Dear Ms. Heine:
The Commission is in receipt of Northern States Power January 18, 2013 compliance documents and
February 8, 2013 Updated Plan and Profile documents filed in accordance with the Orono Substation
Expansion and New 115 kV Transmission Line Project Route Permit (issued April 6, 2013).
The Department of Commerce Energy Facilities Permitting staff(DOC EFP) reviewed the Plan and Profile,
as well as the other submissions, relative to the permit conditions and provided the Commission its
recommendations on February 7, 2013. DOC EFP stated that the Plan and Profile and other filings are in
accordance with the permit and all permit conditions, with exceptions. In a February 8, 2013 supplemental
filing,the permittee addressed the exceptions raised by the DOC EFP.
Based on the review of submissions, including the January 15, 2013 supplement provided by the Permittees,
Commission staff has advised me, and I agree, that the Permittee's Plan and Profile filings in this matter
indicate compliance with the terms and conditions of the route permit.

Dear Mr. Rogers and Ms. Steinhauer:
As the attorney for Michael and Leena Kallivayalil, please consider this letter as a formal
request by the Kallivayalils for consideration by Xcel and the Minnesota PUC of the
Kallivayalils' request for an improvement of the electrical transmission pole locations and the
berm adjacent to their property.
As Mr. Rogers is aware, the Kallivayalils made a written proposal to Xcel by letter dated
June 6, 2012 for the extension of the berm between Xcel's new substation and the Kallivayalils'
property, in conjunction with the suggested realignment of a GRE wooden transmission line pole
(to eliminate the "dip" in the then planned berm) (copy is attached for your reference). Xcel
chose, however,not to make those modifications to its plans.
Xcel has proceeded to construct the aforesaid berm with the "dip" to accommodate what
GRE apparently seeks for line-to-ground clearance for its transmission line—Xcel has also
constructed its new steel tower (Structure 076-4) for its new 115 KV line (approximately 120
feet from the intended location) as stated in Mr. Rogers' May 7, 2013 letter to the Huntington
Farm Homeowners' Association Members. Attached is a photograph of what the Kallivayalils
presently see from their bedroom window, including the incorrectly located Structure 076-4 on
the left-hand side of the photograph.

Inasmuch as Xcel has now acknowledged the necessity of relocating Structure 076-4
(from its present location depicted as "1" on the attachment 3 hereto to the indicated new
position), the Kuruvillas reiterate their request that Xcel at the same time realign GRE's
transmission line from its present position(depicted as"2"to "3" on attachment 3 hereto).
It appears that with the relocation of Structure 076-4, the GRE transmission line can
easily pass below Xcel's new 115 KV line (while maintaining proper clearances) so that GRE's
wooden pole can be relocated as indicated in the attached sketch. The relocation of GRE's
wooden pole would then permit Xcel to complete the berm, as previously requested by the
Kallivayalils, without the "dip" that presently prevents effective screening of Xcel's new
substation and transmission line/poles from the Kallivayalils' property. By relocating GRE's
wooden pole structure, and eliminating the "dip" in the berm, tree planting could also be
extended to the end of the berm, thereby increasing the screening effect of the berm; 3 rows of
evergreens approximately 5 feet apart on top of the berm is suggested.
In view of the devastating effect that the presence of Xcel's new substation and new 115
KV line has upon the market value of the Kallivayalils' adjacent property, the Kallivayalils'
present proposal to lessen that negative impact of those structures is eminently reasonable.

