Re: 300 Tonka Avenue, ayside Addition to Lake Minnetonka
Dear Mr. Patrin:
An inspection conducted at the above subject property on April 27 ,
1982 , revealed certain code violations as follows:
1 - Fire Damage to the roof - July 3 , 1979, has never been
repaired - plastic has been layed over damaged area.
See Orono Municipal Code Section 82 . 050 (a) (enclosed) .
2 - Door left wide open to the public Minnesota State Statute
463. 251 (enclosed) .
3 - Building used for storage of motorcycles air conditioner,
tires, and other debris almost to the ceiling - Orono
Zoning Code 34 . 320 (enclosed) . Uniform Fire Code Section
27. 414 (enclosed) .
4 - No water or sanitation facilities in structure - outhouse
in back of lot - Orono Municipal Code 82. 030 (d) , State
Plumbing Code section MHD 120 (a) (f) (enclosed) .
5 - Building is in a state of deterioration and dilapitation,
thus it is a safety and health hazard. Minnesota State
Building Code/Uniform Building Code Section 203 (enclosed) .
This letter is being written to inform you that the following corrections
must be made by the date given.
1 - Removal of all stored materials within 15 days (June 28, 1982) .
2 - Buildings - Fire Damage Structure and Outhouse must be
removed within 30 days (July 14 , 1982) - State Statute
463 . 16 Hazardous Building - Demolition permit must be
issued from City.

A RESOLUTION ORDERING ABATEMENT OF HAZARDOUS
BUILDING ACTION AT 300 TONKA AVENUE AS LEGALLY
DESCRIBED HEREIN
WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the state of Minnesota; and
WHEREAS, James L. Patrin, 73 West George Street, Saint Paul,
Minnesota is the fee owner of record of property located at 300 Tonka
Avenue, Orono, hereinafter referred to as "the Patrin property" , legally
described as :
Lots 17 & 18, Block 5, Bayside Addition to Lake Minnetonka
WHEREAS, the City Council of the City of Orono, having duly
considered the matter pursuant to Minnesota Statutes Sections 463. 15
to 463. 261, hereby finds that the above described Patrin property is
unhabitable and contains unsanitary and hazardous conditions which
constitute a public nuisance and which makes this property hazardous
to the public health and safety as follows:
1) The Patrin property is located in the rural service
area of the City where there is no municipal sanitary
sewer or water available.
2) The Patrin property contains one unhabitable building
and a small shed/outhouse on approximately 12, 500
square feet of land, which is approximately 1/8 of
the minimum 2 acres required by City ordinances in
order to provide adequate area for on-site treatment
of sewage generated on each property.
3) No sanitation facilities in structure - outhouse in
back of lot.
4) There is no running water in structure and there is
no well located on the property.
5) The structure was damaged by fire on July 3, 1979.
Roof was destroyed by the fire and never repaired.
6) Structure is in state of deterioration and dilapitation.
7) Orders to remove structure were issued by the Building
Official on June 14, 1982 . This order has not been
complied with.
NOW, THEREFORE BE IT RESOLVED as follows :

1) That the City Council of the City of Orono,
pursuant to the foregoing findings and in
accordance with Minnesota Statutes Sections
463 . 15 to 463. 261 hereby orders the owner (s)
of the Patrin property to raze and remove
the structures, on the property. The Council
further orders that all personal property or
fixtures that may unreasonably interfere with
the razing be removed within 20 days of the service
of this order, the City of Orono may remove and
sell such personal property or fixtures at public
auction in accordance with law.
2) That the City Council of the City of Orono further '
orders that unless this corrective action is taken
or an answer is served upon the City of Orono and
filed in the Office of Clerk of District Court of
Hennepin County, Minnesota, within 20 days from the
date of the service of this order, a motion for
summary enforcement of this order will be made at
District Court of Hennepin County.
3) That the City Council of the City of Orono further
orders that if the City is compelled to take
corrective action herein all necessary costs expanded
by the City will be assessed against the real estate
concerned and collected in accordance with Minnesota
Statute, Section 463. 22.
4) That the City Council of Orono hereby authorizes
and directs the Mayor, City Clerk, City Administrator,
City Attorney, and other officers and employees of
the City to take such action, prepare, sign, and
serve such papers as are necessary to comply with
this order and to assess the cost thereof against the
real estate described above for collection along with
taxes .
