(Address) THIS AGREEMENT, Made and e tered into this �� day of b QCc�,�n 3� , ���'7 ,by and betwee the City of Orono, a municipal corporation organized under the laws of the State of Mi esota (hereinafter called "City"), and LLf�lv � f�/�2.L �-STD'LcJ�-1�£Z.Ad3 , their heirs, successors and assigns, (hereinafter called "Property O er"). WITNESSETH: WHEREAS, the Property Owner is the owner of certain property and has made application to the City of Orono for a building permit to co struct improvements on such real property legally described as, 4185 Bayside Road WHEREAS,the septic system serving the roperty has been determined by the City to be non-compliant; and WHEREAS,the Property Owner desires to btain a building permit for improvements to the Property, which include bedrooms or water using appli ces, but due to weather constraints cannot complete the required septic system upgrade until the 2 08 construction year; and NOW,THEREFORE, in consideration of e premises and of the mutual promises and conditions hereinafter contained, it is hereby agreed as llows: 1. Propertv Im�rovements: In accordance with the poli ies and ordinances of the City,the following described private improvements are proposed to be c nstructed by the Property Owner or his/her contractor, who has applied to the City for a uilding permit for said private property improvements (the "Property Improvements"). � Page 1 of i , • 2. Issuance of Buildin Permit for Pro e Im roveme ts: The City agrees to issue a building permit for the Property Improvements at this time, subject t conformance with all current City standards and ordinances for all applicable work. 3. Septic System U� ra�de�. In accordance with the o dinances and requirements of the City, the Property Owner hereby agrees to complete the requi ed replacement of the septic system no later than August 31, 2008 (the "Completion Date"). 4. Septic Svstem U�grade Installation: The design locat on,construction, installation and materials for septic system upgrade shall be in accordance with e plans and specifications approved by the City. 5. Performance Deposit: For the purposes of assuring o the City that the Septic Improvements will be completed according to the terms of this agree ent, the Property Owner has deposited with the City at the time of the execution of this agree ent a certified check satisfactory to the City providing that the City is able to cash the check i its sole discretion to complete the Septic Improvements if the Property Owner fails to sat sfactorily complete the work prior to the Completion Date. City shall return the check to Pr perty Owner upon final inspection approval of the Septic Improvements. 6. Binding Effect: The terms and provisions hereof sh 11 be binding upon and inure to the benefit of the heirs,representatives, successors and assigns of t e parties hereto and shall be binding deemed covenants running with the land. References herein o Property Owner, if there be more than one, shall mean each and all of them. This agreement s all be executed by the Property Owner and City and shall be placed of record so as to give otice hereof to subsequent purchasers and encumbrancers of all or any part of the property, a d all recording fees, if any, shall be paid by the Property Owner. 7. Notices: Whenever in this agreement, it shall be re uired or permitted that notice or demand be given or served by either party to this agreement to r on the other party, such notice or demand shall be delivered personally or mailed by United S ates certified mail (return receipt requested) to the addresses set forth below. Such notice or emand shall be deemed timely given when delivered personally or when deposited in the m il in accordance with the above. Page 2 of 8. Disclaimer by C1t� It is understood and agreed that the City, the City Council, and the agents and employees of the City shall not be personally 1 able or responsible in any manner to the Property Owner or the Property Owner's contractors subcontractors, materialmen, laborers, or any other person, firm or corporation, for any debt, c aim, demand, damages, actions, or causes of action of any kind or character, arising out of or b reason of the execution of this agreement or the performance and completion of the Septic I provements. 9. Hold Harmless and Indemnification: The Property O er shall indemnify and hold harmless the City, the City Council, and the agents and employe s of the City from and against all claims, damages, losses ar expenses, including attorney fees, hich the City, City Council and agents and employees of the City may suffer or for which it may b held liable, arising out of or resulting from the assertion against them of any claims, debts or obl' ations in consequence of the performance of this agreement by the Property Owner, its employe s, agents or subcontractors,whether or not caused in part by a party indemnified hereunder. 10. Remedy for Default: Default by the Property Owner of any of the terms of this agreement shall automatically result in the suspension or withholding o all permits, licenses,occupancy certificates or other authorizations issued by the City in connectio with the Property, and may, at City's sole discretion, give rise to a draw upon the check by ity to remedy such default. A. The Property Owner hereby grants to the Cit , its agents and its employees, the right to enter on the Property for the specific purpos of constructing or completing the Septic Improvements should the Property Owner not omplete those Septic Improvements by the Completion Date. B. The remedies afforded to the City under thi Section shall be in addition to any other remedies which the City may be entitled b law or equity or other agreement. The system co sists of 2 septic tanks & 2 trench systems (one old system) with the top of the roc 30" below grade & effluent 12" above the rock & the bottom of the rock at 48" below gr de. An additional system was added � finding the top of rock 6" to 12" below grade & th bottom of the rock at 24" to 30" below grade. Soil borings #1A & 2A found mottl d soil (redox features) at 26" & 28" below grade. This system does not meet the re uired separation from the bottom of the rock & redox features & is classified as non- ompliant, failing to protect the ground water. This on-site sewage treatment system is design d for a Type 1, three bedroom home, in accordance with the Minnesota Pollution Con ol Agency Chapter 7080 and local ordinances. O ONO COPY' The soils on this site are a clay loam. The mottl d soils were located at 16" to 20" (redox features). Due to the redox features, a P essurized Mound System will need to be installed to treat septic effluent. The bottom f the rock must be located at least 3' above the redox features. All property lines must be located prior to install tion. The existing tanks may be used if water tight & ave a minimum capacity of 1000 gallons each. If not the tanks will need to be ab ndoned, pumped & filled in with dirt. The soils at a depth of 12" have a percolation r te of12.0 mpi. ����� '��� � ORONO COPY ,._,..�aRoo�s, �r��uctt���tt� �F�����o�� A pumping chamber will need to be installed to li the effluent to the treatment area. The power supply and switches must be located utside the manhole and pumping chamber in a weather proof enclosure. A warnin device must be installed with a light and sound device, this is in case of a pump failur . The manifold and supply line pipe must have ba drainage to #he pumping chamber, The distribution pipes shall have their ends capp d. Be sure the rock and sand fill material are clean. The sod layer below the enti mounded area must be turned over, just break up the sod, be sure not to over work. The supply line will need to be insulated through he driveway. All neighboring wells are located greater than 10 ' away from the proposed treatment area. Keep all heavy equipment off of the proposed tre tment area before and after construction. The treatment area should be mar ed off before construction. This Design is not valid &the system will need to be r located if failure to protect the areas proposed for On-Site Sewage Treatment occurs. With proper installation and maintenance, this sy tem should have no problem in treating septic effluent effectively. Nothing other than human waste, toilet tissue, la ndry, showers, water softener etc. should be disposed of into the septic tanks. Rec mmend Iron filters be diverted out of the system. Recommend to divert the water soft er also if the iron filter is diverted. Garbage disposals are not recommended, due to adding more solids &fine solids passing through to the system. Excessive amou ts of soaps, antibacterial soaps, cleaning agents, shower cleaners used every sh wer & chlorine agents may kill the bacteria needed to treat septic effluent. Additive are not recommended. Recommend to pump � clean your tanks through the manhole y a certified pumper every 2 years. Check with your pumper to set up a schedule.
