BAYVIEW FARMS SECOND ADDITION ; - FII,E NO. �967 WHEREAS, the City of Orono is a municipal corporation organized and existing ; under the laws of the State of Mirmesota; and � WHEREAS, the City Council of the City of Orono has adopted subdivision r.egulations for the orderly, econonnic and safe de�elopment of land within the Czty; and WHER.E�, the City Council has considered the application for a subdivision by I�obert S. Olson of 4645 Bayside Raad, Irvin T. Geffre of 4665 Bayside Road, and K-P Properties, Inc. represented by Donald R. Peterson (hereinafter "the subdividers"); and W�3[F..REAS, on October 24, 1994, the City Co�incil ap�raved Resolution No. . � 3483 grant.ing preliminary approval for a plat at 4645/4665 Bayside Road; and WHEREAS, the property is located within the RR-1B, Single F�mily Rui•al Residential Zorung District requiring a minimum of 2 acres of contiguous dry buiidabte land within each newly creaked lot; and WHEI2EAS, the property contains a total of approximately 19.5 acres, of wl�ich approximat�ly 1.1 acres has been deiineated as wetland; and WHEREA�, the proposed plat contains two lots (deszgnated as proposed Lot Z, Block 1 and proposed Lot 1, Block 2), each contaiiling an existing residence structure, proposed. I.ot 1, Block 1 being 2.75 acres in area, and proposed Lat 1, Block 2 being 1.94 acres in area. Proposed I.ot 1-, Block 2 technically requires a lot area variance, but will retain ownerslii� of an additional 0.07 acre outlot and may gain up to an additional 0.28 acres as noted below, in order to meet the 2.0 acre minim.um Iot area requirement; and WHEREAS, the septic system ser��ing the residence on proposed Lot 1, Block I is failing and is intended to be replaced. On-sit� sewage treatment system site evaluation data in�jicates that primary and aIternate drain,field sites for current and future use are available within proposed Lot 1, Block 1. In the event that Outlot C is further developed using road access frozn adjacent properties not requiring the use of Outlots B and D, Outlots A and B will be iegally com.bined with proposed Lot 1, Block 1. (c j Outlot C: 14.13 acre parcel uitended for friture development into single , family residential lots, �utiot C is intended to not be buildable for even a single reszdence unless or until it is further subdivided and/or replarted , ix�to one or rilore building sites. (d) Outlot D: O,Q7 acre future road corridor segrr�ent to cc�mplete continuous access in conjunction with Outlot B for future development of Outlot C. In the event that Outlot C is further develoged using road accesses from adjacent properties not requiring the use of Outlots B and D, Outlot D will be iegally combiued with the proposed Lot 1, Block 2. WHEREAS, Outlots B and D provide continuous access to Outlot C from Bayside Road. The platting of Outlot D coincides with an exasting access easement aver Lot 1, Block 1, F3ayview Farms in favor of Lot 2, Block 1, Bayview Farrns. The inclusion of Lot 1, Block I, Bayview Farn�s in this proposed plat is the subject of an agreement attached to this resolution as Elchibit A, which details the applicants' intent regarding the future use and disposition uf �utlots A, B and D; and W�REAS, it is the City's i.ntent that i€ Outlats B and D are developed for future road to serve Outlot C, then the existing residences on proposed Lot 1, Block 1 and proposed Lot 1, Block 2 shall construct driveway accesses onto said new road and eliminate the existing direct driveway accesses to Bayside Road; and Fage 2 of 6 - Fvm6005 DhYOrero �" ��' CITY of URO O O NO .- �. . �, � ,a RESOLUTION OF THE CITY COUNCIL '.�, , �' �ti NO. �� .� � ,�' , s, G ��'�s�to�'� WI�REA�, it is the City's intent that in the event Outlots B and D are used in i the �uture for road purposes that such road shall be constructed to City standards. Further, it ; is the City's intent that in order to guarantee the future access Co Outlot C, apglicants shall provide to the City standard road and utility easements over Outlots B and D. It is tt�e City's ; fnrther intent that if�uttot� is developed without the need for access via �utl.ots B and D, that such road and utility easemet�ts will be vacated upon formal request af the property owners; and WHEREAS, it is the City's intent that Outlots A, B and C shall remain in private common ownership until �utlot C is further developed, and that Outl�t D shall remain in private � common