The Complaint Procedures for High Voltage Transmission Lines attached to the route permit require that Xcel Energy submit a summary of all complaints received or resolved concerning Permit conditions for the project by the 15th of each month. No complaints have been received by Xcel Energy regarding this project during the month of December. The following documents were submitted in accordance with the HVTL Route Permit: Filing Permit Description e-Docket Document Date Filed Number Section(s) Number 1 4.1 Proposed resolution of 20136-88382-01 June 21, 2013 misplaced structure. Misplaced Structure on 115 kV Transmission Line On May 8, 2013, Xcel Energy informed the Commission that the first new transmission structure north of the Orono Substation (denominated as Structure 076-4) was constructed approximately 120 feet further north than intended.' The May 8th letter informed the Commission that, on advice of EFP staff, Xcel Energy would investigate options for resolving this issue and would seek input from neighboring landowners on their preferences. On June 21, 3013, Xcel Energy filed a letter with the Commission that: • explained how the error occurred and described procedures for reducing the potential for this type of error to occur in future projects; • described several alternatives to resolve the issue and identified Xcel Energy's preferred resolution of the error; and • summarized input Xcel had received from neighboring landowners.2 Section 4.1 of the Route Permit requires the permittee to file plan and profile information, including transmission structure specifications and locations shown on a map. With regard to changes in project design occurring after submission of a plan and profile, this section of the permit states: If the Permittee intends to make any significant changes in the plan and profile or the specifications and drawings after submission to the Commission, the Permittee shall notify the Commission at least five (5) days before implementing the changes. No changes shall be made that would be in violation of any of the terms of this permit. Xcel Energy,eDocket ID: 20135-86838-01 z Xcel Energy,eDocket ID: 20136-88382-01 M Plan and Profile Guidance for Transmission Lines, issued by the Department in 2012,3 provides further detail on how Plan and Profile documents are to be submitted. Among other guidelines, permittees are directed to provide copies that are signed and dated by a professional engineer. The intent of this requirement is to ensure that structures are placed in locations consistent with project design. In its June 21St filing,Xcel Energy has explained that the mistake was the result of confusion resulting from multiple sets of location coordinates. Apparently this particular structure was staked and constructed using coordinates resulting from a preliminary location, rather than the coordinates from the location shown on the plan and profile.According to the filing of May 8, 2013,the error was not noted until a clearance issue with GRE's 69 kV line was identified. As a result of the mistake, Xcel Energy failed to comply with the requirement in Section 4.1 of the Site Permit that the permittee notify the Commission of changes from the plan and profile filed with the Commission. To reduce the likelihood of a similar incident in future construction,Xcel Energy states that the company has implemented new control procedures including exclusive naming conventions for each set of coordinates to better differentiate final coordinates and additional QA/QC reviews by multiple groups to verify construction coordinates are consistent with locations shown on the plan and profile. The June 21st filing introduced four possible remedies for the mistake: I. Moving structure 076-4 to the location shown on the plan and profile filed with the Commission; 2. Leave structure 076-4 in its current location and lower the insulators on the GRE 69 kV line to create adequate clearance between the 115 and 69 kV lines; 3. Request that GRE discontinue use of the 69 kV line; or 4. Leave structure 076-4 in its current location and add two additional tangent structures just outside the substation to lift the conductors to create adequate clearance between the 115 and 69 kV lines. After reviewing the options internally and with landowners from Huntington Farm Home Owners' Association, Xcel Energy states that its preferred option is to move the structure to the location shown on the plan and profile. EFP Discussion and Recommendation Although this failure to comply with the condition of the permit appears to have been inadvertent,EFP staff finds the inattention to details such as structure location very troubling. EFP staff's understanding is that the signed plan and profile drawings are used in the field to ensure that the Project is built according to an approved plan. A difference of 120 feet between the constructed location and the planned location does appear to be the type of discrepancy that should be, if not prevented, at least discovered in a cursory"eyeball" inspection of the plan and profile drawings during the construction or cleanup process. EFP staff accepts Xcel Energy's explanation of the mistake and its proposed QA/QC review process going forward. Based on this instance, EFP staff would recommend a standard permit condition that a Construction& Environmental Control