Dear Mr. Rogers:
Pursuant to the Minnesota Public Utility Commission's ("PUC") April 6, 2012 permit for
the above-referenced substation replacement, and Xcel Energy's letter of May 2, 2012 to
"Property Owners," we are submitting this letter and the attached graphic depictions for Xcel
Energy's consideration.
As you are no doubt aware, we have opposed Xcel Energy's plans to expand its
substation next to our backyard, consistently since Xcel Energy announced those plans. I will
not unduly add to the length of this letter by reciting our previous concerns and opposition to
Xcel Energy's plans. Suffice it to say that we firmly believe that Xcel Energy's present plans to
expand its substation are completely out of step with the residential character of the area, and
will significantly reduce the market value, as well as our own enjoyment, of our home.
Having again stated our opposition to Xcel Energy's present plans, we do want to thank
you and the other representatives of Xcel Energy for the courtesies that you have shown us in
communications such as last month's public meeting at the Orono City Hall. We do understand
that you and the other employees of Xcel Energy are merely doing your job, and we certainly do
not have any animosity to any of you personally.
Assuming that Xcel Energy proceeds with its ill-advised decision to replace the existing
small substation with a new and greatly expanded substation next to our backyard, we
respectfully request that Xcel Energy utilize the "Option 3"that it presented at the May 15, 2012
public meeting, but that the "screening" berm actually be higher. In an effort to illustrate what
we are referring to, we are attaching herewith a copy of Xcel Energy's "VIEWPOINT 2" of
"Option 3" (taken from our backyard) in which we have added a black line for the approximate
location of what we request as the "Berm Top." This "Berm Top" would essentially extend the
existing County Road 6 berm (at the same approximate height as the existing County Road 6
berm) past Xcel Energy's proposed new substation, and would provide a "screen" of the new
ground structures from our backyard (although obviously even this berm would not screen the
pole structures in the new substation from our backyard, nor would even this berm screen the
ground structures in the new substation from our view from either the main floor or the upper
floor of our home).
From the discussion that took place at the May 15, 2012 public meeting, I understand that
Xcel Energy is concerned about the height of this berm, and the trees or shrubs located near the
top thereof, because of the placement of GRE's electrical line. We believe, however, that
concern can be alleviated by realigning GRE's line in the position of the "GRE Replacement" in
the attached graphic from Xcel Energy's "Grading & Landscape Option 3" (in which we have
added a black line showing the possible realignment of GRE's line with the notation "GRE
Replacement." This realignment would place the new pole for the GRE line north of the new
berm, with the GRE line being carried to the new pole in the vicinity of the northeasterly portion
of Xcel Energy's site which Xcel Energy already has in its plans. This proposal would actually
eliminate the need for one new additional pole (would need only 3 poles instead of the 4 poles
that it shows now), possibly shortening the length of the line. This realigned GRE line also
would not have to cross the berm thus removing any concern regarding the height of the berm or
the trees on it with regard to GRE's line crossing it.
We believe that the proposal for heightening the berm that is contemplated in Xcel
Energy's "Option 3" is eminently reasonable. Even this heightened berm would not, however,
completely eradicate the detrimental impact of Xcel Energy's proposed new substation upon our
property, but it would at least be a better situation than we are presently facing.
By submitting this letter and the attached graphics to Xcel Energy, we are by no means
agreeing with, or consenting to,Xcel Energy's proposed new substation.

Huntington Farm Homeowners'Association Members,
Last week, it was discovered that the as-built location for structure 076-4, the first new
transmission pole north of the substation on Xcel Energy substation property was constructed
approximately 120 feet further north than intended and has resulted in inadequate operating
clearance to the GRE 69 kV Line as constructed. A map indicating details is attached for
reference.
In order to place the structure where it was designed and intended to be constructed, Xcel Energy
crews will construct a new concrete drilled pier foundation in the correct location on Xcel Energy
property, move the steel pole to the new foundation, re-string conductor and shield wires to the
substation termination structure. The remaining foundation will be removed to below grade and
the surface area will be filled and restored.
The new foundation and pole will be placed approximately 120 feet south of its current location
and in compliance with the plans submitted to the Minnesota Public Utilities Commission on
January 18, 2013 with updates provided on February 7 and March 22, 2013. A copy of these
plans is attached for reference.
Construction for the new transmission line on Huntington Farm Homeowners'Association
property has been completed except for the removal of access mats, clean up and turf
restoration, which is expected to be completed within the next 2 weeks.
Access mats will remain in place on Xcel Energy substation property until the pole replacement
work is completed sometime in the next 4-5 weeks.

New 115 kV Transmission Line Project

The Commission is in receipt of the May 8, 2013 and June 21, 2013 correspondence from Xcel
Energy regarding the misplaced structure nearest the Orono Substation.
The following document was submitted in accordance with the Project Route Permit:

misplaced structure.
On May 8, 2013, Xcel Energy informed the Commission that the first new transmission
structure north of the Orono Substation (denominated as Structure 076-4) was constructed
approximately 120 feet further north than intended. The May 8th letter informed the
Commission that, Xcel Energy would investigate options for resolving this issue and would
seek input from neighboring landowners on their preferences.
On June 21, 3013, Xcel Energy filed a letter with the Commission that explained how the error
occurred and described procedures for reducing the potential for this type of error to occur in
the future. The filing also described several alternatives to resolve the issue, identified Xcel
Energy's preferred resolution of the error, and summarized the input Xcel had received from
neighboring landowners
After reviewing the June 21, 2013 filings, the Department of Commerce Energy Facilities
Permitting staff stated that Xcel Energy's preferred option of moving structure 076-4 to the
location shown in the January 18, February 7, and March 22, 2013 plan and profile documents,
is the option that best ensures consistency with the project record and compliance history, best

addresses operational and safety issues, and provides the least disruptive long-term resolution
to area landowners.
Based on the review of submissions, Commission staff has advised me, and I agree,that moving
structure 076-4 to the location shown in the original plan and profile documents, is the best
option for addressing the error of the misplaced structure.
