CITY STATEMENT ON LAWSUIT OVER YOUTH ACTIVTIES IN BEDERWOOD PARK The City Council believes strongly that our City parks should be available for our entire community, but especially children, for enjoyment, exercise, and a variety of recreational activities. In June 2021, the City Council adopted Resolution No. 7195, which allowed the Orono Mountain Bike Team, a youth club, to use a section of Bederwood Park for skills training. The City authorized the team to make minor improvements to the area to facilitate mountain bike training, subject to approval of the Orono Parks Superintendent. Minor improvements include removal of debris and clearing of dirt tracks to supplement the preexisting dirt tracks running though that portion of the park. Shortly thereafter, Barbara Schmidt filed a lawsuit, naming as defendants the City of Orono, the Minnesota Department of Natural Resources, the Minnehaha Creek Watershed District, and the Orono Public School District. This lawsuit solely concerns the bike trail approval for Bederwood Park and alleges that allowing the mountain bike team to use the public park is a violation of the Minnesota Environmental Rights Act In motion papers before the Court, the DNR confirmed that no DNR permits required for the proposed bike trail, that the DNR has no responsibility for environmental review of the bike trail, and that there are no public waters within Bederwood Park. Ms. Schmidt subsequently dismissed the DNR from the lawsuit. The Bederwood Park woods do not contain wetlands that would trigger permitting actions. The Minnehaha Creek Watershed District has confirmed this fact with City staff on multiple occasion. It is no surprise that Ms. Schmidt dismissed the Watershed District. Ms. Schmidt has never actually served the school district with the lawsuit. Therefore, the only entity remaining in the lawsuit right now is the City of Orono. In a recent order, the Court denied a temporary injunction sought against the City. The Court found that, “the plaintiff has not shown irreparable harm will occur without the temporary injunction.” More importantly, the Court concluded, “at this stage, it is unlikely that the plaintiff will succeed on the merits.” Finally, the Court acknowledged that, “Public policy favors that all residents enjoy a public park for recreational activities (including hiking and biking), and a number of them should not be enjoined from doing so because of a neighbor’s complaint. Orono has the authority to maintain its public parks, and pass ordinances regarding citizens’ use of the parks.” Agenda Council Meeting Monday, October 25, 2021 6:00 P.M. PUBLIC COMMENTS Barbara Schmidt asked for her name to be corrected in the September 27, 2021 Minutes as her name was listed as Schwartz. She noted she would not be able to answer any questions tonight pending the lawsuit. Ms. Schmidt stated the police were called on September 21, 2021 because of bike racing in Bederwood Park directly past the playground and park-goers that were out in the open. This call was due to extreme speed and the number of bikers in Bederwood Park by one of the local property owners (not Ms. Schmidt). She said they have evidence that bike practice regularly encircles the playground, and in one instance rode through the playground. She asked the City Council to see her legal team for this documentation. Mountain biking is, by design, an assertive activity and at times an aggressive sport that should not be taking place next to open soccer fields, little children’s playgrounds, or walking paths. It is just too dangerous. When this whole idea of bikes in parks came up three years ago, one Park Commissioner verbally approved the practice in the park; the City Administrator said it was a “trial for youngsters.” Ms. Schmidt noted the trial is over and said for “us” it is a failure. Mayor Walsh asked who is “us”? Ms. Schmidt replied it is the neighborhood and there are several petitions that state this. Mayor Walsh has not seen any petitions. Ms. Schmidt continued, saying she witnessed approximately 40 riders in the park at one time, it was filled and the parking lot was overflowing. Most of the youngsters were in high school and there were several adults taking up every square inch of the park at speeds that should not happen next to pedestrians. In fact, Ms. Schmidt was nearly ridden over by one of the coaches with a go-pro camera attached to his helmet, possibly filming every single park-goer. She said this is not a safe situation, it is an accident that will happen and they should ask themselves who is liable for personal injury in this situation? School districts? Ms. Schmidt stated they are not doing the schools any favors by setting up these collision courses to happen. The neighborhood and public parks are not racetracks, the parks are not public mountain biking courses, they should not be ridden in the dark with LED lights. Ms. Schmidt stated that Bederwood Park is a place to gather and spend time with families and friends, it is a place for Little Leagues, children playing, dog-walking, and where they meet families and friends. As Mrs. Carlson- Nelson wrote to the City Council, please find another solution to protect these precious woods, not just for us but for future generations. Mayor Walsh asked if Ms. Schmidt would call them big woods? Mayor Walsh asked if Ms. Schmidt knew that 50 years ago it was a field. Ms. Schmidt stated she cannot answer his questions any longer because of the pending lawsuit. If anyone wants to hear about the lawsuit, they can look at the Facebook page. Mayor Walsh said when Ms. Schmidt says misnomers and things that are completely not true it calls out someone to reflect the truth. Deborah Crump, 25 Stubbs Bay Road, said there is the park, a new construction, and her house. They have been at that location for a long time and her husband was born-and-raised. She watched the City build the park where they put the new soccer field and asked where did they get all the dirt, as she is impressed, it is beautiful, and she is happy the children all have a place to go as it is growing very large in the area. Ms. Crump chose to be very open-minded about this bike trail, she went down and watched them build the soccer field, watched the kids play in the park, and she watches people every day go by her house to the park and lake. There are parents going down with children in strollers, people walking dogs, joggers, and even horses sometimes going down the street. She said she watches them going to the park and noted they shook their heads and walked away. Ms. Crump stated this park is a family park and stated kids are rolling down the side of the hill and running on different sides of the park and now they cannot do this which breaks her heart. Mayor Walsh asked why the kids can’t do this? Ms. Crump replied because the bikes are there. Mayor Walsh asked if the bikes are there 24 hours a day? Ms. Crump replied they are not there every minute. She said Orono can do better than trying to squeeze this track in to this little park. She said to take safety and consideration with kids going this way and that way and going out of the parking lot it