Wayzata Blvd. (Orono Senior Housing) Phase 1 grading permit. Terms and Conditions of Permit 1. This permit is subject to the terms and conditions of the PUD 2B Agreement,a copy of which is attached hereto. 2. Permit approval is based on the approved Site Plan(Sheet C2-1, latest revision 12-17-01) and the approved Grading/Drainage/Erosion Control Plan (Sheet C3-1, latest revision 12- 17-01) and is subject to ongoing review and site inspections by the City. Any changes to plans require City approval. 3. Orange silt fence shall be installed and maintained in place and in functional condition at all times, subject to Minnehaha Creek Watershed District requirements. 4. Tree removal shall occur only within the limits established by silt fencing as shown on the approved plans. 5. In the event that site activities result in spillage of fill materials on adjacent roadways, contractor shall be responsible for maintaining area roadways in a clean condition on a daily basis or as may be required by the City. 6. In the event that excess fill is to be hauled off-site, be advised that any location in Orono to be receiving such fill must first have obtained the appropriate permits from the City (more than 500 cubic yards to any single receiving site requires a 60-day conditional use permit review process). 7. This permit covers only the Phase 1 Improvements as listed in the attached Phase 1 Site Grading Cost Estimate. A separate permit will be required for the Phase 2 Improvements which include all work shown on the attached Phase 2 Utilities and Street Improvements Cost Estimate. 8. THIS PHASE 1 IMPROVEMENTS PERMIT WILL BE REVOKED IF THE PHASE 1 LETTER OF CREDIT IS NOT RECEIVED AT THIS OFFICE BY 4:30 P.M. ON WEDNESDAY, DECEMBER 26, 2001. IF THIS PERMIT IS REVOKED, THE CITY WILL ORDER ALL WORK AT THE SITE TO BE STOPPED BEGINNING AT 8:00 A.M. ON THURSDAY DECEMBER 27,UNTIL THE LETTER OF CREDIT IS RECEIVED AT WHICH TIME THE PERMIT WILL BE REINSTATED. 9. Commencement of the Phase 2 (Utilities and Street) Improvements may not commence until a Phase 2 Improvement Permit is issued, which we anticipate will be in the spring of 2002. Such permit will not be issued until the Phase 2 Letter of Credit is received. 10. This permit does not cover the following activities which require separate permits: - Foundation and building construction - Utility connections to building - Building systems (plumbing, mechanical, electrical, etc.) Sheet 1 of 4 11. Construction trailer is approved to be located near the northeast corner of the site. Any temporary lighting shall be directed away from adjacent properties. 12. Do not commence site grading or improvements until all other agency permits have been obtained (Mn/DOT, MCWD, etc.). 13. Applicant is advised that City will coordinate with the developer prior to commencing burial of existing power lines, installation of street lighting along Brown Road and Highway 12, and other off-site improvements for which the City is responsible. 14. Hours of construction activity(use of power equipment) limited by Orono Ordinance 155 to between the hours of 7:00 a.m. and 8:00 p.m. weekdays and 8:00 a.m. to 8:00 p.m. on weekends and holidays.
