A METES AND BOUNDS CLA S I SUBDIVISION
OF PROPERTY LOCATED AT 4 55 BAYSIDE ROAD .

under the laws of the State of Minnesota; and
WHEREAS,the City Council of the C of Orono (hereinafter"City Council") has
adopted subdivision regulations for the orderly, econo ic and safe development of land within the
City; and
WHEREAS,the City Council has cons dered the application for a 2-lot Class I metes
and bounds subdivision by Steve VVhite and VCI Ca ital, Inc. (hereinafter "the subdividers") of
property located at 4355 Bayside Road and legally des 'bed in the survey attached hereto as Exhibit
A (hereinafter "the property"); and
WHEREAS,the subdividers have co leted all requirements of the City for a 2-lot
metes and bounds Class I subdivision of the property.
NOW, THEREFORE, BE IT RES LVED, that the City Council of the City of
Orono hereby approves the 2-lot metes and bounds Cl s I subdivision for the subdividers as shown
on the Certificate of Survey by Mark S. Gronberg, a li nsed surveyor of Coffin and Gronberg,Inc.,
dated August 19, 1997,revised October 6, 1997 and a ached to this resolution as Exhibit A, subject
to the foll�wina condi.tions:
1. The subdividers shall grant Conservat on and Flowage Easements to the City over
the wetlands shown on the attached rvey. The subdividers shall provide legal
descriptions for said easements.
2. The subdividers shall grant to Henn in County a 66' road, drainage and utility
easement over the portions of County ad 84(Bayside Road)shown on the attached
survey. The subdividers shall provide a legal description for said easements.
3. As a Class I subdivision, this subdivis on is not subject to Park Dedication.

4. The subdivider is advised that the porti ns of Parcels A and B north of Bayside Road
aze not sepazately buildable,and any fu e proposal to construct accessory structures
on those portions will be subject to her City review and approval. �
5. Applicant shall provide confirmation f legal ownership of the property via title
opinion or other form satisfactory to th City Attorney before tne su�division will be
released for filing.
6. The aforesaid division shown on the att ched Certificate of Survey and the aforesaid
easements shall be filed by the City f Orono with either the Hennepin County
Recorder's Office or Registrar of Titles Office on or before March 28, 1999 together
with a certified original copy of thi resolution. The approval granted by this
resolution shall expire if the division h s not been filed by the date specified above.
In that eyent, it will be necessary to file a new application with the City of Orono for
subdivision review.
Adopted by the City Council of Orono,Minnesota this 28th day of September, 1998.