Plan be filed as a compliance filing for all transmission projects going forward. These plans have been required for larger project, such as the CapX 2020 projects. Xcel Energy has stated that moving the structure is the preference of local residents. In discussion with Mr. Michael Kallivayalil, the landowner nearest the substation and structure in question, Mr. Kallivayalil expressed to EFP staff that, with respect to the location of structure 076-4, his preference is that it be moved to the location shown on the plan and profile. EFP staff believes that Xcel Energy's preferred option, moving structure 076-4 to the location shown on the plan and profile, is the option that best ensures consistency with the project record and compliance history, best addresses operational and safety issues, and provides the least disruptive long-term resolution to area landowners. American Complaint? Engineering and Testing(AET) Nature of Mrs. Slaughter complained to AET on site after their soil boring rig left Complaint and some clumps of mud on her driveway when it entered to conduct borings applicable permit east of her property. Mrs. Slaughter also questioned whether Xcel Energy conditions: or AET had the right to enter upon her land and that no one had notified her in advance of entering. She was also initially unable to reach Xcel Energy as the contact information provided in the permit has changed. Activities taken Mr. Bonde informed Mr. Rogers who then called Jane immediately to to resolve: discuss and provide assurance that the mud would be cleaned up.AET crews raked and cleaned up all mud that was left on the driveway from the rig immediately after it was demobilized and on the same day the complaint was made. Mr. Rogers stated that a voice message was left at Mrs. Slaughter's home phone on October 9, 2012 that provided notification of AET's entrance in advance as well as Mr. Rogers contact information and a request for a return call. Mrs. Slaughter stated that she may have not checked or received the voice message and provided a cell phone number for future reference. Xcel Energy also sent a letter to all landowners affected by the project with representative contact information. Outcome: Mr. Rogers made a follow up call to Mrs. Slaughter on October 29, 2012 to ensure that she was satisfied with the clean up and to discuss future construction access for the transmission pole replacement. Mrs. Slaughter stated she was satisfied with AET's clean up of the driveway and also understood that the existing easement over her property included Xcel Energy's right to enter her property to replace the transmission pole. Mr. Rogers provided Mrs. Slaughter information on the types of equipment that would be used for this pole replacement and also informed her that Xcel Energy would be responsible for any property damages caused by the construction access. Haar Executive Secretary Minnesota Public Utilities Commission 350 Metro Square Building 121 Seventh Place East St. Paul,MN 55101 Re: Updated Plan and Profile for Orono Substation Replacement and New 115 kV Transmission Line Project Docket No. E002/TL-11-223 Dear Dr. Haar: Northern States Power Company (Xcel Energy), a Minnesota Corporation, obtained a route permit(dated April 6, 2012)to construct approximately 0.4 miles of new double circuit 115 kV overhead electric transmission line, relocate approximately 0.2 miles of Xcel Energy's existing 115 kV transmission line 0831, and replace Xcel Energy's existing Orono Substation in the City of Orono, Hennepin County, Minnesota. Section 4.1 of the route permit requires that Xcel Energy submit to the Commission the plan and profile and specifications for right-of-way (ROW)preparation and restoration of the transmission line. Plan and profile drawings were submitted on January 18, 2012. DOC EFP staff contacted Xcel Energy regarding that filing and posted a Permit Compliance Filing Review to the docket earlier today indicating that the filing is incomplete and identified five items which required more detail or were missing from the original filing. This letter and enclosed updated plan and profile drawings address those issues identified in the EFP review. 1. Right-of-way preparation and restoration. Construction crews plan to access the ROW from Xcel Energy's Orono Substation Property. Preparation for construction of the line will include construction of a temporary ramp from the substation pad to reduce the angle of the slope for vehicles entering the ROW from the south. Poly mats will be installed on top of the ramp and along the access route to each structure location to allow tree clearing and construction equipment access without disturbing wetland soils. Construction pad areas will be matted around each structure location. Equipment will work from these mats for the duration of the project. When construction is completed the mats and temporary access ramp will be removed. The area under the ramp will be re-graded if needed and re-seeded with a wetland buffer seed mix which has been approved by the Minnehaha Creek Watershed District(MCWD). Vegetation crews will be clearing woody vegetation within the ROW that may interfere with or restrict safe construction and reliable operation of the transmission line. Clearing may be accomplished with mowers,hydraulic tree cutting equipment and/or ASV-mounted