RE: COMPLIANCE INSPECTION / NON-COMPLIANT SEPTIC SYSTEM NOTIFICATION – 1st NOTICE
Dear Ms. Pearce:
The City of Orono administers a Subsurface Sewage Treatment System (SSTS) program which regulates the SSTS
(commonly referred to as septic systems) within the City. On May 4, 2022, the City received a “Notice of Non-
Compliance” from Sewer Services, Inc., for the septic system located on your property: 591 North Stream Road,
based on insufficient soil separation from groundwater. The report indicated the septic system was inspected on
April 28, 2022; a copy of the report is enclosed for your reference.
According to Orono City Code, due to the septic system’s status as non-compliant, the system must be repaired or
replaced within three (3) years [Cite: Sec. 58-66. Inspection reports]. You should contact a septic designer or
installer to help you with this process; a City Septic System permit will be required.
Sec. 58-66. Inspection Reports.
(2) A notice of noncompliance shall be issued in the following circumstances and the conditions noted in violation
of this article shall be remedied as follows:
a. An SSTS determined to be failing to protect groundwater shall be upgraded, replaced, or repaired in
accord with Minnesota Rules Chapter 7080 or 7081, within three years, or its use is discontinued. The
health authority, at its discretion, may grant an extension of an additional two years.
b. An SSTS posing an Imminent Threat to Public Health and Safety shall be upgraded, replaced or repaired
within ten months. The health authority will give consideration to weather conditions in determining
compliance dates. If an SSTS is determined to be a public health nuisance by the health authority, the
health authority may order the owner of the SSTS to cease use immediately and not allow use of the SSTS
until it is corrected in accordance with the recommendations of the health authority.