is an accident waiting to happen. Ms. Crump went down and watched and saw them dashing out in front of the cars by the parking lot and it scared her. She noted the bikes came across the end where the playground is and little kids ran out that way while bikes were going through there. She asked who does she call to get the beer cans out of her backyard? Ms. Crump said those little trails lead back into her property and this is also something that needs to be addressed. PRESENTATION 14. DIAMOND LAKE REGIONAL TRAIL - THREE RIVERS PARK DISTRICT Stephen Shurson, landscape architect with Three Rivers Park District, noted he is present tonight with Stewart Crosby of SRF Consulting Group. Mr. Shurson gave an update on the Diamond Lake Regional Trail Master Plan and seeks the City Council’s approval on the preferred route within the City limits of Orono along Ferndale. The Master Plan will be finished early next year and will be used as a long-term MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, October 11, 2021 6:00 o’clock p.m. _____________________________________________________________________________________ Page 4 of 9 PRESENTATION – Continued planning document in development of the trail. The trail would extend from Dayton to Wayzata, trails would be 10 feet wide, paved, off-road/separated from traffic, and would include bridge structures, boardwalks, or underpasses as needed. Three Rivers has been working with the seven cities along the route to gain approval from each; so far there is approval from the other six cities. Previously they were looking at routes through Orono on Long Lake Road and up Spring Hill Road; based on a new Medina route they are now looking at a new route through Orono. He walked the City Council through the proposed route utilizing existing trails through Baker, the Independence Regional Trail, and the Luce Line over to Ferndale. Crosby asked what kind of encroachments will the trail have along anyone’s property? Mr. Shurson replied it should all fit within the street right-of-way and they will look at street-widths if there is opportunity to be compliant; if there would be any easement along Ferndale it would be very narrow along the side and those are Wayzata residents. Johnson moved, Crosby seconded, to accept the Diamond Lake Regional Trail section in Orono. VOTE: Ayes 5, Nays 0. COMMUNITY DEVELOPMENT REPORT 7. LA21-000051 – ROBERT LINDEN CONSTRUCTION, 1074 LOMA LINDA AVENUE, VARIANCES – RESOLUTION NO. 7221 Staff presented a summary packet of information. City Planner Melanie Curtis noted the Applicant is proposing to rebuild the existing detached garage and connect it to the home with a small, 5.9-foot addition that will continue the 1.2-foot setback from the north side of the home. The detached garage is 15.9 feet from the rear property line where 30 feet is required; the Applicant is requesting setback variances from the side and rear to connect the garage to the home and add a ½- or ¾-story addition over the garage. Robert Linden, 4356 5th St NE, Columbia Heights, builder, and John Lindquist, 1074 Loma Linda Avenue, approached the podium. Mr. Linden noted the need for the northeast section is because the utilities go into the home on the northwest corner so that corridor would be the connecting point for utilities and keeping the separation between the garage and home. Mayor Walsh noted the City Council has usually been consistent in not allowing things to become more non-conforming and this application makes it more non-conforming. The reason they say no to things is because a year or two later someone will tear the entire house down and say now they get to rebuild like- kind. The City Attorney will tell them that all of the people the Council said no to for the same type of issue will then come to the City wanting to do that, as well. Mayor Walsh noted they need to be consistent. Johnson asked regarding the area labeled “mechanical,” is that a further expansion of the very limited setback of the garage or is it the height? LA21-000051 – ROBERT LINDEN CONSTRUCTION, 1074 LOMA LINDA AVENUE, VARIANCES – RESOLUTION NO. 7221 – Continued Mayor Walsh replied it is both, they want to add the height within the setback and additional hardcover/building structure within the setback. Mr. Linden noted they are actually reducing the hardcover as it is today. Mayor Walsh asked if it is within the setback. Mr. Linden knows there is a concrete sidewalk that already exists there which will now become building foundation. The height is a story-and-a-half so everything will be within the roof envelope. Mayor Walsh stated they are still adding non-conformity and the City Council has said no to others in the past. Mr. Linden stated the street setback is virtually impossible where it is now. Mayor Walsh replied there are inherent practical difficulties with those kinds of issues that the City Council can work with; however, this application is purposely adding more non-conformity in structure which creates its own problems. Johnson’s concern is not so much the height but the enlargement to the garage. Printup moved, Seals seconded, to table LA21-000051, 1074 Loma Linda Avenue, Variances – Resolution No. 7221. VOTE: Ayes 5, Nays 0. 16. LA21-000057/58 – ROBERT ERICKSON, 365 WESTLAKE STREET, GENNESARET PRELIMINARY PLAT Staff presented a summary packet of information. Barnhart stated the Applicant is requesting preliminary plat approval to plat a property he owns, recently vacated portions of Westlake, and is proposing to give the City the drainage and utility easement and additional land for a cul-de-sac. The Planning Commission reviewed the application and recommended approval with the comment on the additional easement to make the cul-de-sac a more conforming size. Staff and Planning Commission recommended an additional 10-foot easement on the backside in lieu of the boulevard reserve the Applicant proposed as part of the vacation request. The Planning Commission offered that potentially shifting the cul-de-sac to the west a bit, it would fit within the existing or additional right-of-way that Mr. Erickson would provide. To this point, Mr. Erickson has objected to that request and Mr. Barnhart seeks City Council’s direction on that. Staff recommends approval of the preliminary plat subject to the provision of an easement for the cul-de- sac and Watershed District approval. Mayor Walsh clarified that the Watershed does not give approvals on a preliminary plat but a final plat, therefore it cannot be a condition on a preliminary plat. Bob Erickson, 372 Westlake Street, noted about a year ago he applied for a sketch plan to combine five smaller lots that were subdivided in the early 1900’s and combining with the southern portion of Westlake Street which has since been vacated. LA21-000057/58 – ROBERT ERICKSON, 365 WESTLAKE STREET, GENNESARET PRELIMINARY PLAT – Continued plat (Lot 1, Block 1 Gennesaret) have remained unchanged. Mr. Erickson noted that is the application before the City Council tonight and he asks for their preliminary approval. Johnson asked what Mr. Erickson’s objection is to having a conforming 50-foot cul-de-sac versus a 