Prior to the adoption of the fee schedule on December 13, a public hearing will be held. Proposed Changes by section for the 2022 Fee Schedule are: Planning and Zoning • Application Fees - An increase of the base application fee from $275 to $325. This change is based on an updated analysis of time and expenditures related to processing an application. • Easement Creation – Add fee and remove reference to “Class I Subdivision” • Building Permits – Changes recommended by MnSpect. • Erosion Control Escrow – “Not to Exceed” was added to the amount. • Demolition: Accessory Structure – Septic System and a $1,000 escrow were added to this fee. • Annual Septic Fee – Changed from annual to quarterly to reflect change in billing frequency. • Septic Late Fee – Changed from a flat amount to 3%/Quarter • Miscellaneous Projects – this section was added to better organize the schedule. • Fences – This is a new fee. • Contracted Inspection Service – Removed from the schedule. • Park Dedication – Staff has prepared a separate analysis of this section for the Council to give direction on. Utility Rates and Fees • Point of Sale – “City Inspection” was added to better clarify City vs Private Inspection. • Sewer Projects – Connection fees were updated by the interest rate of outstanding assessments. Projects that the assessments have been paid off have been removed and will be subject the base connection fee. • Penalty – Changed from 8% annually to 1% monthly. • Utility Rates – A separate rate study document will be provided. Based on the 2021 fee schedule the rate increases would be Water – 3%, Sewer 3%, Storm 1%, and Recycling 4%. Park Fees • Golf Course Fees – Price for an Individual decreased from $19.00 to $18.00. • Language allowing the Superintendent to set pricing for special events. • Motorized Carts changed from per round to per rider/per round. • Lurton Park – The cost for a replacement pass has been added. Police Administration • A fee for Body Worn Camera videos has been added - $50.00. Documents • 2010-2030 Comprehensive Plan is removed • Municipal Code Book is removed • Electronic Labels – 8GB removed from size of flash drive • Surcharge for excess expenses – “Building” add to consultant types. Staff would like the Council’s input on the recommended fee changes. The Council may also want to consider additional fees changes that Staff has not recommended. A. Cash Contribution in Lieu of Lands. In those instances where a cash contribution is to be made by the subdivider, in lieu of a conveyance or dedication of land, the cash contribution to be contributed shall be that would otherwise have been conveyed or dedicated. The City shall account for such funds inequivalent to the fair market value of the equivalent undeveloped land a special fund named Park Dedication Funds. The City Council has established by resolution a minimum commercial/industrial park fee of $8,125 per acre and a maximum of $13,875 per acre. STORMWATER AND DRAINAGE TRUNK FEES Storm water trunk fees apply to new development and redevelopment of existing properties and provide funding for the storm water infrastructure necessary to serve the City. The trunk fee is based on the land use and acreage of the property being developed. An equivalency factor multiplier is assigned to each land use type, with a 2-acre residential lot considered as the standard in the City with an equivalency factor of 1.0. The table below lists the storm water trunk fees per acre for the various zoning districts and land uses in the City. The connection fee includes those portions of existing assets that will benefit new customers together with any anticipated future capital improvements constructed for the purpose of providing utility services to new customers. The connection charge applies to those properties not previously assessed for the associated utility project. Wayzata bills Orono based on a quarterly usage of 25,000 gallons. Charge is based on the metered rates and 25,000 gallons. Charges shall result from either an intensification of an existing non-residential use or a new non-residential use that replaces a former use on a property located within an area already assessed and served by municipal sewer and water. Each sewer and each water unit adjustment charge shall be equal to the current Service Availability Charge established by the Metropolitan Council Wastewater Services or its successor and shall be payable to the City of Orono upon application for a building permit. Credit for previously assessed sewer or water units shall be applied against the total number of sewer and water units established for the new use. With the addition of the BWC, there are requests for the videos captured on the BWC. The current fee schedule does not have a cost associated with requests for BWC video. Thought the methodology and fees were last reviewed in 2011, the fees have been static since 2001. Park dedication was identified as needing further study when the Subdivision code was reviewed in 2020. After review of the current park system, and anticipated growth based on the 2040 Comprehensive plan, staff proposes some changes to the park dedication methodology and formula. In essence, the revised methodology is based on the premise that “Development pays for itself.” Staff will go through the methodology at the workshop. In summary, the current residential share of our park system is 0.10 acre per residential house hold. The current Commercial/ Industrial share is 0.05 acres per C/I acre or 14 employees. Each new Household (lot) should provide 0.10 acres of park dedication to maintain that level. Cash in lieu of this land is that amount of land times the average predeveloped value of the property being developed. A cap of park dedication is proposed, based on the density of the project. The methodology recommended is based on no identified, specific needs for additional parks, and limited trail additions. If the Council would like to incorporate these goals into the methodology, a specific study should be completed to establish nexus of the additions (and increased fee) to the proposed development. These proposed changes will require an amendment to the subdivision code. Staff will initiate that for January review by the Planning Commission.
