my desire to develop the land with a single family home of approximately 4500 Sq ft

enclosed soil borings and land elevations to you and request a review meeting at your
earliest convenience. If there is any additional information or documentation that you

Dear Craig and Renee Wickland,
I am a Realtor with Coldwell Banker Burnet and represent Steve and Alyson Murray,
who are the new owners of the property at 3760 Bayside Road. Part of the Due Diligence
process involves analysis of property lines in order to establish setbacks and property use.
Our Due Diligence on this property has noted your landscaping encroachment on your
east property line. This encroachment is shown both in the Survey of 1998 and in the
recent staking of the property lines.
Further Due Diligence has noted that your property file at the City of Orono contains a
correspondence from Mr. Gary Valerius dated October 26, 1998. In this letter, Christine
and Gary Valerius outline their concern and awareness of the encroachment. They
reference a letter sent to you in September of that year. In a subsequent conversation
with Mr. Valerius, he informed me that you had spoken with him regarding this issue
acknowledging the encroachment. Mr. Valerius explained to me that upon seeing the
landscaping, and his providing additional screening, he became comfortable with your
casual use of this area, however, he was additionally clear that he in no way provided an
easement or compromised his ownership of the property as described in the survey.
Steve and Alyson Murray have no objection to your current use of this area, subject to
discussion with you in order to gain an understanding of the intended casual use. They
are equally clear that they grant no easement, temporary or permanent of this land or
property line nor does the City of Orono recognize any grants of easement, temporary or
permanent of this land or property line.

According to the WCA Rules Chapter 8420.0225 Subp. C, (cross reference MN Stat. 5ec.
15.99) a decision must be made within 60 days of receiving this request for a type and
boundary decision. Failure to deny the request constitutes approval. Any denial of the

- District Corps of Engineers and Local Units of Govemment in the State of Minnesota".
, The techniques described in the publication offer valuable guidance and clarification �.
regarding the use of the 1987 Federal Manual for Wetland Delineation. This publication � ,
also points out that the indicator status of some hydrophytic plants has "unofficial" status.
The official soluce of indicator status of hydrophytic plants continues to be the U•S Fish
and Wildlife Service publication previously cited.
If it is determined that a TEP meeting is necessary, SER requests that we are notified ten
(10) days prior to the meeting. SER is also•willing to coordinate the meeting if necessary.

POTENTIAL WETLAND AREAS <
Based on a review of off-si[e data (National Wetland Inventory (NWn map and the Hennepin Counry Soil Scrrvey) there�
appears to be 1 wetlancl area located within the property boundaries of the subject parcel. According to the Hennepin
County Soil Sccrvey hydric soils have also be�n mapped on the site. Hydric soil is one of the three necessary criteria for a
' jurisdictional wetland along with hydrophytic vegetation �nd the presence of water (hydrology). A fourth criterion for
jurisdictional determination is that of normal conditions. SER reviews past precipitation data and local site conditions to
determine the existence of normal conditions. SER boundaries are established with normal condit.ions as a pre-requisite.

VVetland�elineation
SER's Wetland Delineations involve the review of available off-site data, completion of a field visit that involves the
staking of jurisdictional wetlands followed by a detailed wetland delineation report. SER has developed a reputation for �
the accuracy of our wetland delineations that maximize the amount of highly valuable buildable upland. SER will stake
;the wetland boundary(ies) as conservatively as possible through its detailed approach'in collecting field data.
Prior t�o completing the site visit, SER personnel will review the county soil survey, NWI maps, the most recent aerial
photographs, and the DNR'Protected Waters maps. A site visit will be conducted which will include the staking of
jurisdictional wetland(s) with 4-fooG wood�n lath and the appropriate number of soil sample locations to characterize
difficult areas. The wetland boundary(ies) will be staked to maximize the extent of the non jurisdictional wetland to
conserve buildable upland. The findings of the wetland delineation will.be provided in a detailed delineation report that
will inchide site description, method of.boundary determination, detailed description of observed soils, ve�etation and
wet(and hydroloQy, figures and wetland data sheets. All wetland delineation activities will adhere to the USACOE .1987
Wetland Delineation Manual and MnWCA rules. '