40- foot? Mr. Erickson replied to obtain a full 50-feet, the center of the cul-de-sac would have to go westward 17 feet; in looking at the contours or looking at the property they would find a substantial hill that the cul-de- sac would be moved into. Mayor Walsh said to move it just 10 feet there is another 4 feet of hill; now instead of a 6-foot wall they must build there is a 10-foot wall. He noted going the other way and taking more of Mr. Erickson’s and someone else’s property – he does not own half of that land so the City Council cannot dictate that. He noted if they got the other part of the property, it is also going uphill so once they take that extra 10 feet down into the cul-de-sac, Mr. Erickson is most likely going to have to regrade his entire yard and his driveway to even meet that slope. He noted they would be creating chaos. Third, a prior Council and Staff did their homework and said they could live with 40 feet, so they built their driveway, sold property, built houses, planted trees. Mayor Walsh reiterated that a prior City Council and Staff did their homework and vetted it. He noted it would be a humongous hill and would be a burden for everyone, the City, and safety. The City Council and Staff discussed options for the cul-de-sac; Edwards noted they would pave the standard 40 feet and get quite close to a conforming cul-de-sac. He noted the standard is driven by State Fire Code. Johnson clarified they could achieve the cul-de-sac but there might not be the full 10-foot easement on the east side. Edwards replied that is correct. City Attorney Mattick noted the City gets more flexibility with the right-of-way but if they do not need it, they do not need it. He assumes there is a 10-foot easement to the east which mirrors the proposal and as a drainage and utility they will not be able to pave that 10 feet. If they can achieve the paving with what has already been given and the City is comfortable with that understanding that to get to the conforming, they may have to cheat a bit to the west. Barnhart clarified if the City Council were to approve as presented, they would approve with no extra easement; then the Applicant would come back with a final plat that would be substantially consistent with what they see here. Mayor Walsh noted they still have to approve the final plat which will be subject to the Watershed and other agencies. LA21-000062 – DON GAMBLE O/B/O WARD E. EDWARDS AND DONNA EDWARDS (2474 CARMAN) AND RA EDWARDS ET AL (2480 CARMAN) – CONCEPT REVIEW Staff presented a summary packet of information. Barnhart noted this is a concept review of a potential policy change as the Applicant is proposing to rezone the property. The City Council previously looked at configurations that would create a buildable site south and north of the lagoon creating four lots total. The City Council consistently said they were not comfortable creating non-conforming lots and the challenge has been that south of the lagoon the minimum lot size has always been 1 acre. One portion of land is about .7 acres and the other is less than that but more than .5 acres. The Applicant is proposing to rezone the block of parcels to LR-1C which is a half-acre zone with a 100-foot frontage width for a lake lot measured at the lake and 75 feet back. Doing that would allow 2474 and 2480 Carman to be split into two conforming lots. Barnhart noted the question is whether the City Council would be open to a formal application for a zone change. He noted it is fairly consistent with how Casco Point Road has been developed. From a planning perspective, Staff does not see a huge issue with how it is proposed. He noted the Comprehensive Plan says it is low-density residential and is compatible with how it is currently zoned and with the LR-1C zoning district. The City Council looked at the 1-acre lots and ½-acre lots on screen. Don Gamble, 10704 Water Lily Lane, Woodbury, stated the confusing part is how it was zoned in those two different zones. Looking to the west and all the way around the point it is all LR-1C (1/2 acre) until it gets to this point and it goes to 1B with the back of the lots still being 1C but everything south being 1B. He noted changing the zoning does not change the densities, rather they just become conforming with the neighborhood and the density around it. Mayor Walsh would like to see it conform with what is there – he could take the two orange lots and make them one, split off the two lots and then they would all be conforming with current zoning. Mr. Gamble noted it is two separate owners and it seems to him that the zoning is off. Jeff Jarnes, owner of 2470 which is just to the west, asked if they rezone this does it negatively affect his property in any way? He does not think it does. His understanding is the way it is zoned is to have one house right now, therefore this zoning change would make it able to have two houses. He wants to be sure it would not be three properties. The City Council replied no, there would not be three. Mr. Jarnes stated the south shore of the northern lots is all wooded with deer and he noted they do not want to have one driveway down the middle with multiple units in there. Mayor Walsh noted Barnhart was looking for feedback on the issue. FINANCE DIRECTOR REPORT Finance Director Olson updated the City Council on building permit activity for new homes noting in September the City was a bit lower than previous two years but with total permits the City is right on target. They are currently at 85% or $359,000. CITY ADMINISTRATOR/ENGINEER REPORT City Administrator/Engineer Edwards stated he is working with the County on a bridge reconstruction plan on North Shore Drive for the following year. He met with the County design team and the final phase of the Wayzata Boulevard turn-back project will be in 2023. Edwards noted they had approximately 25 people at the Parks Commission work session regarding an increased demand for pickleball courts across the metro. MAYOR/COUNCIL REPORT Seals said it was homecoming and there were many people at the game. She shared regarding the soccer club at Bederwood field that every soccer club parent that uses the field loves it and has not complained about being restricted by other parties. She has not heard from any of them. They think it is great that there is a parking lot and playground and many of them bike to the park. Is it busy? Yes. That is a sign that people are using resources that tax money has gone into. She lives near the park and is happy to go down and walk the park with neighbors who are concerned. Johnson noted it is also a trailhead. Crosby thinks it is important during public comments to allow people to speak; however, if it is about reiterating the same thing, it gets old. He noted the City is improving their parks, kids are playing in parks and being active outside, and that is the way it is going to happen in Orono. He stated they do not need to apologize for improving their parks and having children use them. Crosby shared regarding water meters that were changed out to the upgraded ones and the issue he has is that he cannot actually see it for the water usage. He noted he had an