I (reserved for recording information) DECLARATION OF EASEMENT THIS DECLARATION OF EASEMENT is made this --(a day of Au k u % r_, 2015, James D. MacKinnon and Pamela A. MacKinnon, husband and wife, and Catharine A. MacKinnon, a single person, and Leonard D. MacKinnon, a single person ("Declarants"). WHEREAS, Declarants are the fee owners of land located in Hennepin County, Minnesota (the "Property"), legally described as follows: Outlot D, Kintyre Two, Hennepin County, Minnesota WHEREAS, Declarants have marketable title to the Property, free and clear of all liens, mortgages, encumbrances; and WHEREAS, Declarants have platted the Property into a subdivision entitled Kintyre Two; and WHEREAS, as a condition of approval of the plat for Kintyre Two by the City of Orono, Declarants are required to dedicate this easement; WHEREAS, Declarants desire to create, impose and grant a perpetual easement for public access; NOW, THEREFORE, Declarants hereby state and declare: 1. Grant of Easement. Declarants hereby declare and create: (a) perpetual, non- exclusive easement over the Property for the benefit of the public, for access over, under and across the Property ("Easement Area"); and (b) a perpetual; non-exclusive easement over the Property for the benefit of the City for (i) public ingress, egress and access; (ii) road, drainage and utilities purposes and uses, including the right to construct an maintain the same, including but not limited to a full and free right and authority to enter upon the Easement Area to construct install, maintain, operate and repair the road or utilities, and any and all appurtenances, including drainage control structures, incidental and related thereto; and (iii) ingress and egress over the Easement Area :For inspection by the City of any portion of the Easement Area, animal control, snow removal, :maintenance, repair and replacement of the road or utilities on the Easement Area, and exercise of any rights or remedies granted to the City by this Declaration or any future amendments or easements. 1 2. Maintenance. The road and utilities within the Easement Area are intended to be treated as private road and utilities subject to homeowner association ownership and maintenances. The City has no obligation to maintain or service the road or utilities located within the Easement Area. City. 3. Perpetual Duration. The duration of the Easement is perpetual. 4. Amendment.