For the wetland delineation, all jurisdictionat wetland boundary(ies) will be staked by SER personnel with expertise in
hydric soils and hydrophytic plant species identification. The wetland boundary(ies) will be marked with either

Technical Documentation '
A comprehensive delineation report of the staked wetland boundary(ies) will discuss field procedures, wetland type(s)
observed, comparisons with wetlands illustrated on NWI maps, and the appropriate fib res. This report will adhere to
suggested guidelines for delineation repnrts as recommended by the USACOE and the Minnesota Board of Water and
� Soil Resources. The accuracy of SER's delineations is an'd has been consistently upheld by numerous technical reviewers
representing a variety of local, state and federal abencies. All.delineations require documentation in the form of a repor�.
SER will not s[ake wetland boundaries without producin�a report.
SCHEDULE
We can schedule the fieldwork to begin after we receive a sib ed Authorization to Proceed'form. If you agree to the terms
-0f this Scope of Services, please si�n and retum the enclosed Authorization to Proceed form for our files.
The wetland delineation report, which presents the site visit finditigs, will be submitted approximately 30 days after the
site visit. Please contact me at SER if there are time restrictions that will require expediting thesa tasl�s in a timelier
manner. Otherwise SER is prepared to schedule the work and proceed with the proposed timeline upon receipt of the
attached AuthOrization to Proceed form(s).

George asked me to send you an Email to explain what I have found out regarding dock access rights that relate
to my lot on Bayside road.
My attorney has told me that the Easement that we have with The next door lot represents a valid enforceable
legal right obligating Lot 2 to give my lot(lot 1) access to use a dock across their property subject to other local
governing bodies authority over the lakeshore use.. So the owner of lot 2 must do it but its subject to the next
steps that apply to all landowners in and around Lake Minnetonka to comply with whatever rules exist from the
city of Orono or the LMCD since they control the lakeshore and thus all docks on lake Minnetonka. Mike Gaffron
at the city has told me that the city will not approve a separate dock for lot 1 across lot 2s outlot without the city
council giving special approval which he thought was unlikely. The city will also prevent any lakeshore owner from
renting out boat slips. He acknowledged that many many lakeshore owners who have docks may park other
peoples boats at their docks free but they still don't approve of it and he thinks its against their rules. They
obviously have not enforced that position since it is so prevalent around the lake. My attorney tells me that Lot 2
definitely has lakeshore access and has been granted dock rights for a number of boat slips- He in fact has had a
dock in the water and boats moored at it for many years.

Woody—Melanie asked me to respond to your forwarded email from Chip Fisher. First, I would note that Lot 2
does have lake access rights by virtue of the Special Lot Combination Agreement which connects the Outlot to
Lot 2 for zoning purposes. Secondly, Chip is correct in his understanding of my assertion that the Council is
unlikely to grant approval for Lot 1 to have lake access, given the clear record in the subdivision approvals that
states Lot 1 cannot have lake access. Third, the City's position on renting out of boat slips is that it is a
commercial activity which can only happen in a commercial district, and the mere provision of a dock space or
buoy at a residential site for someone other than the owner or occupant of the property, regardless of whether
money is exchanged, is a violation. The prevalence of dock rental around the lake is not easily quantifiable, but I
have no doubt that many lakeshore owners are renting out slips, and the City's policy is to only enforce upon
complaint; we do not have the staff to check every boat at our approximately 1000 lakeshore properties.
However, to say we have not enforced this position is incorrect. Even within the last week, we have filed legal
action against a property owner who is operating a 9-slip marina at a residential property just north of the
Narrows. We typically receive 5-10 complaints per year from neighbors who have to put up with the traffic,
strangers, and odd-hour activity associated with slip rental situations...

George asked me to send you an Email to explain what I have found out regarding dock access rights that relate
to my lot on Bayside road.
My attorney has told me that the Easement that we have with The next door lot represents a valid enforceable
legal right obligating Lot 2 to give my lot(lot 1) access to use a dock across their property subject to other local
governing bodies authority over the lakeshore use.. So the owner of lot 2 must do it but its subject to the next
steps that apply to all landowners in and around Lake Minnetonka to comply with whatever rules exist from the
city of Orono or the LMCD since they control the lakeshore and thus all docks on lake Minnetonka. Mike Gaffron
at the city has told me that the city will not approve a separate dock for lot 1 across lot 2s outlot without the city
council giving special approval which he thought was unlikely. The city will also prevent any lakeshore owner from
renting out boat slips. He acknowledged that many many lakeshore owners who have docks may park other
peoples boats at their docks free but they still don't approve of it and he thinks its against their rules. They
obviously have not enforced that position since it is so prevalent around the lake. My attorney tells me that Lot 2
definitely has lakeshore access and has been granted dock rights for a number of boat slips - He in fact has had a
dock in the water and boats moored at it for many years.