irrigation leak that he did not know about and his last bill was $700. Crosby said if the City puts a new meter on someone’s house, they need to have access to see it if something is going on so if there is a leak it can be addressed. Johnson noted they had very talented people wanting to give their time to the parks at the earlier meeting. He asked how do they improve the City’s parks so it attracts more people; on one hand they want to bring in a different group and then people do not want it. He said one of the Park Commissioners lives across the street from the golf course and wants more activity at the golf course and wants it to be a year-round attraction. Johnson noted there are a lot of people that live near the parks who want them used more, Seals included. He said they added three new Park Commissioners tonight. Johnson shared about the public works facility plans including traffic flow. Mayor Walsh stated homecoming was great and the kids had a blast. He met with Charlie Minor, the mayor of Long Lake, regarding the fire department. Each City will hire an appraiser and get some proposals on the worth of municipal facilities. He said it looks like the conclusion is whatever the two appraisers come up with, they will take the average, and would then buy it to move forward. They hope this process would culminate in 2023 and they could take over the whole contract in 2022 or 2023. Cameron Porter will be appointed to serve as alternate until the term expires on March 1, 2023. 2. Prosecuting Attorney Services Discussion City Administrator Adam Edwards began discussion with a brief background of the City’s use of Prosecuting Attorney Services. He noted the contract will be expiring in March 2022, and there may be some interest with neighboring Cities to engage in a group contract for services. Police Chief Correy Farniok mentioned that he met with the police commission and inquired about what other cities were doing and if asked if they would be interested in discussing a group contract for services. Farniok noted it could be a 6-9 month process to determine if this is something the city should pursue. Mayor Dennis Walsh, noted that staff should notify Tallen of this discussion and see if they would be willing to extend their contract until a decision is made. We are not only the Bederwood and Lowry Woods Nature Conservation area neighbors, we are the people that care about what happens in all neighborhoods in Orono and Hennepin County. Right now, we are asking for change. We are here tonight to advise all of Hennepin County, our local communities, and the media that our private and public property rights have been deprived. We are here to ask for transparency, public and timely property notices, and an equal voice in what happens to our public lands and how private land use is regulated. How did it come to be that the Orono advisory-only Park Commission gave the rights to use public land for niche entertainment that predictably led to trespassing on private property? This trespassing has gone on for months and months without stopping. How did it come to be that the Orono advisory-only Park Commission gave approval to carve up our Bederwood Park and our Lowry Woods Conservation Area without public notice? Mayor Walsh asked according to whom? Ms. Schmidt replied she cannot take any questions and said the City Council must refer to the City’s legal counsel. Mayor Walsh asked if Ms. Schmidt is the one taking pictures and videos of children in the woods? Ms. Schmidt continued to read: This degradation occurred for months and months. How did it come to be that the Orono advisory-only Park Commission gave approval to go against our standing ordinance of no bikes in parks Section 22-93 by approving public mountain bike trails for niche entertainment? This degradation and frankly, disruptive park activity has occurred for months and months without public notice. Our organization has gathered over 100 signatures on a petition for an Environmental Worksheet (EAW) to review the existing and continuing damage which has gone on to Bederwood Park and the Lowry Woods Nature Conservation Area. The City of Orono did not order the EAW, even though we were told there would be further degradation to Bederwood woods and the construction of bridges over the Bederwood stream, specifically in June of 2021. Mayor Walsh stated that is not true either. If Ms. Schmidt speaks falsehoods, he will correct her. In May of 2021, we were told there wasn’t a plan for the Lowry Woods Nature Conservation Area yet a Capital Improvement Project (CIP) is proposed for $100,000 according to the plan reviewed at the Park Commission meeting on September 7, 2021. To be clear, we do not want bikes in Orono parks except for travel to and from parks. We do not want mountain bike trails in Orono parks. We do not want mountain bike courses in our Orono parks. We do not want the advisory-only Park Commission making further decisions without giving public notice and adequate opportunity to comment from our neighborhoods. Accordingly, we are demanding that you dissolve the unlawful enacted resolution for the mountain bike courses in Bederwood Park. I’ve also brought more than dozen letters written by local neighbors to ask the City Council to stop building mountain bike trails in Bederwood Park and stop biking in Bederwood Park and Lowry Woods Nature Conservation Area. We ask that you stop allowing bikes in Bederwood Park and Lowry Woods Nature Conservation Area in perpetuity. Ms. Schmidt read a letter from resident Marilyn Nelson: To the Mayor and City Council: I live at 500 Tonkawa Road. Although I am not directly on the trail, I walk the entrance to the Luce Line. Mayor Walsh thanked Ms. Schmidt for her time and noted she had her five minutes and asked her to sit down. Ms. Schmidt said that is fine and asked to turn in her paperwork for review. PRESENTATION 6. APPROVAL TO ACCEPT DONATION – ROTARY AND CHUNKS AUTOMOTIVE SERVICES Chief Farniok wants to take the opportunity to thank several member of the community that have participated with the firearm safety program through the DNR. He thanked Mike Personius who has donated his time and energy in helping educate students for the program and Chief Farniok wants to accept a donation on behalf of the Orono Rotary Club on the donation to help buy equipment and needed training materials for the firearm. Chief Farniok also thanked Deputy Chief Chris Fisher and Matt Stoltz who is also an instructor. Deputy Chief Fisher said eight years ago the Chief directed Staff to work on community engagement regarding re-branding who they are to the community. As part of that initiative, they looked at other services they can provide, one of which was firearm safety for children. Kids come four nights a week for three hours and the fifth day is a four-hour field training; they go up to the Corcoran Police Department facility for the field training. Adopt 2022 Preliminary Tax Levy – Resolution No. 7218 Finance Director Olson gave a presentation on Agenda Items 11 and 12 stating they have been working on the budget since May. Tonight, they set the preliminary tax levy which sets a maximum