. The reduced hardcover and setback getting better in
places is helpful.
McCutcheon thinks they are improving the situation with items that Staff highlighted, plus thirty years is
a long time and they are correcting something, especially when there is agreement from both neighbors.

1. Purpose. The purpose of this action item is to gain council approval to commence construction
designs for the Navarre Municipal Parking Lot.
2. Background. Previous work includes a public engagement process and a feasibility report. Through
the summer of 2021 the City Community Development with consultant support from Bolton and Menk
(BMI) completed a public engagement process with the Navarre area to evaluate possible improvements
to the Navarre Parking lot (Report at Exhibit A). Based on the feedback form the public engagement the
City with BMI completed a feasibility study for the project to establish key elements and an initial cost
estimate for the parking lot improvement (Layout at Exhibit B).
3. Scope. The engineering services will consist of detailed design of the parking lot including: survey,
concrete islands, lighting, storm sewer system and pavement marking.
4. Cost. Bolton and Menk (BMI) has provided a scope of services for a fee estimate not to exceed
$42,750 (Exhibit B).

5. Funding. The engineering as well as the eventual project will be funded with a combination of the
funding sources. During the CIP process this project was identified to be primarily funded from the
Community investment fund. However the increase in scope combined with increasing construction costs
have resulted a need to look to other funding sources. Staff is currently recommending using the PIR
fund for a portion of the construction expenses. The PIR fund however must be paid back over time.

RE: Navarre Municipal Parking Lot Community Engagement
City of Orono
The Navarre Area municipal parking lot, located near the intersection of Shadywood Road and Shoreline
Drive requires repair due to aging asphalt and poor surface conditions. Additionally, the comprehensive
plan identified this parking lot as a future space for community events. The City of Orono’s council
requested staff conduct engagement efforts to ensure future investments in the parking lot meet
community needs. Bolton & Menk was retained through the service agreement to complete these efforts.
This memo and its attachments detail the efforts completed and the participants’ responses.
Efforts
Multiple marketing and engagement strategies were implemented to solicit feedback from the public and
surrounding businesses. Three events were held:
•Virtual Open House. The City of Orono’s website hosted a virtual open house which included
information about the project and a brief survey. As part of the virtual open house, a virtual
listening session was held on August 12th, 2021 at 7 PM. There were seven participants.
•Pop Up in the Parking Lot. On August 17 th, 2021 from 4 PM to 7 PM, a pop up public input
opportunity was held in the Navarre municipal parking lot. At this meeting, users of the parking
lot were able to make brief comments about the parking lot and changes they would like to see
and complete a sticker exercise to identify types of improvements. Eleven people signed in with
dozens more providing comments as passersby.
•Business Focus Group. On September 14th, 2021 at 2 PM, a virtual focus group was held with two
business owners (Narrows Saloon and Ace Hardware).
To invite community members to the engagement events, multiple marketing materials were developed
and circulated:
•Postcards were sent to property owners and tenants in advance of the virtual open house, listening
session and pop up.
•Postcards were sent to business owners to invite them to the virtual open house and business
focus group. Due to lack of response, a follow up letter was sent by City Staff and a nother
postcard was sent after a date was selected.
•A press release was published on the City of Orono’s website to invite the broader community to
participate.
Results
Survey (Online, combined with Pop -Up)
The online survey was published to collect comments from the community about the future of the lot.
This five-question survey asked respondents what type of community events they would like to see take
place in the space, what features they would like to see in this parking lot, what could make the lot more
functional and if there was anything else we should know about the parking lot. If respondents wanted to
stay updated with the project as it progresses, they could enter their email at the end of the survey. As of
September 2nd, 2021, this survey had received 104 responses. The results are summarized below.
Question 1. “The comprehensive plan identified the municipal parking lot as a future space for
community events. What type of events do you feel would be most important here?”
Support for a future farmer’s market at the site was highest, with 76% of the respondents supporting one
at the lot. Community festivals and art fairs were next, each receiving support from about half of the
respondents. Car shows received support from about 20% of respond ents. There were an additional 18
write-in responses with answers, including the addition of a pickleball court and a request that nothing be
done to the lot. Figure 1 shows the survey results for question 1. The complete answers can be found in
Appendix A.

