CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7 2 1 2 CITY OF ORONO HENNEPIN COUNTY, MINNESOTA RESOLUTION DISPENSING WITH STATUTORY REQUIREMENTS FOR REVIEW BY PLANNING COMMISSION OF SALE OF PROPERTY, APPROVING THE SALE OF REAL PROPERTY, AND APPROVING A LOT LINE ADJUSTMENT WHEREAS, Mr. Brian Huisman and Mrs. Anne Huisman ("Owners") are the owners of real property located at 1121 North Arm Drive, Orono, Minnesota 55364, PID: 0711723140063 and said parcel is currently legally described on the attached Exhibit A ("Current Applicant Property"); and WHEREAS, Mr. Huisman submitted a Land Use Application ("Application") to the City of Orono ("City") requesting a boundary line adjustment for the Current Applicant Property; and WHEREAS, the Current Applicant Property abuts parcels of land that is purportedly owned by the City, and said parcels are currently legally described on the attached Exhibit B ("Current City Parcels"); and WHEREAS, a substantial portion of the Current City Parcels are submerged and under the ordinary high water (OHW) line; and WHEREAS, the Application proposes adjusting the common property line in a manner that would enlarge the Current Applicant Property ("Final Applicant Property") and reduce the Current City Parcels ("Final City Parcels") as provided in the attached survey attached as Exhibit C; and WHEREAS, the City wishes to convey to Owners via quit claim deed the portion of the Current City Parcels that is being reduced by virtue of the proposed boundary line adjustment in the Application for $1.00, and the property to be conveyed in legally described as Exhibit D; and WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning Commission review the acquisition and disposal of any publicly owned interest in real property within the City; and WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the Planning Commission review requirement upon 2/3 vote of the governing body dispensing with the requirement and finding that the acquisition and disposal of the property has no relationship to the comprehensive municipal plan; and WHEREAS, the City wishes to approve the Application, which would result in the legal description for the Final Applicant Property as set forth in Exhibit E, and the legal description for the Final City Parcels as set forth in Exhibit F; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono: CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7212 1. The City Council finds that the sale of the portion of the Current City Parcels for $1.00 has no relationship to the comprehensive municipal plan; 2. Review by the Planning Commission of the acquisition of the Property is hereby dispensed with; 3. The combination of the Current Applicant Property and the Current City Parcels is exempt from the subdivision requirements of the City Code pursuant to City Code Section 82-200, and therefore may be completed through a lot line adjustment; 4. The lot line adjustment of the Current Applicant Property to become the Final Applicant Property and the Current City Parcels to become the Final City Parcels is hereby approved; 5. The Mayor, City Clerk, and City Attorney are authorized and directed to execute a quit claim deed and record all documents and take all appropriate measures to effectuate the intent of the City Council; and PASSED AND ADOPTED y a two-thirds vote of the City Council of the City of Orono, Minnesota this Jp day of , 2021.