mulchers. Vegetation will be cut at or slightly above ground surface and roots or stumps will be left in place unless removal is needed to allow installation of mats and equipment access. Trees that are cut down will be removed and chipped outside of the wetland area. No chipped material will be placed within the wetland. Existing wood poles numbered 76,77,and 78 will be completely removed by cutting them into smaller segments and pulling the bases out of the ground. Guy wires on pole 77 will be removed and cut below grade and all material will be hauled off site for disposal. Any spoils created by installation of the new poles will be kept contained and will be removed from the site. Because construction will take place from mats during frozen ground conditions little need for restoration is anticipated. Any areas disturbed by construction activities will be restored to their original condition.This may include,but is not limited to,smoothing out ruts,re-seeding vegetation, and removal of spoils and construction spoils. Any exposed soils will be stabilized or re-vegetated according to the SWPPP and approvals from the MCWD. 2. Swan Flight Diverters. Swan flight diverters (SFD)were mistakenly left off of the original P&P drawings and have been added to the updated drawings. 3. Right-of-way Width. ROW width is more clearly identified on the updated P&P drawings. The existing and proposed ROW shown on the drawings is a 75 foot ROW. 4. Legend. Additional information has been added to the legend to identify areas identified on the P&P aerial views. 5. Structure 77 Height Change. Structure 77 was described in the permit application as being 70 to 90 feet tall. Since the time of permit application more detailed engineering work has identified that the structure needs to be 100 feet tall to address considerations of wire span,tensions,and conductor spacing to avoid clashing from potential weather-induced galloping. The documentation shall include maps depicting the plan and profile including the right-of-way alignment and structure in relation to the route and alignment approved per the permit. On January 18, 2013, Xcel Energy filed signed Plan and Profile drawings of the proposed transmission line. Xcel Energy has informed Department staff that it wishes to begin construction while the ground is frozen. Department staff has reviewed the filing and believes that it is incomplete in its current state. In the judgment of Department staff, additional material is required to ensure that the filing meets the intent of the permit: 1. Section 4.1 of the permit requires the permittee to provide information on right-of-way (ROW)preparation and restoration. Although the filing does indication the location and dimension of structures, information on right-of-way preparation and restoration is missing. Department staff has advised Xcel Energy that this requirement may be met with an addendum describing how ROW will be prepared and restored, including information on removal of existing poles. 2. As required in Special Condition 5.2, Swan Flight Diverters are to be installed at 25' intervals. This should be noted on the plan and profile sheets. 3. Right-of-way width should be identified on the satellite photos to ensure consistency with Section 3.3 of the permit. 4. A legend identifying the markings shown on the satellite photos should be provided. 5. An explanation should be provided for an apparent discrepancy between the height of Structure 077 in Section 2.3 of the permit (70 to 90 feet), and sheet NH-253583-15 in the filing (100 feet). Department staff has advised Xcel Energy staff of these issues and understands that Xcel Energy is working to provide additional information in a timeframe that allows construction to proceed during frozen conditions. Department staff also has advised Xcel Energy to submit paper and CD copies these with future Plan and Profile filings as required in the Compliance Filing Procedures attached to the permit. Report of Archaeological Survey On September 19, 2012, Xcel Energy filed a Report of Archaeological Survey, as required by section 5.4 of the permit. Department staff inadvertently overlooked this filing at the time it was filed, but has reviewed the documentation and has concluded that the documentation is in compliance with the terms and conditions of the HVTL Route Permit issued by the Commission in this docket. Recommendation Department staff will provide comments upon Xcel Energy's filing of supplemental information. In the opinion of Department staff, the additional material provided in the February 8, 3013, filing addresses the deficiencies of the earlier plan and profile filing. With respect to the structure 77, the permit, at Section 2.3 identifies a height of 70 to 90 feet for this structure. In the February 8, 2013, filing, Xcel Energy stated that more detailed post-permit design work identified the need for a taller (100 foot) structure to allow sufficient spacing between conductors to ensure that conductors do not come in contact in the event of weather- induced galloping. Department staff believes that this design change is consistent with Section ' Department of Commerce,Department Comments on Plan and Profile and Report of Archaeological Survey. February 7,2013. eDocket ID: 20132-83644-01 4.8.1 of the permit, which requires the Permittee to comply with