Question 2. What type of features would you like to see in this parking lot? Select all that apply.
A list of 12 features that could be added to the parking lot were provided to respondents. Flexible space
was the most common feature requested, with 73% of respondents requesting it. Lighting was next at
67%, followed by natural plantings and trash bins and dumpster enclosures. This question was also asked
at the pop-up event. The most popular features at the event, like with the online survey, were lighting and
flexible space. Figure 2 shows the survey results for question 2 and Figure 3 shows the results to the same
question from the pop-up in the parking lot.

Question 3 was the write in comments section about the multiple -choice question 2. These comments
varied widely in topic, opinion, and tone, but they could be categorized into four broad sections: nature
related, renovation/re-striping, events, and other. Natural plantings and shade trees were popular
responses, and many people wanted to re-stripe the parking lot. Other responses varied from support of
the project to opposition of doing anything to change the current uses of the parking lot. The full list o f
responses can be found in Appendix B.

Question 4. Are there other changes the city could consider making to make this lot more
functional?
This was the second write-in question posed to the respondents of the online survey. Over half (53) of all
survey respondents answered this question. Similarly, to question 3 the comments were a wide variety of
topics, opinions, and tones. Responses varied from simple maintenance requests, like re -striping or hiding
dumpsters better, to larger projects like leveling the land and improving drainage systems or building a
multi-level parking garage. Many comments were parking related, but several comments were about
natural features like trees and greenspace. The full list of comments is available in Appendix C.
Question 5. Is there anything else we should know about this parking lot?
Question 5 was the third write-in question and was a space for more general comments about the parking
lot. Forty responses were received for this question from the online survey. Comments a re lumped into
three main categories: business related, maintenance/renovation, and other. Business related comments
mostly spoke to how there was not enough parking dedicated to the businesses at the shopping center.
Maintenance and renovation ideas vari ed from restriping the site to adding parking capacity through
multiple means, including building retaining walls to create more space and having nearby houses give up
some of their property to the lot. The full list of these comments is available in Appendix D.
Virtual Listening Session
The listening session was held online and asked participants their thoughts on what
improvements are necessary for the parking lot. Items discussed include:
• Concerns about the aesthetics of the parking lot, specificall y the private property owner
to the west and enforcing current standards for all businesses ; garbage screening; bury
utilities; more plantings, greenery, and tree shade
• Future functionality including EV charging stations or preparing for them in the future by
burying the conduit; incorporating future events, even if the events happened at the
nearby park and closed Lyric Avenue
• Multimodal accommodations including pedestrian connections to the Metro Transit
station; improvements for the K-12 bus stop waiting; trail head parking with bicycle and
pedestrian facilities, including bike parking
Pop Up in the Parking Lot
In addition to the online survey, a pop -up event was held in the parking lot. At this event, comments were
collected to gauge feedback on wh at should be done with the space. The answers, like with the online
survey, were all varied. Many commented that they wanted to see maintenance and renovations done,
while others offered general comments about the current conditions in the parking lot. The full list of
these comments can be found in Appendix E.
Business Focus Group
A focus group with the Narrows Saloon and Ace Hardware provided insight on these businesses’
needs and operations as they relate to the parking lot. Generally, these businesses would like to
see the parking lot spruced up and potentially expanded, with improved lighting. They
recommended evaluating the underground utilities after a series of water issues in previous years,
to ensure improvements minimize disruption to their busin esses. Other items discussed include:
• These businesses noted any changes to the parking lot needs to consider truck delivery
and minimize the barriers trucks would need to navigate.
• Spaces are not full depth so that creates drive lan e challenges, especially with large
vehicles. With the new regional bicycle trail connection, increasing numbers of vehicles
have additional bicycle trailers, which increases their overhang into the drive lane.
• Consider ways to reduce/minimize impacts from using the lot as a shu ttle lot because it
reduces the flexibility and availability of parking for surrounding businesses.
• If there are opportunities to expand the lot, the city should consider it , but limit
maintenance and find the most cost-effective solutions.
• The parking lot could use some aesthetic improvements.
Summary
The feedback received regarding the future of the Navarre municipal parking lot was varied,
however multiple ideas were more favored than others. These themes and ideas are summarized
below into five categories, with descriptions and order of magnitude cos t/effort estimates.

