Zt is our understanding that you are using the new septic tanks as a holding tank system. I note that completion of the septic system was not ?isted as an outstanding deficiency en your Temporary Certificate of Occupancy issued on March 1, 1989. I also note from the file `� that on July 24 , 1989 Lyle Oman verified that all noted i;'� def iciencies had been comp 1 eted. However, the f ina 1 Certif icate ��',��'' of Occupancy has not been issued because the septic system is �� ; incomplete. �,���: �� '� You may recall that my ietter of July 25, 1988 layed out �'� .; ' �,ome options for interim use of the existing system while the fr: ;;; � City Council considers the merits of municipal sewers for your � area. However, that '_etter did not discuss the use of holding tanks as an option. Z do seem to recall discussion with you �' �:�' :3uring your lot width variance review, regarding potential ,;:,,,;, '�olding tank use. "�" The July 1983 letter suggests that a written agreement would *a�.a�.:,� be in order for some interim option other than a complete septic �� system. Since an agreer�ent has not been executed, it is incumbent upon you at this point to formalize such an agreement. The intent of this letter is to � serve as an agreement between you and the City of Orono regarding �� temporary use of your existing septic tanks as a holding tank system. The following are proposed as conditions and stipulations of the City's temporary approval for your holding tanks: . 1. The Temporary Certificate of Occupancy granted 3/1/89 '� shall be extended to 9/1/90. That Temporary Certificate � will note the completion of septic system as a requirement . for issuance of a final Certificate of Occupancy. 2. You will provide the City with a written contract between you and a licensed septic system pumping contractor. :.: That contract shall stipulate that tanks will be checked at least weekly by the pumping contractor and pumped out as often as necessary to avoid any surface discharge from the tanks. 3. If the City Council at some date prior to 9/1/90 makes a definite decision that municipal sewers will not be provided for your area, you will be required to complete your septic system within 60 days of that decision (weather permittinq, if ia the winter) . 4. As you correctly noted, the �;ro�;erty is within an area the City is considering for Fotential installation of municiFal sewers. Because there is a �otential that the �roperty may be provided witt� •, muncipal sewer in the relatively near future, connection of a new h�use to the existing septic sy�tem is a reasonable request. It would seem unfair to have you s�end �erhaps as much as 54, 000 to $8,000 on a septic system and then require you to �;ay assessments for and connect to a munici�;al sewer a year or two later. However, at this point in time there does not seem to be any real Fust, by the City Council nor the affected �ro�;erty owners to initiate a project, and no meetings to discuss the issue are currently scheduled. It would seem that even if ineetings and hearings did commence this fall, and ff � decision was made to �roceed, actual hook-up availability would likely not occur until late 1989 or 1990. Prior to issuance of a bui lding �;ermit for the new house, owner ' � must Frovide a full site evaluation and design for a new conformin�� ; septic system, both primary and alternate drainfield eites, in orde� � to confirm the suftability of the lot for �;ermanent usage of septic � systems should sewers never become a reality. � 2.
