Our lands legal description includes four parcels and the
property is owned and divided into two parcels on the tax roles .
We bouyht the property on May 9 , 1980.
We have waited for sanitary sewer for ten years . We now ask
the council to provide us the right, and grant two sewer units .
We have noted on the Parade of Homes that Sugar Woods , in Orono ,
was granted 1 acre lot building sights .
Our property needs are to be able to split the land into two
building lots . Tne land is so large that it would pass the city
regulations of set backs etc .
Taxes on this large parcel has held us from building . We know the
DNR will force tne sewer issue. Something will have to be done
to protect Lake Minnetonka . Is there anyway possible we could
have the results soon? We could then plan what we should do , for
not knowing t�e outcome puts us into a hardship .

potential. for a seconc3 building site on your Stubbs Bay property.
I would like to make tl�e folJ_owing comments in response to your
query:
1. I have ca7_cu3.ated and recalcuJ_ated the area of your
pro�erty, yieJ.dinc� 1.9 acres a�proximately. Your pro�erty
does not a�pear to contain 2.7 acres as you may have been
J.ead to believe. The southerly tax parcel. is apgroximatel.y
l.l acres, wi_tti the northerl.y tax �.�arce]. being approximately
0.8 acres in area.
2. The �ro�erty is 1.ocated in the LR-lA single family
residential. zoning district, requiring 2 acre minimum lot
size and 200 foot minimum wiclth. Under the current zoning,
the �ro��ety in total does not ap�ear to meet the 2 acre
minimum Xot size standard, and current�.y wouJ.d be considered
as a substandard size lot in this 2 acre zone.
3. When providing municipal sewer to 2 acre zones, the
City has historica]. ly not changed the zoning to a]. l.ow
densities greater than 1 residence �er 2 acres. Providing
existing neighborhoods with City sewer has not automatically
been accompanied by changes in zoning. Therefore, I have no
reason to believe that rezoning woul.d occur in the Stubbs
Bay area if municipal sewers were instal.l.ed.
4. In order for the City to grant you a second sewer unit,
the City wou].d require that you verify that you have two

5. If you were granted two sewer units, each of the
existing parceis woul.d require a I.ot area and width variance
to the 2 acre standards and the southerly parcel. woul.d need
a variance for Zack of frontage on a public road. Also, the
northerl.y parcel "as is" wouid I.ikely need setback variances
to reg�.ace the existing house in a reasonable I.ocation.
Your logical first step in deaZing ��ith this property would be to
initiate a l.ot line rearrangement subdivision. Your initial
request should be merely a "sketch pl.an review" with both
Planning Commission and City Council review to determine if they
wouZd conceptual.ly al.lcw a second building site. They woul.d give
you direction as to what conditicns would be imposed if such
approval was to be granted. The sketch plan step has a fee ot
S150. 00 which hel.gs to minimize your financial outl.ay prior to
knowing whether the subdivision request is feasibl.e.
If the Pl.annir_g Commission ar_d Council were to I.00ic favorably
upon a �ot line rearrar.gement and a secor.d sewer unit/building
site, you c�ould then have to Froceed with a formal subdivision
aF�Fl.ication inc?uding detaile� survey �.zerk.
Of course, any conceptual a�proval granted by the Planning
Commission and Councii wi�l I.ikel.y be conditioned on municipal.
sewer becoming availabl.e to your property. As of this writing,
the decision whether or not to sewer Stubbs Bay has not been
reached.
