Dear Mrs. Ha1e:

See if you concur with their suggestion. At any rate give me a

Dear Mr. Uran:
Subject: Violation of Minnesota Rules, Chapter 4725 for Well Located at 3348 Bayside Road,
Orono, Hennepin Countv, Minnesota, Unique Number 600234
The purpose of this letter is to inform you of violations of Minnesota Rules, Chapter 4725, which
were noted by a representative of the Minnesota Department of Health (MDH), and to
acknowledge corrections you made at the site listed above.
Water Plus constructed a water-supply well, Unique No. 600234, in March of 1999 on property
located at 3348 Bayside Road, Orono. A search of the records available at the city of Orono
indicated that the property was formerly served by an individual sewage treatment and disposal
system. The property was connected to the municipal sewer system in 1993. Records indicate
that the contents of a sewage tank were pumped and removed, and that the block walls of the
tank were caved in. The records did not indicate whether the sewage tank was a sealed septic
tank or a cesspool or seepage pit with an open bottom. The records also noted the possible
existence of a sewage drainfield. The city records did not indicate that contaminated soils were
removed
Minnesota Rules, Chapter 4725 requires that a water-supply well be located a minimum
horizontal distance of 50 feet from a sewage drainfield, a minimum of 50 feet from a septic tank,
and a minimum of 75 feet from a cesspool or seepage pit. The minimum isolation or "setback"
distances apply to sources actively receiving contaminants and also to inactive sources of
contamination, unless the contamination has been removed.
On March 26, 1999, Mr. Douglas Edson, hydrologist from the St. Paul office, met on the
property with Mr. Steve Weckman, city of Orono, and you to determine if the well was located
closer to the sewage system than allowed by rule. Two holes were dug to a depth of 18 inches in

a location approximately 20 feet from the well. Sorted and graded drainfield-type rock was
found, confirming that a drainfield was present. A sewage tank was located and found to be
45 feet from the well. Mr. Edson informed you that the well was constructed too close to the
'ainfield and that either the drainfield and contaminated soils within 50 feet of the well must be
excavated and removed, or the well must be sealed and a new well constructed in a complying
location. He also stated that if the sewage tank was a sealed septic tank, and if the contents had
been removed, no further action concerning the tank would be required. However, if the tank
was found to be a cesspool or seepage pit, and if contaminated soils had not been removed, then
either the contaminants must be removed, or the well must be sealed and a replacement well
constructed in a complying location.
On April 5, 1999, Mr. Steven Bennett of the MDH met Mr. Weckman and you on the property to
observe the excavation of the drainfield and the verification of the sewage tank. The drainfield
was found to be located within 10 feet of the well. The sewage tank was found to be a concrete
block seepage pit located approximately 45 feet from the well. During the excavation process, a
second drainfield was discovered, and a second open-bottom concrete block seepage pit was
discovered on an adjacent lot owned by the same property owner. Both of the drainfields were
excavated and removed. Both of the seepage pits were removed along with contaminated soils.
Mr. Bennett noted a strong sewage smell associated with the drain field and seepage pits, even
though they had been taken out of service in 1993. Clean fill was hauled to the site, and the
excavations were backfilled. The entire backfilling and grading operation was finished on
Apri17, 1999.
Please contact Mr. Edson at 651/215-0820 or me at 651/215-0831 within ten days of receipt of
this letter if you believe our information is incorrect or incomplete, or if you have any questions
about the content of this letter.
Sincerely,
