A RESOLUTION
EXTENDING THE EFFECTIVE PERIOD
OF GENERAL CONCEPT PLAN APPROVAL
FOR ORONO AMBAR LLC AT 2060 WAYZATA BOULEVARD
AS GRANTED IN RESOLUTION NO. 4619
WHEREAS, on March 12, 2001 the Orono City Council adopted Resolution No.
4619 granting General Concept Plan Approval for property located at 2060 Wayzata Boulevard;and
WHEREAS,Condition 6 of Resolution No.4619 states that the approval granted by
said resolution will be effective for a period of 6 months after adoption, and if Development Plan
and Final Plat Approval are not completed within 6 months, the terms and conditions of said
Resolution become null and void,unless the City Council grants an extension to the effective period;
and
WHEREAS,the Developer has not been able to complete the Development Plan and
Final Plat Approval due to circumstances beyond his control in relation to the intended HUD
financing associated with the project.
NOW,THEREFORE,BE IT RESOLVED that the General Concept Plan Approval
granted in Resolution No. 4619 on March 12, 2001 is hereby extended an additional 6 months to
March 12, 2002.
Adopted by the City Council of Orono, Minnesota this 27th day of August, 2001.

The City Council granted General Concept Plan Approval for the Dunbar senior housing and office
building proposal via Resolution#4619 on March 12,2001. That approval is effective for 6 months
from the date of adoption, and will expire on September 12 if not extended. Completion of the
approval process has been delayed due to circumstances beyond the developer's control in relation
to the HUD financing. It would be appropriate to extend the General Concept Plan Approval for
an additional 6 months, although it appears that this project may be scheduled for final approval
sometime in October.
COUNCIL ACTION REQUESTED
Motion to adopt the attached resolution extending the effective period of General Concept Plan
Approval for Orono Ambar LLC for a period of 6m months.

1. RESOLUTION OF THE CITY COUNCIL

5. This General Concept Plan approval resolution approves the development concept
subject to the applicant meeting the requirements of this resolution and all other
requirements of the City. This resolution does not constitute approval of the
Rezoning or Comprehensive Plan Amendment. This resolution does not constitute
Preliminary Plat Approval. Such approvals shall only be considered when the
City Council finds that all "Conditions for Development Plan and Final Plat
Approval" as identified herein have been met.
6. This Conceptual Approval shall be effective for a period of 6 months from the
date of this resolution. If Development Plan and Final Plat Approval is not
granted within that period, the terms and conditions of this resolution shall be
null and void. The City Council at its sole discretion may extend this effective
period.
7. The undersigned applicants have read and reviewed this document.
