The last I had heard from James was May 21 when he had finally gotten a response from the State Fire Marshal's Office,and indicated there were a number of items to be resolved. The next thing I hear is that you are now pursuing a stationary tank which is exactly the opposite of what I stated we could approve back in April. The fact that other marinas in other cities around the lake may have a stationary tank next to the shore does not mean we will approve one here. If Wayzata Marine in Orono has had such a tank it has not been approved by the City except in the past on a very temporary basis (beginning of season for a few days only, Lyle tells me). I think it is time for all involved to meet again to discuss parameters for moving forward. Lyle and I can be available this week Tuesday afternoon, Wednesday morning or afternoon, or Thursday afternoon. Let me know what works for you. I can find no record that we ever approved a fuel tank location or fuel system for Wayzata Marine.So if they have had a stationary Transcube sitting less than 75 feet from the lake all summer for the last x years,we (I)don't know about it. My issue with the stationary tank from the start is that from a zoning perspective it is a structure that isn't allowed within 75' of the lake, unless it has wheels, which makes it not a structure. If you are comfortable that the stationary cube is a good temporary solution (this year and/or seasonal on an annual permit basis),then we need to deal with a process for making it legal based on the zoning. I will leave it to James to determine whether or what type of barriers(concrete or otherwise)will be required to protect the system. Because this is a temporary system, you should consider pursuing the approvals to have your permanent pump located either on land as you initially proposed(requiring City variance approval)or on the dock(requiring LMCD approval). Anyways in regards to the items you submitted for this proposal there were a few items I noted that I think should be modified or better explained due to the scope of what they are doing. I've described each of these items below. 1.) The first item on page 2 of the permit restrictions document discusses the requirement that the tank truck have a fuel limit switch that limits a single fueling operation to 500 gallons before the switch needs to be reset. I presume that this requirement was derived from MSFC Section 3406.5.4.5 as it matches the language exactly. Given the nature of this operation I believe it would be reasonable to have the limit lowered from 500 gallons to an amount that would be more likely found with the type of boats that will be fueled.This will require more resets by the operators but will limit the amount of fuel spilled in the event some type of incident occurs near the point or transfer or elsewhere in the process. 2.) On page 5 of the spill containment plan,the total capacity of the tank vehicle is listed at 2100 gallons.On the next page, it lists the capacity for a complete failure or partial failure of the tank at 600 gallons. In looking over the photos it appears that the largest partitioned portion in the tank is 600 gallons but I disagree that this would represent the quantity lost in a complete or partial tank failure (it could be anywhere from 0 to 2100 gallons).This should be revised and may require them to ensure they have adequate capacity of spill containment equipment on hand. 1 3.) We recommend some type of impact protection be provided in the parking lot to shield the side and possible part of the rear of the tank vehicle. Given that this is a temporary operation it would probably be suitable to use concrete jersey style barriers spaced away from the truck in accordance with MSFC Section 312. It is DOT certified and completely operational and in great working order. This truck is currently on site, sitting next to the previous tank and trailer setup and will be moved into the same position as agreed for the trailer. Although it is DOT certified, we intend to keep it on site and have it filled by truck, the same as planed with the stationary mobile solution as discussed. We still hope to be open by Monday afternoon and based on the list of requirements, I think we need just the containment Boom and absorbent pads and no smoking signs, along with operation and spill training in order to be up and running. Jim, can we still meet on site, for this training as planned and will you still bring the required spill kit? I can meet you on site at 10:00 AM if necessary as I would like to get fuel delivered early afternoon. Please let me know if you would like to meet to finalize the permit. I agree with the issueing of a permit but I am not sure that it should come from the Fire Department. I feel it should come from the City of Orono and both you (or someone from the City of Orono) and I could sign it. I also agree that all the safegaurds be required in this section but also the other sections of the State Fire Code. The Long Lake Fire Department doesn't have a permit drawn up or in place for this but maybe the City could grant them a temporary use permit to do this while there other option for the below ground tank is being worked on by the City Staff and is going through the process. It would be nice to have a time frame of 60 or 90 days. How do you intend to fuel boats with this unit at this location—a long hose stored on a reel or rack, or? How will the emergency shutoff work? We need detailed information about the dispensing unit itself, and how you expect the fueling operation to function. c. I would note that Greg Nybeck has advised me that construction of a dock-located fuel dispensing system will require LMCD approvals. 3) There are a variety of Fire Code standards that need to be met regarding the tank; for instance, 36" of fill over it and a 6" concrete or 8" asphalt surface above it. There are no dimensions on the sketch of the tank installation provided to allow us to confirm the proposed depth of fill. There may be other fire code questions or concerns as we move forward. Based on the above, I believe we should meet next week to discuss the various concerns about this proposed fueling system, and that meeting should include as a minimum you and your petroleum contractor; myself, Building Official Lyle Oman, and Fire Chief James Van Eyll; and perhaps Greg Nybeck of LMCD.