the clearances, design, and construction practices outlined in the National Electric Safety Code. The Minnesota Department of Commerce, Energy Facility Permitting Staff has requested additional information regarding the minor alignment change to two structures that was included in the Plan and Profile drawings submitted on January 18, 2013. This letter addresses that change. The route alignment included in the Plan and Profile was adjusted slightly from the preliminary alignment shown in the Route Permit. This change was done to comply with Section 4.2.8 of Route Permit which states that structures should be located to span watercourses, wetlands and floodplains to the extent practicable. The adjustment included in the Plan and Profile involved eliminating the structure originally labeled 076-4 (new) in the attached map, which was located within the wetland, and shifting structure 076-5 to the southwest. Both of these structures are located entirely on Xcel Energy owned property north of the Orono Substation and within the permitted route width. Consistent with Section 3.1 of the Route Permit, this alignment modification reduces impacts compared to the preliminary design relative to the factors outlined in Minnesota Rule 7850.4100. Specifically, the modified alignment reduces impacts in the following ways: • Reduces overall impacts by eliminating one structure. Specifically, this change eliminates one foundation and structure from the wetland; • Shifts the right-of-way off of Huntington Farm Home Owners' Association property between structure 076-3 and 076-4 and onto Xcel Energy's property; and • Reduces overall cost by eliminating one structure and foundation. EFP staff reviewed the filing and in a February 12, 2013, letter to Executive Director Haar, informed the Executive Director that EFP staff believed information provided by Xcel Energy in the February 7, 2013, filing was consistent with the terms and conditions of the Route Permit.2 Section 3.1 of the Route Permit provides for alignment modifications within the approved route: Any alignment modifications within this designated route shall be located so as to have comparable overall impacts relative to the factors in Minnesota Rule 7850.4100 as does the alignment identified in this permit, and shall be specifically identified and documented in and approved as part of the Plan and Profile submitted pursuant to Section 4.1 of this permit. Although not specifically identified, the Plan and Profile filed February 7, 2013, includes an alignment modification from the preliminary alignment shown in the Route Permit. The alignment modification is within the permitted route. At the request of EFP staff, Xcel Energy provided additional information on the modified alignment in a March 22, 2013, filing. The March 22, 2013, filing compares the modification to the alignment shown in the map attached to the Route Permit and provides a summary of overall impacts relative to the factors in Minnesota Rule 7850.4100. By eliminating two jogs shown in the preliminary alignment attached to the route permit, Xcel Energy was able to eliminate one foundation from a wetland and maximize spanning of wetlands consistent with Section 4.2.8 of the Route Permit. The structure types and dimensions are consistent with the structures identified in Section 2.3 of the Route Permit. Although this alignment modification should have been specifically identified in the Plan and Profile filings, EFP staff believes that this modification is consistent with the permit and the information included in the March 22, 2013, filing completes the record pursuant to Sections 3.1 and 4.1 of the Route Permit. Construction on the new substation began in September 2012 and line construction began in February of 2013. Last week, it was discovered that the as-built location for structure 076-4,the first new transmission pole north of the substation on Xcel Energy substation property was constructed approximately 120 feet further north than intended and has resulted in inadequate operating clearance to the GRE 69 kV Line as constructed. A map indicating details is attached for reference. Neighboring landowners were notified of this issue on May 7, 2013. Xcel Energy is proposing to move the structure to the location that was approved in the Plan and Profile submitted to the Minnesota Public Utilities Commission on January 18, 2013 with updates provided on February 7 and March 22,2013. In order to do this crews would construct a new concrete drilled pier foundation in the correct location on Xcel Energy property, move the steel pole to the new foundation, re-string conductor and shield wires to the substation termination structure. The remaining foundation would be removed to below grade and the surface area would be filled with topsoil and restored. Department of Commerce EFP staff have asked that Xcel Energy evaluate any possible options that would allow the structure to be left where it is currently placed in addition to the proposed option to move the pole. Analysis of alternatives is currently underway. The Kallivayalils have expressed concerns regarding the placement of the pole,the locations of poles on the 69 kV line(which bypasses the north side of the substation)and the size of the berm on the west side of the substation. A letter from their attorney regarding these concerns