Lyle,this is a quick reminder regarding the letter you indicated that you would write for me regarding the
lawsuit served on me by A1 Balgaard. I greatly appreciate you effort in this regard.
I would hope that you could incorporate the following items in your letter:
• The Morrison's had a current survey of their property,they acquired a permit from Orono and thus met
all requirements necessary for their driveway project.
• You met with A1 and the person from the county and there does not appear to be any barriers to Al
extending his driveway to the road.
Thank you Lyle, I'm sorry to have to ask you to do this. The court date is scheduled towards the end of
January, so it would be great if you could do this in the next few weeks. Please give me a call at work
(370-2834) if you have any questions or suggestions regarding how to present my case. I plan to live in
Orono for many years and am just trying to improve my property.

Re: Driveway Alteration
Dear Mr. Morrison:
I am w7iting this letter at your request reQarding the issuance of land alteration permit #7476.
On October 23, 1995 the City received an application from you requesting a permit to alter
your driveway. I reviewed your proposal drawn on a survey of your property. Your plans
indicated that you proposed to move the driveway which was running along the property line
to further away from the lot line. You also proposed to eliminate the driveway's connection
to the neighbor's property. After reviewing the plans and not findin� any conflicts with the
Orono Municipal code, the permit was issued on October 25, 199�.
The day that work began the neighbor Mr. Balgaard came to my office to express his concern
over the closing off of his second driveway. I explained to Mr. Balgaard that the work that
was underway was entirely on the Morrison property and it was the Morrison's right to do
work on their own property. Mr. Balgaard then asked about doing work on his property. I
explained that the City could issue a permit for him to do work on his property also but work
in the road right-of-way would require a permit from Hennepin County. The following day
I met on-site with Mr. Balgaard and Dave Zetterstrom of Hennepin County Public Works. We
discussed Mr. Balgaard creating a ne�v driveway approach next to the existin� one. Dave
Zetterstrom said Mr. Balgaard would be required to obtain a permit and that he could approve
it as proposed.

MEETING GROUND RULES:
The parties agree to participate in the meeting in an attempt to discuss the following issue(s):
The parties also agree to abide by the following ground rules:
1. ISSUES TO BE DiSCUSSED. The�iscussion at the meeting will be limited to the problems described above.
2. TIME CONSTRAINTS. Specific time constraints will be proposed and agreed upon before the meeting
begins.
3. MEETING IN`'GOOD FAITH". All parties agree to meet in"good faith", which means they will be
forthcotning in providing truthful information. In addition, all parties will treat each other with mutual
respect, meaning:
• No interrupting
• No abusive behavior, e.g. name calling,put-downs
• Speak far yourself, using"I" statements, not for any other person
�. ROLE OF FACILITATOR(S). The facilitator(s)are neutral parties and thus do not represent either pariy nor
are they advocating for any specific outcome to the meeting. The role of the facilitator is to:
• assist parties with clarifying issues
• ensure that all parties have an equal and fair chance to state their concenls, ask questious and/or share
pertinent information
• ensure respectful communication bv all parties.
5. CONFIDENTIALITY. The meeting proceedings are considered confidential. No part of these proceedings
can be used in any lawsuit related to the problem(s)identified above. The parties will not subpoena the
facilitator(s). an_y Board members, staff of the West Suburban Mediation Center(WSMC), or any records or
docwnents of the facilitators or WST7C. As these proeeedings arc not a formal mediation process and one goal
of this meeting is to share information, notes may be taken and retained by all participaring parties. However.
no recording of this proceeding shall be made unless all parties previously agree to it.
EXCEPTIONS TO CONFIDENTIALITY. Where information regarding possible abuse or neglect of children
and/or domestic abuse is stated by any participating party, statute requires that such information be reported to
the appropriate authorities.