and cannot increase after this evening but can be decreased. The final levy and budget will be adopted at a meeting on December 6, 2021. Public input will be allowed before final adoption at the Truth in Taxation meeting at 6:00 p.m. on December 6, 2021. He shared revenue sources, noting this increase in the property tax levy will not increase the property tax rate. Mr. Olson noted property taxes are 53% of the General Fund budget which is a fairly low number compared to surrounding cities, some of which are 82-83%. He walked the City Council through the line item changes and explained each one. Seals stated se was approached about potentially increasing the Golf Course budget by $10,000 to do marketing. She is in support of it because it is paying for itself; she wants to bring it up to the group as they don’t typically have a lot of marketing of the golf course. Mayor Walsh thinks they should bring the City Council a plan and explain the marketing proposal. Edwards noted if there are increased revenues, the Golf Course could bring a marketing plan to the City Council and those funds were authorized. Mr. Olson continued the presentation, comparing the average City property tax distribution in the State of Minnesota (29%) to the City of Orono (15%). He showed the 2022 proposed tax levy and budget on screen and explained each line item including the General Fund, Facilities Fund, Pavement Management, and Parks. Crosby noted the Big Island event was terrific, trails look wonderful, as does the historical signage on the island. He said it was a fun day. Printup echoed Crosby’s statements and said he enjoyed the presentations tonight. Seals said the Big Island property is now accessible to all beyond the dock, and it is really great to see the project finished. She has had a few resident questions regarding development, noting people say they cannot believe how much Orono has changed, the development, etc. Seals thinks this is very unfortunate as much of this “knowledge” is coming from social media; she reminded people that social media is not the source of truth. She asked to explain to the public that the City Council has been very consistent that they do not want mass development, but in reality, they must meet Met Council numbers and approve some development. Mayor Walsh said in talking about communications, it would be great to have questions and answers with links on the City’s website, a video, or other information available. He thanked the Staff for the great work on the Big Island ceremony, it was nice to see some Vets get out there, and he thinks they will have a much busier year out there next year with all the information that has gone out. He noted there were a lot of other helpers and volunteers who worked on this project to get it completed. He stated Orono Homecoming is coming up and encouraged the public to come out and cheer on the team. Carlson Approved By: 1. Purpose. The purpose of this agenda item is to adopt a Resolution Certifying the Assessment Roll of the Carman Bay Lake Improvement District. 2. Background. On July 24th, 2017 the Orono City Council passed resolution number 6871, A Resolution Approving the Establishment of the Carman Bay Lake Improvement District. The district is required to hold an annual meeting in which it adopts an annual budget and a tax roll. On September 21, 2021 the district held its annual meeting and adopted its 2022 budget and tax roll. The district has forwarded the assessment roll to the City for certification to Hennepin County. 3. Staff Recommendation. Staff recommends the adoption of the attached resolution levying the Assessment Roll for the Carman Bay Lake Improvement District. Treasurer’s Report Treasurer Kennefick presented the 2021 budget and estimated 2021 expenses (see attached “2021 CBLID Treasurer’s Report”). The CBLID had a good year budget-wise. We had a bit more carryover of funds from last year than we budgeted for, tax receipts were slightly higher, and the LID received a $5,000 DNR Grant this year to treat Eurasian Water Milfoil (milfoil) and Curly Leaf Pondweed (CLP). Also, expenses were lower than expected due to a change in the treatment protocol by our applicator PLM, saving $6,000. As a result, our finances are about $13,000 better than we budgeted for, and this amount will carry over into 2022. This is only an estimate at this point because we will not receive our second half 2021 tax revenue from the City of Orono until December, and the amount of the tax receipts may vary somewhat from the 2021 estimate. CBLID web page on City of Orono website: Nielsen discussed the CBLID web page that the City of Orono maintains for us. The City has been helpful, and does not charge the CBLID for presence on the site. Our web page is a good source of information. The CBLID web address is: http://www.ci.orono.mn.us/423/Carman-Bay-Lake-Im- provement-District-CBL. Or, simply go to the City of Orono web site, and do a search for “Carman Bay LID”. The site includes information on all documents that established the LID, the purpose of the LID, bylaws, board meeting minutes, annual reports, and more. Also there is a white paper, “Outline of Aquatic Plant Management for CBLID and Individual Homeowners,” that was recently created by Board Member Mark Kieper. In two pages it outlines what the CBLID can do and what homeowners can do, and answers frequently asked questions. All residents are encouraged to look at the website. VII. New Business A. 2021 Carman Bay treatment update Nielsen described the 2021 CBLID Bay treatment. This is the 4th year the CBLID has been treating invasive weeds (overall, the Bay has been treating since 2008, before the CBLID was established.) We have had good success over the years, and this year was no exception. Currently the LID is treating for two identified invasive species in Carman Bay, Eurasian Water Milfoil (milfoil) and Curly Leaf Pondweed (CLP). The CLP comes early in the season and milfoil later. Before treating, we must do a delineation survey. This survey is done by a separate entity, not our treatment vendor, that creates a map to show where the CLP and milfoil are located. Then our treatment vendor, PLM, and the DNR develop a treatment plan for us, and the DNR issues a permit. The CLP survey is done in early May, and we treated 20 acres on May 21st for CLP. Our Bay has 115 littoral acres (the area where weeds can grow, defined as areas of less than 15 feet water depth in the Bay.) We have been consistently treating about 20 acres over the last few years. We were told if we treat for CLP 7 years consecutively, there is a good chance we can eliminate it for a few years. This is encouraging news, as we are in our 5th year of treatments for CLP. The milfoil survey is done later, in June, as the milfoil plants start growing later. We treated for milfoil on June 14. This year we encouraged our vendor, PLM, to treat before July 4th whereas in 2020 the treatment was done after July 4th. Our goal is to make the Bay look good by the 4th, and it did look better this year with the earlier treatment. Going forward we will encourage treatment by the 4th. Whether they can treat or not does depend on several factors like wind, water temperature and when the milfoil starts growing. This year we treated 11-1/2 acres, last year 6-1/2 acres, and in 2019 37 acres. The acreage treated does fluctuate from year to year, and the variability makes it difficult to budget for treatment the next year. Even though our treatment area doubled this year, our costs went up only about 20%, or about $1,000. That is because our applicator used a combina- tion of ProcellaCor and Diquat. ProcellaCor is a powerful, focused herbicide that is specific for milfoil and very expensive, while Diquat is a broad-spectrum herbicide that is much less expensive. There are about 30 different varieties of plants in our Bay. As long as we can keep the native plant diversity in our Bay, the DNR will allow us to use Diquat. We want to continue to use it to keep our costs lower. 