ownership with proposed I.ot l, Block 2 until Outlot C is fuxther developed; and W�3CEREA5, it is the Cin�'s intent that at the tune Outlot C is further developed, the C'rty will at that�t'vme require the payment of�ark dedication fees and the dedication of any 'additional�necessary and appropriate public easeiz�ents within Outlots A, B, C and D; and , WHER.F.,AS, it is the City's intent that proposed Lot l, Block 1 and prc�posed Lot � l, Block 2 grant the standard gerimeter utility and drainage easements based on the assumption that Outlots B and D will in the future become a roadway; and WI�EREAS, alttzough Hennepin County Degartment .af Public Wor.ks has requested additional right-of-way for County Road 84, no additional County road right-of-way will be required of tlie developer consistent with the standards for a collector road as defined in the Orono Comprehensive Plan; and V�,r'I�REAS, a driveway easement over Outlot B shall be granted in favor of proposed Lot l, Block 1 for the existing driveway in Out�ot B; and WHEREAS, the existing accessory znetal shed located at the northwest corner of OutIot C will become non-conforming upon final plat approval due to lack of a principal residence structure and must be removed within one year of �nal plat approval unless it is uicorporated into a subdivision of Outlot C into buildable lots and made conforming at that tune; and '4yHEREAS, flie single family reszdences existzng on proposed Lot 1, Block 1 and proposed Lot 1, Block 2 require no further variances; and Page 3 of 6 � fom 5006 OW OroN .� o,�,. Co�gletion of the requirements of Resolution No. 3483. 2. Dedication on Ehe plat of drainage and utility easements. j 3. Granting of road and uti�ity easements over Outlots B and D. ; 4. Granting of a driveway easement over Outlot B in favor of proposed T.ot 1, Block 1. 5. Payment to the Ciry of legal review and �Iing fees of $200.00. N(3W, '1'�IEREF�RE, BE IT RE50LVED, that the City Council of the City of Orono hereby appraves the plat of Bayview Fazms Second Addition, Hennepin County, Minnes�ta, subject to the following conditions: 1. Outlots A, B and C shall remain iu� common ownership until Outlot C is further developed. Outlot D shall remain in own.ership with praposed Lot 1, B1ock 2 until Outlot C is further developed. 2. Outlot A i.s considered an unhuildable remainder parcel and upon development of Outlot C, Outlot A sha11 be either combined with Outlot B and proposed Lot 1, Block 1 if Outlots B and D are i�ot used for road purposes, or Outlot A shall be Iegalty cornbined with proposed Lot 1, Biock 2, in the event that Outlots B and D are used for roadway purposes. 3. Outlots B and D are platted for future roadway purposes and shall remain as separate unbuildable tax parcels in private ownership until such time that (3utlot C is further developed. In tkke event that Outlot C is further developed without a need for use of Outlots B and D as roadway access, then Outlots B and D znust be legalIy combined with adjacent properties. 4. Tn the event that Outlots B and D are used as an access road serving a future development in Outlot C, the residences on proposed Lot 1, Block 1 and proposed i Lot 1, Block 2 shall revise their driveway locatzons onto said Outlot roadway and � eliminate direct access to Bayside Road. 6. No additional right-of-way for County Road 84 will be granted although Hennepin County has requested it. 7. Payment of park dedication fees and the dedication of additional public easements within Outlots A, B, C and D will not be requued until Ontlot C is fiirther d�veloped. 8. The residenee on proposed J�at 1, Block l shall be provided with a ne��v septic system within the time frame and requirements of the City code. � 9. ' T'he metal shed ]ocated at the northwest corner of Qutlot C shall be removed � within one year of fi.nal plat appraval u.nless a camplete'formal application for ; subdivision of Outlot C l�as been subinitted by that date. � 10. The aforesaid plat shall be filed by the City of Orono with the Henuepin County Recorder's Office on or before May 14, 1995 together with a certified original copy of this resolutian and executed copies of the easement documents noted above. The approval granted by this resolution shall expire if the plat has not been filed by the date specified above. In that event, it witl be necessary to �le a new application with the City of Orono for suUdivision review.
