GRANT OF PERMANENT EASEMENT
FOR DRAINAGE AND UTILITY PURPOSES
ROBERT D. ERICKSON and LISA S. ERICKSON, married to each other, hereinafter
referred to as "Grantors", in consideration of One Dollar ($1.00) and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, do hereby grant unto
the CITY OF ORONO, a Minnesota municipal corporation, the Grantee, hereinafter referred to
as the "City", its successors and assigns, forever, a permanent easement for public drainage and
utility purposes over, across, on, under, and through land situated within the County of Hennepin,
State of Minnesota, as described on the attached Exhibit "A" and depicted on the attached Exhibit
"B" (the Easement Property").
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
upon the Easement Property at all reasonable times to construct, reconstruct, inspect, repair, and
maintain said public drainage and utility systems over,across,on,under,and through the Easement
Property, together with the right to grade, level, fill, drain, and excavate the Easement Property,
and the further right to remove trees, bushes, undergrowth, and other obstructions interfering with
the location, construction, and maintenance of said public drainage and utility systems.

The easements granted herein are subject to the following restrictions:
(i) The City is prohibited from creating or installing over the existing sanitary
sewer main within the granted Easement Property any stormwater management
ponds or any other type of pond or rain garden.
The above-named Grantors,for themselves,their heirs,successors and assigns do covenant
with the City,its successors and assigns,that they are well seized in fee title of the above-described
Easement Property;that they have the sole right to grant and convey the easement to the City; that
there are no unrecorded interests in the Easement Property; and that they will indemnify and hold
the City harmless for any breach of the foregoing covenants.

EXHIBIT "A"
to
GRANT OF PERMANENT EASEMENT
Legal Description of Property:
That part of Lots 10, 11 and 12, Block 1, HILLSIDE PARK, according to the recorded
plat thereof; Together with that part of the vacated alley adjoining said Lot 12 per
Document Number 2711665, Hennepin County, Minnesota, lying west of a line described
as commencing at the Northwest corner of said Lot 10; thence on an assumed bearing of
North 89 degrees 57 minutes 07 seconds East, along the north line of said Lot 10, a
distance of 307.00 feet to the point of beginning of said line to be described; thence on a
bearing of South to the shoreline of Lake Minnetonka and said line there terminating.
AND
All of Lots 15 and 16, and that part of Lot 14 lying North of the South 15 feet thereof,
Block 2, "Hillside Park"; also
The East 1/2 of that part of the vacated alley in said Block lying Southerly of an extension
across it of the Northerly line of the South 30 feet of said Lot 14.
The East line of Lot 13, Block 2, Hillside Park being marked by a judicial landmark at the
point of intersection of said East line and the Westerly extension of the North line of the
South 30 feet of said Lot 14. The North line of the South 30 feet of said Lot 14 being
marked by a judicial landmark at a point in said North line, distant 191.8 feet East of the
East line of said Lot 13 are established by the judicial landmarks. (See Order Doc. No.
485552)
Also the South line of that part of said Lot 14 lying North of the South 30 feet thereof is
marked by Judicial Landmarks set pursuant to District Court Case No. 514584 and the
North boundary line of said Lot 16 is marked by Judicial Landmarks set pursuant to Torrens
Case No. 15570 at the Northeast and Northwest corners of said Lot 16.
ALSO
Lots 17 and 18, Block 2, "Hillside Park"
The south boundary line of Lot 17 is marked by judicial landmarks set pursuant to Torrens
Case No. 15570.
Legal Description of Drainage and Utility Easement:
That part of Westlake Street (dedicated as Lake Street in the plat of"Hillside
Park") which lies southerly of a curve concave to the north having a radius of 50
feet. Said curve is concentric with the following described curve: A curve
concave to the west having a radius of 40 feet, said curve passes through the

northwest corner of Lot 9, Block 1, "Hillside Park" and passes through a point on
the westerly line of Lot 10, said Block 1 distant 74.16 feet south from said
northwest corner of Lot 9, the center of said curve is on the centerline of said
Westlake Street.