Question 1 – Write In
• None of those. Too much commotion and noise for those of us that live nearby.

• I think the above are good ideas, but most take more management and logistics than people
realize and I'm not sore there is a community bene fit. Car show is probably a fit as they are
typically nights and weekends and don't effect the businesses adjacent. Seems like letting the
restaurants use the majority of the lot for free is an issue that needs to be address. They should
probably pay for larking and a percentage of the maintenance as they cause the wear and tear and
the benefit financially.

Question 3 - Write-in Answers
• Natural plantings will end up weeds. The picture example looks unkempt. And no ground art!
Keep the children across the street in the playground.
• If you do a farmers market or outdoor music or art festival then where do people park for that ?
Plantings near the basement doors under lulus and lakeshore interiors could spruce up that end of
the parking lot
• Maximize parking and beautify by cutting into embankment on west and northwest, adding
retaining wall and plantings. That slope is difficult to mow, never looks good and collects trash.
A number of the social events suggested have in the past, and could again in the future , utilize
the adjacent park space and the street between the park and the parking lot. This lot fills up now
and really nees to maximize the parking space as its primary function.
• It would be nice to somehow tie it into the nearby playground and convey the natural beauty of
the area and of Lake Minnetonka. Navarre could use a good gathering place such as Wayzata's
new boardwalk with fountains, greenery and such.
• Incorporate with the park next door—maybe the plantings and seating can be in combination.

• 1. I would rather have "natural shade" in the forms of trees, rather than man -made shade
structures. 2. EV charging (TESLA supercharging!) would be great since those individuals
need to "hang out" for a time. 3. A decorative low "wall" (or consistent landscaping) around the
exterior would better mark the area. We could tie in the municipal lot with Lunds and Byerlys if
the "wall" were copied around their parking lot by the sidewalk. Navarre largely lacks a cohesive

• Seriously. The Navarre area does not need any farmer's market s, etc. The parking area should
remain for parking and yet, it should be beautified with all of the boxes I checked previously.
The markets are in Mound along with the gardens, etc. I would like to see a ton of year 'round
gorgeous landscaping and Christmas lights.
• not many curbs due to snow plowing. no pavers because they chip and crack and with the slope of
the Parking Lot they would get filled with debris.
• I think if you resurface and do the striping ---it would then be perfect. Trying to beautify the
parking lot would take away from the atmosphere of the area and be an expense the citizens do
not need. A small farmers market once a week would be OK but not necessary as there are
many other farmers markets close by. Lund's and Byerly's do not nee d additional produce to
compete with and we do not want to lose our convenient grocery store.

crosswalk and then nagivate the parking lot to take her to the park. It would be nice to have
designated crosswalk for that adventure.
• If this parking lot is going to be used as a multi -purpose, where are patrons for the
Narrows/Lakeroom and Hardware store parking during events? And also where are patrons to the
"other events" parking?
• This lot is not big enough to hold events without coordinating with businesses. A farmers market
or community event would be harmful to my business. There are many trucks with trailers and
taller service vans that use the lot so need to make sure to accomodat e these users- parking lot
islands or dividers would make parking with a trailer difficult.
• It would be nice to tie this into the extention of the Dakota trail that was completed this year.
Make it a space for bike parking as well as an event space and pa rking lot.
• Would be great to have space for food trucks/farmer's market/music
• Most of the items above will add significant increases to the project. The lot is highly used and
optimizing the number of spaces should at the top of the list. The items provided could be

examples, or Apandana Solar- they put the array on top of the MSP airport garage
• I would love to see a well-lit space that feels safe for all people, all the time. It's a bus stop for
children in the morning, so having it clean and safe should be a priority. I'd love to see some
outdoor dining space for the resataurants too. It is the loading dock for the hardware store, so
there are challenges, but I look forward to seeing a great solution! Thanks for allowing us to

