Dear Ms. Block;
Regarding your questions about vehicular access to the rear of your property from Hillside Place,
this access is not allowed per the terms of a resolution filed against the property when a previous
o�vner sold two lots on Hillside Place that are located north of your property. As part of this
agreement your property is also supposed to have a fence along Hillside Place to prevent access
to the driveway. This required fence needs to be reinstalled on your property to remain in
compliance with the City of Orono requirements. The only two properties that can have vehicular
access to Hillside Place are the two lots north of your property. I have enclosed a copy of the
agreement regarding the access restrictions that apply to your property.

A. Segner is the owner of real property located at 3286 Navarre Lane (the "3286
Parcel") znd 2260 Ba}rview Place (che °226�? Pucel") and 3300 Navarre Lane (the "33(}0
��� Parcel"), all in the City of Orono, hiuinesota and ie�a�ly described on Exhibit "A" attached
� � hereto and made a part hereof (collectively, the "Segner Property"); ��

� � Parcel"), in the City of Orono, Minnesota aad legally described on E�ibit "B" attached

� ri�ht-of-way width of 2� feet;

M D. The City has maintained municipal sanitary sewer lines and manholes with.in
N Hillside Piace since 1965> and has maintained che capabiLity for vehicular travel on Hillside
� Place only to the extent necessary to maintain the sewer system;

�. E. City �iunicipal Code ("Code°;, Secdcns 6.a5, Subdivision 9 and 6.�5,
� Subdivision 4 provide standards for placement, desi��, and cansLLucnon of resident:al
driveways accessina onto gublic and privat� roads. Those sections sta�e as follows: "A. One
driveway approach shall be allowed from up ta two singie residential parcels of land to the
sz.me public (or private) road provided that approprisr� easemencs exist b�tween parcies
sharin� the driveway and driveway approach. Parceis having frontage on mQre than one
publie (private) road sball be allowed a drivzway approach to one public (or private) road";
F. The 2260 Parcel and the 33Q0 Parcel have previously utilized a private drive
within Hillside Place. -• There is no cnnent u�: of Hillside PIace by rhe ow�ner of the 2260
Parcel and the 3300 P'arcel;
G. Segn�r and Marinos have reg �� ted t�e City to apprave a private drive within
Hillside P�ace to allow access to the 3286 Parcel and the 3290 Parcel, and the City has
approved such request provided Segner and Marinos ent.�r into this Agreetnent; �

N�ti�, �REFORE, in consideration of che C.ity allowinQ the private drive servicin�
the 3286 Pazcel �nd tne 3290 Parcel to be located in Hillside Place and the mutual benefits to
be derived ther�from, Se�ner and l�lar�nos agree as follows:
AGREENiENTS:
1. 'I`he foreooing recitals zre incarporat�d as part of this Agreement,
Z• All use of Hil.lside Pl�ce for access purposes to and from the 2;.60 parcel and
the 3300 P2sce1 shall be discontLzued immediately upon execution of this Agreemen�
3• Segner shall immediately construct, at her sole expens�, a permanent fence
along the entire easterly boundary of the 2260 Parcel a.nd the 3300 Parcel abutting Hillside
P1aCe. Said fence sE�all at a minimum be 36" in height with two 2°X4" raiis at approximaLely
�$" and 3b" above grade, with 4"X4" posts spzced 8' apart No gat� fer �ehicul� aece;; to
Hillside Place shall he instal.led as pas-t of such fence.
4. Se�ner shali immediately and exclusively utilizz the e�cistin� drxveway from the
2260 1'a�cel to Bayview Place for access to and from the 2260 Parcel.
S. Segner shall immzdiat�ly cons�ct at her sol� expense, a new driveway acc�ss
to Nav�r:e Lane to s�rvice the 3304 Parcel, and shall thereaic�r exclusively utilize such new
driveway access to and from Na��arre Lane to the 3300 Parcel. �
6. Segn�r and Marinos agree that only the owners of the 3256 Parcel and the
329Q Parcel, and their respective invitees, shs1l be allowed to utilize that porcion of HaIlside
Place legally described on E�hibit °C" attached hereto and made a gart hereof (the "Private
� Drive ) for private driveway purposes as allowed by the City's Code Secrion 6.06,
C� i Subdivision 9, except that incidental use of said right-of-way by pablic and/or pr.ivate
�� eme:�ency vehicles, schoal buses and th� public for access to adjoining properties or other
incident?1 traveI shall be permitted.
7. Marinos and Segner hereby agree:
(a) The Private Drive shall be constructed Znd maintained at Segner arid
Marinos sole expense in accordance wi�h all applicable City Code
requirements; and
(b) Immediately Lpon notice to �iarinos and Segner that the City desires to
ogen Hillside Place for public travel, Marinas and Seoner shall, at their sole
expense, immediat�ly remove the Privac� Drive and restore Hillside Place to
grade.

�• Se�ner and :viarinos hereby i.ndernnify and hold the Ciry harmless from any
and aIl cla.ims, causes of action, liabiliuzs, �mages or other losses (ircIudin� attorneys' fees
and costs incurred by City in connection therzwith or in enforcement of this A�reement)
susCained or incu.-red by reason of use of the Private Drive by Seo-ner and Marinos, and their
respeetive invitees, successors or assi�-ns.
9. City shall honor any request of the awners of the 3286 Parcel and the 3290
Parcel to post Hillside PIace with "No Parking" sijns and subject Hiliside P1ace to
�nfarcement of same by the City's Police Deparnnent
10. This A�reement shall run with the lznd, shall be bindin� upon Segner and
T�larinos, their respective successors a,rtd assigns, and may be enforced by the City at law or at
equity.
11. Any future use of Hillside Place by an owner of the 226Q Parcel or ihe 3300
Paxcel shall constitute a violation of this Agreement and of Municipal Code Section 6.05,
Subdi��ision 2, and snall constitute a misdemea.nor. This paragraph daes not apply to Segner,
er successors or assigns, as the owner of th� 3286 Parcei.
12. �'his Agreement may be amended or terr.�inated only by Q recordable, wrirten
a�reement betweea the parties hereto, iheir successors and assio s, which shall be filed in the
office of the Hennepin County Registrar of Title against the Segaer Property and Marinos
Properiy. Circumstances a.risin� which mzy requir2 amendment or [ermination of this �
A;reement, include but are not limited to, the City's apprc�val of an alternate access for
either the 32$b Parcel or the 3290 Parcel to an opened public roadway other than Hillside
Piace or changes in City Code provisions. Notwithst�ndinb anything contained in tteis
paraaraph, the amenament or termination of this Agreement and any requirement�
cont�mplated by any such amendment or terrflination, must be approved by the City and meet
aIl applicable City Code grovisions.