was filed to the docket on June 4, 2013. Xcel Energy Principal Land Agent Chris Rogers has been coordinating with the Kallivayalils as well as the other landowners in the Hunt Farm HOA regarding the misplaced pole issue. On May 3, 2013 Xcel Energy filed a letter on e-dockets explaining that structure 076-4,the first new transmission pole north of the Orono Substation on Xcel Energy property, was constructed approximately 120 feet farther north than intended. As a result, clearance between the new 115 kV line and the existing Great River Energy (GRE) 69 kV line on the north side of the substation is inadequate for National Electric Safety Code compliance. The purpose of this follow-up letter is to provide an explanation of how this occurred and how we plan to prevent a similar incident in the future. In addition,this letter provides information regarding several alternatives for resolving the issue. During the course of each project, design alignment and the related structure locations may be staked numerous times to facilitate public viewing, soil investigations,vicinity utility locates, and ultimately, final location for construction of facilities. Alignment revisions result in the generation of multiple sets of location coordinates. In this case,the structure foundation for structure 076-4 was staked and constructed utilizing a preliminary coordinate location rather than the final coordinate location approved in the Plan and Profile submittal. I To reduce the likelihood of this type of incident reoccurring in the future,we have since implemented new control procedures including using exclusive naming conventions for each set of alignment coordinates to define their purpose, and additional QA/QC reviews by multiple groups within the project team to validate coordinate data against the appropriate alignment staking intent. With regard to the clearance issue arising out of the misplacement of structure 076-4,Xcel Energy has evaluated several possible solutions: 1. Move the structure to the location that was shown and approved in the Plan and Profile submitted to the Commission. In order to do this, crews would construct a new concrete drilled pier foundation in the corrected location on Xcel Energy property, move the steel pole to the new foundation and re-string conductor and shield wires to the substation termination structure. The remaining foundation would be removed to below grade and the surface area would be filled with topsoil and restored. 2. Lower the insulators on the GRE 69 kV bypass line which would create adequate clearance to allow our structure to remain where it is. We have been coordinating with GRE and they are agreeable to this option. Engineering has been working on details with GRE and this appears to be a viable solution. 3. Request that GRE discontinue the use of the bypass line. This may be possible if the Xcel Energy Hollydale project,which is currently going through the permitting process, is constructed. That line would then be able to serve the Medina substation in the case of loss of a transformer. Because this option depends on completion of the Hollydale permitting process, and timing of construction is not yet known,this is not a preferred option. 4. Retain the structure where it is currently installed and inset two additional tangent structures(one for each of the two lowest circuits of the 3-phase line)just outside of the Orono substation to lift the conductor and provide adequate clearance over the GRE line. Because this option requires inserting additional poles,this is not a preferred option. Upon further review numbers 3 and 4 above were not determined to be viable or acceptable solutions because number 3 is dependent on completion of another transmission project which is not yet permitted and 4 would increase visual impacts due to the increased number of poles. The project team met on site with landowners from the Huntington Farm Home Owners' Association on Friday June 14 to review the first two alternatives and get their feedback. After reviewing the site and gathering input from other neighbors living on Hunt Farm Road the Huntington Farm HOA recommended alternative 1,to move the structure. Xcel Energy also prefers this option because it provides the proper electrical clearances for maintenance and operation of the Xcel Energy 115 kV line and the GRE 69 kV line. Leaving the structure where it is currently installed(option 2 above)would require lowering the GRE line to provide adequate clearance between the lines and would require creating a space below the line 2 where pedestrian and vehicle access was restricted. This restricted space could hinder maintenance access for both lines. It could also limit any future modifications to the GRE line that might be necessary to meet potential changes in code requirements. Based on the information described above Xcel Energy plans to pursue option 1 above: to install a new foundation in the location shown in the plan and profile drawings submitted on January 18, 2013,with updates sent on February 7 and March 22, 2013. After the new foundation is completed the structure will be removed from its current location and reinstalled on the new foundation. Conductor(wire)will then be restrung in this location to replace what is currently installed with conductor of the correct length for the pole spans.
