HomeMy WebLinkAbout2021 Subordination of Easements SUBORDINATION of EASEMENTS Legal description of subject property: Parcel 1: That part of Lot I lying West of a line drawn parallel with and 395 feet East of, measured at right angles to, the East line of the West 1/2 of the Southwest Quarter of Section 26, Township 118, Range 23 and the same extended, and lying North of the North line of Lot 2 and its Easterly extension; that part of Lot 2 lying North of the Easterly extension of the Northerly line of Tract A, Registered Land Survey No. 1379; all in "Auditor's Subdivision Number 291, Hennepin County, Minnesota", according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. Parcel 2: That part of Government Lot I, Section 26, Township 118, Range 23 described as follows: Beginning at the Northwest corner of Lot 2, "Auditor's Subdivision Number 291, Hennepin County, Minnesota", thence West along the extension of the North line of said Lot 2 and along the South line of Lot 1, said Auditor's Subdivision, to the most Westerly line of Lot 1, said Auditor's Subdivision; thence South along the extension of the most Westerly line of Lot 1, said Auditor's Subdivision, to the South line of said Section 26; thence East along the South line of said Section 26 to its intersection with the West line of Lot 2, said Auditor's Subdivision;thence North to the point of beginning; except that portion thereof embraced in Registered Land Survey Nos. 934 and 1379; and except the West 50 feet of that part of above-described Government Lot 1 lying North of the North line of Registered Land Survey No. 934; and except that part of Government Lot 1 lying Southerly of the Easterly extension of the Northerly line of Tract A, Registered Land Survey No. 1379. Certificate of Title No. 608676 The City of Orono ("City") is the grantee of two Flowage and Conservation Easements burdening the described property, conveyed on October 22, 1979, and filed in the Office of the Hennepin County Registrar of Titles on April 16, 1980, as Document Nos. 1378052 and 1378053 ("City Easements"). The City hereby agrees that the City Easements, and all rights of the City thereunder, are subordinated to the Easement among John E. Newell as Trustee of the John E. Newell Trust Under Agreement Dated June 21, 2017, and Stephen L. Newell as Trustee of the Stephen L. Newell Trust Under Agreement Dated June 21, 2017 (together, "Grantors"), and the Minnehaha Creek Watershed District,to which this Subordination of Easements is appended.