SOIL OBSERVATION AND TESTING
INTRODUCTION
This report concerns our recent observations and testing of soil conditions for the
residence currently under construction at 3760 Bayside Road in Orono, Minnesota. Our
work in the field was authorized on February 16, 2005. Our authorized scope of
services was limited to the following:
1. Observe the soils exposed within the mass excavation for the planned structure.
2. Put down shallow hand auger borings to explore the local subsurFace soil
conditions.
3. Provide judgments regarding suitability of the observed soils for support of the
anticipated structural loading.
4. Perform intermittent field testing of compaction of fill soils.
CONCLUSIONS
Based on our limited observations and hand auger borings, the soil exposed within the
observed excavation was judged to be firm, grayish brown sandy lean, similar to the
soils described in the preliminary soil boring report. The exposed soils were judged
capable of supporting the anticipated fill and foundation loads for the planned
construction.
PROJECT INFORMATION
We understand the construction in progress will consist of a single-family residential
structure of masonry block and wood frame type construction. Overall dimensions for
the structure are approximately 80' x 37' with a 34' x 30' garage attached to the south
side of the residence. The single story structure will have a walkout basement towards
the north. The lowest finished floor will be placed at approximately elevation 935'. The
garage floor will be at approximately elevation 940.4. We understand the structure will
be supported on perimeter strip footings placed at normal frost protection depth and on
several interior strip footings placed just under the floor slab. We have not been
provided with the actual design unit foundation loadings. However, we anticipate
loadings of 2000 psf or less, which is typical for this type of structure.

During our observations, we had access to the soil boring report performed by Advance
Surveying and Engineering Co. (#0001203) dated September 1, 2000. The report
indicated a soil profile of 2' of topsoil, underlain by firm, grey-brown sandy lean clay,
inturn overlying stiff, grey sandy clay to the depths explored. The report indicated the
underlying firm, grey-brown sandy lean clay is suitable to support foundation loads of up
to 2000 psf. Please refer to the referenced report for specific details.
OBSERVATION METHODS AND RESULTS
Our observations of the mass excavation were performed on February 21, 2005, on an
intermittent basis. Besides observing the exposed soils, we placed several shallow
hand auger borings to explore the localized subsurface conditions to aid our judgments.
The soils exposed and retrieved by our hand auger borings were classified in
accordance with ASTM D 2488-00 and estimates were made of their strength
properties.
At the time of our observations, it appeared the excavation extended through the
existing topsoil and approximately 1' into the underlying grey-brown sandy lean clay.
We judged the exposed natural sandy lean clay to be in a firm condition, similar to the
conditions described in the preliminary soil boring report for the project. The bottom of
the excavation was generally level at approximately elevation 931'. After the exposed
soils were judged suitable, pit-run clean sand engineered fill was placed to attain the
planned footing grade and lower floor slab grade.
Therefore, based on our observations, hand auger borings, and compaction tests, it is
our opinion the soils observed are suitable to support the anticipated fill and foundation
loads up to 2000 psf.
COMPACTION TESTING

�lare�(�j compaction tests were obtained on February 2� 2005, on an intermittent
basis. The compaction tests were evaluated according to the Moisture-Density Relation
of Soils as designated by ASTM D 698-00 (Standard Proctor). The test results,
attached, indicate the recommended minimum compaction level of 95% of Standard
Proctor was attained or exceeded at the test locations and elevations.

REMARKS
It must be recognized that we do not practice in the field of surveying. Therefore, we
must rely on elevation and location information provided by others. Also, if the
construction is redesigned or otherwise moved subsequent to our work, we should be
informed so our firm can assess if additional engineering observation is required or
suggest engineering alternatives.