3 10/4/2021 Each year in August we must also have a Point Intercept Survey that maps all of the existing weeds by location and type. What’s important for the Board is how much milfoil is left after the treatment, which this survey indicates. The CLP that is left after treatment has naturally died back by the time of the survey in August, and is gone. The survey showed there was 15% occurrence of milfoil (i.e., 85% reduction) left after the treatment, which is pretty good. Our goal is to be at 20% or less. Last year there was 11% occurrence and 3% in 2019. Kennefick interjected that to control the CLP we use Diquat in May, which kills some of the milfoil early on. However, as mentioned earlier, if after seven years we don’t have to treat for CLP, it may mean more milfoil to treat. In all of North Arm Bay, three years ago, the DNR allowed PLM to use another chemical, Fluridone, also known as So- nar A.S. As a result of that treatment, they now have no milfoil. North Arm was approved for Flu- ridone because it is an enclosed bay. Carman Bay is an open bay and for that reason would not be approved for this treatment by the DNR. There is some discussion about the whole Upper Lake be- ing considered as one entity and using the Fluridone chemical to treat all of it. That would be more economical, and would likely eliminate milfoil for a period of time. There was an open discussion with homeowners about options for them for native aquatic weed control. B. Proposed 2022 budget Treasurer Kennefick presented the budget for 2022 (see attached “2022 CBLID Budget Report”). Our goal is to have a $70,000 annual carryover. When we looked at the estimated carryover from 2021 and estimated what our expenses may be next year, using a higher but reasonable amount for treatment, the Board feels that we can reduce the property assessment from $300 to $200 per prop- erty for 2022, then at the end of 2022 we should still be within the range of our goal of a $70,000 cushion. We want to maintain that level going into the future. This proposed budget does not in- clude a DNR Grant, as we cannot count on it. If all goes well next year, if our income is up with a grant, and our expenses lower, we may propose lowering the assessment even more. We want to be cautious, as we could have a bad year or have to deal with Starry Stonewort, which is expensive to manage. Other invasive species in our lake, but not in our bay at this time, are Flowering Rush and Purple Loosestrife. It is also unknown what other invasives we may face in the future. Nielsen stated the worst situation would be to not have the funds available to fully treat the bay. The Board is trying to be judicious with the funds, only spend what it costs to treat but not cut cor- ners on treatments. In a new development, the Lake Minnetonka Association (LMA) is in the pro- cess of forming an advisory committee to look at the overall lake management and study the inva- sive and native weeds, with the goal of developing an overall Lake Minnetonka management plan. Proposed 2022 Tax Assessment Nielsen stated that the Board supports a 2022 tax assessment of $200 for 112 properties. The purpose of this action item is to close out the contract for the Tonkawa Phase II Forcemain Replacement Project (21-021) 2. Background. On November 23rd, 2020 Council approved the design and engineering of the Tonkawa Phase II Forcemain Replacement project. On March 8th, 2021 Council awarded the project to GM Contracting. The work was completed in June. However, during construction we discovered the forcemain was not in the location identified on the recorded drawings. As a result the contractor had to spend a considerable amount of labor and equipment time to locate them. Once located the method of replacement had to be changed to avoid potential damage to other infrastructure in the right of way. On August 23rd Council approved change order #1. The project is now complete and all of the close out paperwork has been received. 3. Project Scope of Work. The projects consisted of replacement of 1,105 feet of 6 inch forcemain that leads from Lift Station #28 on Park Lane to the end of the Phase I project on Tonkawa Road. 4. Cost. The final pay request is for $13,087.42. The total contract cost will be $261,748. 5. Funding. Funding for the project comes from the Sewer Fund. The City of Orono is partnering with the Orono Youth Hockey Association to create a dedicated hockey rink on a portion of the Casco Point Skating Rink. The hockey association will be providing the boards to create a 50’x100’ rink, as well as maintenance on the skating rink. Lighting was requested for the entire skating rink to extend its use after dark. 3. Project Scope. Six 25’ utility poles will be installed with LED lighting attached. The lights will extend beyond the hockey boards and will provide light to the entire skating rink 4. Cost. Parks received quotes from two contractors for installation. A summary of the quotes received are listed in the table below. The lowest quote was from Holton Electric at $20,215. Frost conditions may increase the quote by an estimated $5000. They are as of the end of September which represents 75% of the year. Revenues are currently at 74.2%% of budget with expenditures at 74.5% of budget. General Fund Revenues At 70.3% of revenues the City is currently on pace to meet revenues for the year. For comparison purposes, 2019 revenues at the end of the 3rd quarter were 71.4% and finished the year at 101% of budget. Tax revenues are at 53.1% of budget compared to 48.8% last year. Other revenue categories are also trending positively. Building permit revenues are currently at 84.5%; the Licenses and Permits category as a whole is at 83.6%. Golf Course Revenue is following up a record year in 2020 with another excellent year and are at 189% of budget compared to 187% in 2020. For Other Government Revenue, the City is only at 15% compared to 161% in 2020. This is due to the CARES Act grant that was received in July 2020. Since the end of the quarter, we have received our Police State Aid allocation of $231,000 which will bring the category over 100%. Other revenue categories are on pace to be at budget levels. Revenues are estimated to finish the year around 101% of budget. General Fund Expenditures At 74.5%, the overall