• I own Navarre Hardware. The Narrows and Lake Room will often take most of the parking
during evenings and weekend brunch (10am - 2pm). During these times there is not enough
parking for my customers. Many parking spaces are only 16' deep which is not enough for a full
size car, SUV or truck so vehicles extend into the drive lanes making navigation difficult .At
times Lord Fletchers has used the lot for employee parking and used a shuttle. The lot also gets
used for Parade of Homes, Artisan Home Tour, daily commuters, meeting place for local
workers, etc. ,These activities can take 20 spaces which creates more stress on parking
availability.

As requested, we have prepared a scope of services and design fee estimate for the proposed Navarre Parking Lot
Improvements. It is our understanding that the scope of the project will include milling and overlaying the existing
pavement. The project will also include additional lighting, concrete islands, and improvements to the storm sewer
structures. The approved concept plan is attached for reference.
Proposed Scope of Engineering Services
To assist the city with this improvement project, Bolton & Menk proposes the following scope of services:
Staff Design Meetings – Our team will work with City staff to develop the scope of the project and to get input on
design details. The goal of these meetings is to ensure that the project is designed consistent with City standards
and that the City’s maintenance practices and operations are considered throughout the design process.
Detailed Design and Bidding – Once the final scope of the project is determined, Bolton & Menk will prepare
detailed plans and specifications. This work will include design of a lighting system that meets lighting levels
approved by the city. Once authorized, the project will be advertised for competitive bids. Bolton & Menk will
administer the bidding process and will ultimately make a recommendation to the City Council about awarding the
project.
Fee Estimate
Based on the scope of services described above, we propose a not-to-exceed fee of $42,750 to be billed on an
hourly basis. Once the Construction Contract is awarded, Bolton & Menk will prepare a separate scope and fee
estimate for construction phase services.

1. Purpose. To adopt resolution approving an emergency repair of a lake slope.
2. Background. A variance application was submitted on June 22, 2022 to repair a retaining wall at
1354 Rest Point Circle. The repair for the walls indicate a footprint expansion to support the slope of the
lakeyard leaving the existing walls in place. A soils engineer provided documentation showing the slope
failure is imminent and needs an emergency fix.
The city code section 78-1726 (6) Emergency repair exception. Slope failures have a direct impact on
the health and welfare of Orono residents, and timely response to such events is important to the
protection of natural resources and private property. Therefore, the city engineer may declare grading
and/or export/import activities in the Lake yard exceeding the limits above as emergency repair and
forward such application to the city council for immediate review. Emergency repair shall be defined
for the purposes of this article as the activities necessary to stabilize a failing slope, or prevent the
imminent failure of a slope, in the opinion of the city engineer.
The recommended correction for this slope failure is to construct new walls in front of the existing failing
walls. A building permit and variance is required to allow a new footprint expansion of a retaining wall
within the lakeyard
3. Engineer Comments.
a. This Application: The applicant has provided a letter from a licensed engineer, Ronald Vickery,
with the assessment that a slope failure is imminent. Further the same engineer has provided a plan for
stabilizing the slope using retaining wall in front of the failing existing walls and installing soil anchors. I
believe the proposed fix does address the potential slope failure. In this particular instance the proposed
emergency repair appears to also be the proposed permanent repair. Therefore my recommendation for
council to authorize the emergency repair in a timely manner but is not a recommendation to forgo the
normal requirements associated with improvements in the lakeyard / 75foot setback for the permanent
structure which should still follow.
b. Code Section 78-1726 (6). To my knowledge this is the first time this code section has been
invoked since it was added several years ago. This application is a good test case for the ordinance and
while I believe meets the intent of the code section, it does identify a potential need for a code amendment
to provide better clarity and links to other sections of code. The portion of code this emergency repairs
exception is in deals with grade alterations but does not specifically include structures within the lake
yard. Most of the best practices for providing emergency slope stabilization involve some sort of
structure. I recommend the city review this section of code to specifically acknowledge the use of
structures for emergency slope repairs.
4. Staff Recommendation. Staff recommends approval of the resolution to allow the contractor to
proceed with for the emergency slope failure as designed.

