As we discussed,the property is located in LR-1C Zoning District which is a single family residential zone. Therefore it can not be rented out as a duplex. The City had been informed by neighbors that the previous owner was possibly renting the lower level of the home to a family member. The property was for sale at the time, so the City took no action, anticipating that this duplex use would cease shortly. We also spoke about family members sharing a home, the City code allows this if there is one kitchen facility and no separation between levels. A second issue regarding this property is the use of Hillside Place for access. When the previous owner sold 2 lots at the north end of Hillside Place, she was required to cease use of the road for 2260 Bayview Place and 3300 Navarre Lane. She was also required to build a permanent fence along the road (see attached agreement filed on the chain of title). Therefore, the City must require you as the current property owner to utilize the property as a single family dwelling and to replace the fence across the rear property line. A deadline of July 13, 1998 has been established for replacement. If you have any questions please feel free to contact me at my office. It has come to the City's attention that you are renting the building as a duplex in violation of City Ordinances. The City also informed you of a fence that is required to be reinstalled. As of this date the fence has not been reinstalled. If the home is being shared by a group of people with one kitchen then an inspection is required to verify there is only one kitchen. Therefore, the City must require you to replace the fence and to schedule an inspection of the building to verify compliance no later than July 27, 1993. LR-1C ONE FANIILY LAKESHORE RESIDENTIAL DISTRICT. Subd. 1. Purpose. The "LR-1C" One Family Lakeshore Residential District is intended to provide a district which will allow a combination of inedium density residential development and limited a�icultural activity. Planned residential developments may be allowed by conditional use permits. The proposed land use may not endanger the quality of storm water runoff into Lake Minnetonka. Because of the location of the district near Lake Minnetonka, special regulations aze necessary to protect that natural resource from the effects of intense development. The district shall have immediate access to highways and public sanitary sewer. -- - Subd. 2. Lakeshore Set Back, Hard Cover and Tree Removal Regulations. (See Section 10.22). - Subd. 3. Permitted Uses. Within the "LR-1C" One Family Lakeshore Residential District, no land or structure shall be used except for one or more of the following uses: A. Any permitted use as regulated in the "R-lA" District. B. Personal Wireless Service Antennas and Towers. 1. Purpose and Intent. The purpose of this section is to establish predictable,balanced regulations for the siting and screening of�vireless communications equipment in order to accommodate the growth of wireless communication systems within the City of Orono while protecting the public against any adverse impacts on the City's aesthetic resources and the public welfare. 2. Personal Wireless Service Antennas. Personal wireless service antennas erected on a municipal structure may be allowed as a secondary use by administrative permit, provided they comply with the City policy regarding the use of City-owned property for wireless telecommunication antennas and provided they meet the following conditions: a The antenna shall be in compliance with the Nlinnesota State Buildina Code and all other applicable federal and state regulations and pernuts. b. Structural design,mounting and installation of the antenna shall be in compliance with manufacturer's specifications and shall be verified and approved by a registere�professional e:z?ineer. c. No advertisin;message shall be affixed to the antenna. d. Antennas shall not be artificially illuminated unless required by law or by the Federal Aviation Administration(FAA)to protect the public's health and safety. ORONO CC 286 (4-1-84) § 10.25 e. When applicable,proposals to erect new antenna shall be accompanied by any required federal, state, or local agency licenses. f. Transmitting, receiving, and switchin� equipment shall be housed within the existing structure. If a new equipment building is necessary for transmitting, receiving and switching equipment, it shall be situated in the rear yard of the principal use and shall be screened from view by landscaping. g. All obsolete and unused antennas shall be removed within = twelve (12)months of cessation of operation at the..site, unless an exemption is granted by the City Administrator or desi�ate. The removal shall be the responsibility of the communication provider. h. Antennas shall utilize camouflaging techniques or shall be side mounted to an antenna support structure in order that such facilities aze compatible wzth the chazacter and environment of the area in which they are located. i. The applicant shall demonstrate by providing a coverage/ interference analysis and capacity analysis prepared by a registered professional engineer that the location of the antenna as proposed is necessary to meet the frequency spacing needs of the personal wireless service system and to provide adequate portable personal wireless service coveraae and capacity to the area. Within any"LR-1 C" One Family Lakeshore Residential District,no structure or land shall be used for the following uses except by conditional use permit: A. Any conditional use as regulated in the "R-lA" District except that a Planned Residential Development shall not be limited to detached single family dwellings only. Subd. 5. Accessory Uses. Within any "LR-1C" One Family Lakeshore Residential District, the followi.nj uses shall be permitted' accessory uses: A. Any accessory use as regulated in the "R-1 A" District any'private docks' subject to the City Code and other applicable regulations,including boat storage density regulations. Subd. 6. Area, Height, Lot`Vidth and Yard Requirements. A. Height.No structure or building shall exceed 2-1/2 stories or thirty feet in height except as provided in Section 10.7�.
