Hehl : I apologize for any misunderstanding created by either myself or other Orono staff personnel questioned about the legality of the fence constructed last year on Lot l, Block l, Steilows Second Addition. I regret that we have not made it clear that indeed, the fence as constructed and located on the subject property, meets all pertinent standards of the municipal code. The grade changes referenced in your letter (received this office April 2 , 1984 ) were originally approved in a site grading plan submitted sometime in 1981 , the year the building permit for the house was issued . The existing grade along County Road 84 at the time the fence was constructed in1983wasalready established/approvedinl981 although the final site grading work was not completed until early 1983 when the mound septic system was finally installed. The fencing and tennis court were installed at the request of the new owner. The site grading plans presented by the builder in 1981 never revealed fencing along County Road 84 . I would suggest that you make arrangements to visit the City offices so that I may review the entire file with you. At that same time, I will be able to answer any questions you may have concerning the interpretation of the ordinances in relation to the grade changes and location of the fence. If , after that, you wish to protegt the interpretation by staff , there is an appeals procedure application available to all residents that I would be happy to review with you.