A RESOLUTION
APPROVING AN EMERGENCY SLOPE REPAIR
PURSUANT TO
MUNICIPAL ZONING CODE
SECTION 78-1726
WHEREAS, on June 9, 2022, Dennis Walsh (hereinafter the “Applicant”), pursuant
to City Code 78-1726, applied for authorization to proceed with an emergency repair to the lake slope
on his property addressed 1354 Rest Point Circle and legally described as:
Lot 11, Subdivision of Lot 14 Rest Point Park, Lake Minnetonka and Lot
13 Subdivision of Rest Point Park, Lake Minnetonka, Hennepin County, Minnesota
(hereinafter the “Property”);
WHEREAS, the Applicant submitted documentation from a licensed professional
engineer which indicates the failure of the current lake yard slope on the Property and the existing
retaining walls is imminent; and
WHEREAS, the Applicant has made a request to the City of Orono for an
emergency slope repair pursuant to Orono Municipal Zoning Code Section 78-1726; and
WHEREAS, on June 9, 2022, a corrective restoration plan was provided by the
Applicant’s licensed professional engineer to correct and reinforce the existing failing retaining
walls; and
WHEREAS, the engineered plans proposed an expansion of the existing retaining
wall footprint within the 75’ setback from the ordinary high water level (hereinafter the “OHWL”)
of Lake Minnetonka where no walls are permitted and existing walls are failing; and
WHEREAS, due to their proximity to the OHWL the new, reinforcement retaining
walls will require a setback variance from City Code section 78-1279; and
WHEREAS, on June 27, 2022, the City Council reviewed the request, the
engineered plans, and the recommendations of the City staff; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota
hereby approves the requested emergency slope repair including new engineered retaining walls
as described above based on one or more of the following findings of fact concerning the Property:

FINDINGS OF FACT:
1. The analysis contained within staff memos and the exhibits attached to the aforesaid
memos, all minutes from the above mentioned meetings, and any and all other materials
distributed at these meetings are hereby incorporated by reference.
2. The Property is located in the LR-1B Zoning District.
3. The Property contains 0.71 acres in area and has a defined lot width of 125 feet.
4. The Property is within Tier 1 and hardcover is limited to 25% according to the Stormwater
Quality Overlay District.
5. The Property contains existing timber walls within the lake yard 75-feet from the OHWL
which have been determined to be under imminent threat of failure confirmed by a licensed
professional engineer.
6. The Applicant has requested consideration for an emergency slope repair pursuant to City
Code Section 78-1726. Engineered plans were provided which demonstrate the proposed
corrective action.
7. Retaining walls are not permitted within 75-feet of the OHWL; installation of new walls
require City Council approval of a lake setback variance.
8. In considering this application for emergency slope repair, the Council has considered the
advice and recommendation of the City Staff and the effect of the proposed emergency
slope repair upon the health, safety and welfare of the community, existing and anticipated
traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on
values of property in the surrounding area.
CONCLUSIONS, ORDER AND CONDITIONS:
Based upon one or more of the above findings, the Orono City Council hereby grants
approval to proceed with an emergency slope repair pursuant to Orono Municipal Zoning Code
Section 78-1726 to allow the repair of the existing retaining walls including installation of new
retaining walls according to the approved plan, subject to the following conditions:
1. Council approval is based on the entire record, above Findings.