expenditure amounts are running a little higher than in the past years and will likely end the year over budget. Although some adjustments have been made, the expenditure statement should be view as non-adjusted. Two departments are currently over budget for the year. The first one is Engineering; with the overage being in large part to an unbudgeted expenditure of $10,000 to survey Big Island and locate suitable dock sights. The second is the Golf Course, but as discussed in the revenue section, revenues for the course remain well above budget and will offset the overage in expenditures. A few departments are currently over 75% of budget. Assessing is at 98% of budget, there will be no only minimal addition expenses recorded and the department is expected to be around Budget Update October 21, 2021 Page 2 100% of budget. The Police Department is currently at 77% of budget. The expenditures include $165,000 for the camera systems approved by the council earlier this year. Some of these costs will be paid out of the PIR account so the department will finish the year at budget. Building and Zoning is also currently at 77% of budget. Expenses related to the outsourcing of the Building Official will likely push this budget over 100%. Even with the projected overages in some departments, the expenditure budget is projected to be at 100% or lower at the end of the year. General Fund Summary In summary, the overall General Fund budget is looking good through the 3rd quarter. Revenues are on pace to exceed budgeted amounts. Expenditures at 74% of budget are higher than last year’s 3rd quarter numbers but should be at budgeted levels at year end. Background The city purchased 365 Old Crystal Bay Road for a new public works facility in 2020. A comprehensive plan amendment (LA21-000006) was approved in April 2021 that added the site into the Metropolitan Urban Service Area, allowing for sanitary sewer access. In September 2021 the City Council waived Planning Commission review, electing to hold required public hearings at the City Council level (Exhibit D). The building is long, with a drive through garage on the west side of the building, and offices, meeting rooms, rest rooms being located in a shorter building on the north side of the garage. The final design of the building has not been established, in terms of building materials, colors, etc. Two variances are required to construct the building as presented. They include a variance from the side yard (north) setback line. The building is proposed to be setback 23 feet from the north side lot line, where 30 feet is required for RR-1B zoning. While the property to the north is owned by MnDOT, it is not considered Right of Way. The other variance required is to the building height. The defined height of the building is 36’ where 30 feet is the maximum. The garage exceeds the 30 foot limit, in part due to the significant slope of the lot (it drops 21 feet in the span of the building length), and the need for high ceilings for the over-head crane and other equipment. The proposed use, municipal buildings, are a permitted use in the RR-1B zoning district. No conditional use permit is has been identified. Planning Staff Practical Difficulty Analysis: Regarding practical difficulty, Staff finds a practical difficulty exists due in part to the slope of the lot and the length of the building. Perhaps the strongest argument for the height variance is based on how defined height is calculated. The height is based in on the lower of the highest existing grade (1023) or 10 feet above the lowest existing grade (1002+10=1012). The 1012 elevation is located in the back 1/3rd of the building. At the street, or at the front of the building, the height will appear as 25 feet (2 stories). The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause practical difficulties because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Economic considerations alone do not constitute practical difficulties. Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. §216C.06, subd. 14, when in harmony with this chapter. The board or the council may not permit as a variance any use that is not permitted under this chapter for property in the zone where the affected person's land is located. The board or council may permit as a variance the temporary use of a one-family dwelling as a two-family dwelling. According to MN §462.357 Subd. 6(2) variances shall only be permitted when: 1. The variance is in harmony with the general intent and purpose of the Ordinance. The intent of the ordinance is to reduce massing with principal structures too close together, and to regulate massing with tall buildings. Neither of these goals will be challenged with the variance. The north property line is a boundary with undeveloped MnDOT FILE # LA21-000068 October 25, 2021 Page 3 of 4 property, adjacent to a drop off for Hwy 12 and a rail corridor. The building height as defined reflects the drop off of slope toward the west end of the building. From the street, the building will appear conforming. 2. The variance is consistent with the comprehensive plan. The use of the property is a permitted use in the RR-1B zoning district. 3. The applicant establishes that there are practical difficulties. a. The property owner proposes to use the property in a reasonable manner not permitted by the official controls; In the site design, the goal was to shift the building as far away from neighboring residential parcels to maximize screening. To maximize the southern setback, the northern setback was reduced. The building height is necessary for the internal workings of the building (large truck lifts, storage) and due to the substantial slope of the lot from east to west. b. There are circumstances unique to the property not created by the landowner; The unique design of the lot, both from its long narrow shape and slope of the lot are unique to the property and not created by the landowner and c. The variance will not alter the essential character of the locality. The height variance and the setback will not be discernible to the general neighborhood. Most of the work on the site will occur in the west and north sides. Additionally City Code 78-123 provides additional parameters within which a variance may be granted as follows: 4. Economic considerations alone do not constitute practical difficulties. Economic considerations have not been a factor in the variance approval determination. 5. Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. § 216C.06, subd. 17, when in harmony with Orono City Code Chapter 78. This condition is not applicable. 6. The board or the council may not permit as a variance any use that is not permitted under Orono City Code Chapter 78 for property in the zone where the affected person's land is located. This condition is not applicable, as a municipal building is a permitted use in the RR-1B District. 7. The board or council may permit as a variance the temporary use of a one-family dwelling as a two-family dwelling. This condition is not applicable. 