A RESOLUTION APPR VING THE
PLAT OF JOHNSON WHEEL R 1ST ADDITION
FILE NO. 16 3
WHEREAS, the City of Orono is a mu 'cipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of the Ciry of Orono has adopted subdivision
regulations for the orderly, economic and safe devel pment of land within the Ciry; and
WHEREAS, the City Council has co idered this application for a subdivision
of a plat by Mark Johnson, the subdivider (hereinaft "the subdivider"); and
WHEREAS, on September 9, 1991, e City Council approved Resolution No.
3014 granting preliminary approval for the plat of th property located at 4465 Bayside Road;
and
WHEREAS, on October 11, 1993, e City Council adopted Resolution No.
��4 5 granting an extension of the effective period of preliminary subdivision approval to
October 11, 1993; and
WHEREAS, the proposed subdivision as been found to meet all standards of the
RR-1B Rural Residential Zoning District finding that ch lot is of a size and configuration that
will allow the continued use of the developed Iot r single family residence use and the
undeveloped lot to be fully developed without the nee of any variances; and
WHEREAS, the subdivider has com leted all requirements of the platting
regulations of the City, including:
1. Completion of all the requirements of esolution No. 3014.
2. Dedication on the plat of right-of-way f r a public road shown at Bayside Road.
3. Dedication on the plat of drainage and tility easements.

4. Creation of Outlot A that is not conti ous with Lots 1 and 2 and is divided from
the remainder of the property by a C nry road. Said lot shall be designated as
an unbuildable lot and available f r combination with adjacent residential
properties on north side of County R ad 84 or Bayside Road.
5. Payment to the City of a Park Dedica ion Fee in the amount of $2,544.00.
6. Payment to the City for the legal view and filing of the plat, and other
documents in the amount of $150.00.
� 7. Payment to the City for the final plat pplication fee at $150.00.
NOW, THEREFORE BE IT RESOLVED, at the City Council of the City of Orono
hereby approves the plat of Johnson Wheeler lst Addi 'on, Hennepin County, Minnesota, subject
to the following conditions:
1. Access to Lot 1 shall remain via an xisting driveway that serves the existing
residence.
2. Access to Lot 2 shall be achieved via existing private drive along the east side
of the property owned by the applican . Upon the sale of Lot 2, applicant shall
grant an access easement in favor of t 2. Such access must be located at the
extreme southeast corner and to exte d no further north than 25' in order to
maintain a 20' separation setback fro the principal drainf'ield site.
3. The 30.4' x 18.4' barn on Lot 2 sha 1 be removed by Qctober 11, 1994 if a
building permit has not been issued fo residential construction by that date.
4. The aforesaid plat shall be filed by th City of Orono with either the Hennepin
County Recorder's Office or Registra of Titles Office on or before April 11,
1994 together with a certified original c py of this resolution and executed copies
of either easements or covenants noted above.

The approval granted by this resolution shall e pire if the plat cannot be filed by the date
specified above. In that event it will be necessary t file a new application with the City of
Orono for subdivision review. Dated this llth day o October, 1993.