2. The approved emergency slope repair shall conform to the submitted plans (hereinafter
the “Plans”) submitted by the Applicant and annotated by City staff, attached to this
Resolution as Exhibit A.
3. Any amendments to the emergency slope repair which are not in conformity with City
codes may require further Planning Commission and City Council review.
4. A building permit must be issued before work can commence on the emergency slope
repair.
5. The Applicant shall apply for and receive an after-the-fact variance from City Code 78-
1279 prior to finalization of the building permit for installation of the walls.
6. Authorities granted by this resolution run with the Property not with the Applicant, but are
permissive only and must be exercised by obtaining a variance and building permit for the
Plans. A building permit must be applied for within 60 days of the date of Council approval,
or the action will expire after August 26, 2022.
7. Violation of or non-compliance with any of the terms and conditions of this resolution may
result in the termination of any authority granted herein.

Sec. 78-1725. Purpose and intent.
The purpose of this section is to promote the health, safety, and welfare of the community and to establish
reasonable uniform limitations, standards, and controls for land alterations, excavating, filling and grading within
the city. The regulations will allow the city to better manage stormwater discharge, ensuring drainage does not
negatively impact neighboring properties, manage hauling traffic and noise, and prevent erosion issues onto
adjacent properties, wetlands, lakes, and roads.

Sec. 78-1726. Interim use permit required.
An application for an interim use permit shall be accompanied by a certified site plan showing the location of
the proposed excavation or storage and shall state the amount of material which is to be removed, excavated or
stored, placed, or graded, and such other information as the council may require. Applications shall be filed with
the city administrator and shall be accompanied by a deposit to be determined by the city, which will be used to
offset the cost of processing the application. Any unused portion will be refunded to the applicant.
(a) Except where otherwise provided in the article, it is unlawful for any person to perform or have
performed the following land alteration activities without an interim use permit issued by the council:
(1) Mining. The commercial extraction of sand, gravel or other material from the land and their
removal from the site without processing shall be mining. In all districts, the conduct of mining
shall be permitted only upon issuance of a interim use permit. Such permit shall include, as a
condition, a plan for a finished grade which will not adversely affect the surrounding land or
development of the site on which the mining is being conducted, and the route of trucks moving
to and from the sites. A bond will be required for restoration
(2) Soil processing. The operation of processing of sand, gravel or other material mined from the
land shall be permitted only by interim use permit. Such permit shall include a site plan where
the processing is to be done, showing the location of the plant, disposal of water, route of trucks
moving to and from the site in removing processed material from the site, the condition in which
the site is intended to be left upon completion, hour of operation; and such permit shall not be
granted for a period of longer than 12 months
(3) Creation of an engineered grade for the basis of building height determination outside of a
subdivision.
(4) Unless included as part of a permitted project or as exempted below, the following activities
require a separate interim use permit.

Re: Wall Evaluation, 1354 Rest Point Circle in Mound, Minnesota
As you requested, Vickery Engineering & Consulting, LLC (VEC) has performed visual observations of
the existing timber walls at the referenced location. As requested, I’m writing this letter to discuss the
evaluation of the existing timber walls.
Background Information
VEC prepared final design and construction drawings for the new retaining walls on this project. The
plans prepared are titled “Proposed Timber Retaining Walls, 1354 Rest Point Circle, Mound, Minnesota",
and were dated 6/4/2022. The project number for the plans was VEC 21-230.
Site Observations
VEC performed observations of the existing retaining walls last fall. At that time, the walls were
observed to be leaning outwards, with many of the timbers showing indications of the decay of the wood.
Several of the walls showed indications that the face of the wall was pulling away from the deadmen that
are anchoring the wall face in place.
Discussion
The existing walls are essential in holding the slope in place during construction. In order to keep the
slope from falling into the lake, shoring will be required to keep the existing soils on the slope. There is
no way to get a pile driving rig into the back yard to provide sheet piling for shoring, so leaving the
existing walls in place and building in front of the walls is the only way to repair the walls on the slope.
Conclusions
Based on our on-site observations, it is our opinion that if the walls aren’t repaired in the near future, the
entire slope will likely end up in the lake, walls and all. The potential for failure increases every day that
passes, and failure could be imminent, especially if there are any large rain events in the new future.