8. The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property. The long, narrowness of the lot, coupled with significant slope of the property are unique to the lot. 9. The conditions do not apply generally to other land or structures in the district in which the land is located. The use of the property for a municipal building is unique to the property and the district. 10. The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant. The public works nature of the building requires flexibility from standard zoning regulations which were developed primarily for residential uses. 11. The granting of the proposed variance will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter. The reduced north side setback and height variance will not impact neighboring properties in these ways, as there are no neighbors to the north (nor will there ever be), and the height issue is caused by the significant drop in the lot. The plans reflect minimal amount of variance necessary to meet use requirements of the site while minimizing impact to neighboring properties. The Commission may recommend or Council may impose conditions in granting of variances. Any conditions imposed must be directly related to and must bear a rough proportionality to the impact created by the variance. No variance shall be granted or changed beyond the use permitted in this chapter in the district where such land is located. Public Comments. To date, one written comment has been received, attached as Exhibit C. The author opposes the use of the property for the public works facility. Issues for Consideration 1. Does the City Council find that that the property owner proposes to use the property in a reasonable manner which is not permitted by an official control? 2. Does the City Council find that the variances, if granted, will not alter the essential character of the neighborhood? 3. Does the Council find it necessary to impose conditions in order to mitigate the impacts created by the granting of the requested variances? 4. Council Exhibit B LA21-68 From:Bill Bruning To:Jeremy Barnhart Cc:Denny Walsh; Adam Edwards Subject:LA21-000068 / Maintenance Facility Proposal Date:Wednesday, October 13, 2021 7:46:20 PM Attachments:image002.png Hello Mr. Barnhart, When Orono offered our neighborhood to MnDOT for the construction of the highway 12 bypass, it was the path of least resistance. 365 Old Crystal Bay Rd., site of the proposed Orono maintenance facility & fire station, was used for years as a ramp for thousands of trucks hauling dirt from the highway excavation, as well as an encampment for MnDOT workers and equipment delivery. Hundreds of trees were eliminated, the train tracks were moved closer to our home and two of our former neighbor’s properties were used as MnDOT dump sites / see pictures attached below. The City of Orono mislead us before we purchased our home 27 years ago by showing us four proposed MnDOT routes for the highway 12 bypass, not the fifth route approved nine months later. With our property immediately devalued, we were financially unable to move. MnDOT told our neighborhood that it didn’t warrant the expense of noise mitigation and advised us that we would get used to the noise. Orono’s then mayor advised us not to upset MnDOT. It’s now been 15 years of highway noise and increased train noise 24-7-365. Orono now wants to continue the demise of our neighborhood with the construction of a maintenance facility. When Orono took a portion of our property for a path along Old Crystal Bay Rd., as a good will gesture we did not file lawsuits as other neighbors had. When MnDOT did the pile driving for the second of two OCBR bridges, it cracked our garage floor apron but refused responsibility ($2,500 / cost to us for repairs). My Orono property taxes contributed to the $2 million purchase price of Big Island to which I have no access. Perhaps Orono could, as a good will gesture, now recognize what we’ve had to tolerate and choose a different site for this maintenance facility. Each year the city certifies to the county, all unpaid annual service charges for the septic program, the recycling program, and all delinquent sewer and water accounts of $50.00 or more, to be collected with the following year's taxes. In addition to the outstanding amounts delinquent, eight percent (8%) interest and an administrative fee of $25.00 are added to all accounts. At this time, the total to be assessed is $102,771.62 between 132 properties. This amount will be decreased by any payments received up to the final payment date of November 29, 2021. A copy of the assessment roll is attached for your review. 3. Public Hearing. State statutes require the City hold a public hearing regarding the assessment of these fees prior to certifying the assessment roll to the County. Notices of the public hearing have been sent to all delinquent properties. The hearing is an opportunity for property owners to ask questions and provide comments regarding the proposed assessment. 4. Staff Recommendation. The selection process for the vacant position will involve advertising the position, application screening, an interview panel, and reference checking. This position will require the use of a variety of equipment and tools. Occasional help may be required for public works and the golf course. Supervision Received and Exercised This position is supervised by the Parks and Golf Superintendent. This position will periodically provide supervision and oversight to crews of seasonal or part time park maintenance workers. Examples of Work Essential functions listed below are intended as illustrations of the various types of work that may be performed. Carlson Approved By: 1. Purpose: To gain approval for the 2022 health insurance plan for employees. 2. Background: In May of 2020 the City left the LOGIS health insurance pool to seek opportunities to provide quality benefits at a more reasonable cost for city employees. In 2021 the City selected had Health Partners as an insurance provider with the result of a slight decrease in premiums. However, the renewal rate for Health Partners in 2022 reflects an increase of 25% over the 2021 rate. This would have real dollar impacts to both the city budget and our employees’ personal finances. Since we were notified of this increase a few weeks ago, we have engaged a new insurance broker and had them provide us quotes on other carrier options. The Public Employees Insurance Plan (PEIP) came in as the most cost effective option at an overall increase over our current plan of ~ 3.4%. These are averages as the specific impact depends on the individual plan (employee, employee/spouse, employee/children, and family). 3. Funding: The City currently allocates $915 towards single employee contributions and $1472.50 towards family employee contributions. The contribution for single coverage will remain at $915. Based on union agreements, the family contribution is increased in an amount equal to 50% of the increase in family coverage. While the overall increase is 3.4%, the family coverage is increasing by 17%. The City contribution for family insurance in 2022 will increase to $1627.25. 4. Staff Recommendation: Staff recommends approval of PEIP as the medical plan for City employees in 2021 and 2022.
