WHEREAS, Robert Snyder and Pamela Kroeger Snyder, a married couple
(hereinafter "the Applicants") are the owners of the property located at 1�13 Bay Rid�e Road
within the City of Orono (hereinafter the "City") and le�ally described as follows: Tract H and
Tract K, Registered Land Survey No. 19?, Hennepin County, Minnesota (hereinafter the
"Property"); and
WHEREAS, the Applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-30�(B) to allow construction of an
addition to the existinj home resulting in an 8.4-foot setback on the south side of the home
where 30-foo� side yard setbacks are noi-mally required and an 8.4-foot sethack currently exists;
and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held
a public hearing on July 18, 2011 at which times all persons desiring to be heard concerning this
application were Qiven the opportunity to speak thereon.
NOV1', THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
l. This application w�as reviewed as Zoning File 11-3�16.
2. The property is located in the LR-lA One Family Lakeshore Residential Zoning
Distnct which requires a minimum lot area of 2.0 acres and a minimum lot width
of 200'.

3. The Plannin� Commission reviewed this application at a public hearin� held on
July 18, 2011 and recommended approval of a side setback variance based on the
followinQ findin�s:
a. The property contains 42,096 s.£ (0.96 acre) in area and has 110-feet in width.
b. Sanitary sewer is available.
c. There is no additional land available to brinb the lot area into conformity.
d. Adjustin� the proposed addition to meet a 10-foot side setback would create
awkward desi�n challenges and offer minimal benefit to the adjacent property
owner.
e. Additional ve�etative screening is proposed.
f. The Applicants are proposin� reductions in hardcover within the 7�'-2�0'
zone to reach a conforming 25%hardcover level.
g. The Applicants' request will not alter the essential character of the
neiahborhood and will result in minimal ne�ative impact on adjacent
properties. �
h. The Applicants' request is in harmony with the purpose and intent of the
ordinance.
i. The driveway as proposed meets the Cit��'s minimum standards althouah the
configuration is acknowled�ed by the Applicants to be somewhat Iimitin�,
hence it is likely to be used primarily for storaQe.
j. The Applicants have demonstrated that enforcing the lot area and lot width
provisions of the Zoninj Ordinance deprive the applicants of the reasonable
use of their property.
4. The City Council has considered this application includin� the findinQs and
recommendation of the Planning Cominission, reports by City staff, comments by
the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.

�. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions, light, air nor pose a fire
hazard or other dan�er to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a practical difficulty; is
necessary to preserve a substantial property right of the applicants; and would be
in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan
of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findinas, the Orono City Council hereby �rants
variances to Orono Municipal Zoning Code Section 78-305 (B) to allow construction of an
addition to the existing home resultin� in a 8.4-foot setback on the south side where a 30-foot
side yard setback is normally required and an 8.4-foot setback currently exists, subject to the
following conditions:
L Council approval is based on the survey and buildinQ p�ans submitted by the Applicants
and annotated by City staff, attached to this Resolution as Exhibits A & B. Any
amendments to the site plan which are not in conformity with City codes will require
further Planning Commission and City Council review.
?. No hardcover variances are granted. The Applicants must conduct hardcover removals in
order to achieve a conforminv ?�°�o hardcover level within the 7�`-2�0' zone. Hardcover
within the ?�0'-500' zone shall not increase above 30%.
3. The Applicants acknowledge the awkward configuration of the proposed dnveway and
acknowled�e that chan�es to the driveway resulting in hardcover in excess of 2�% will
not be approved. �
4. The Applicants shall submit a detailed drainage and �rading plan with the buildin�permit
application to ensure no ne�ative impacts to the adjacent proeprty.
�. The Applicants shall submit a planting plan with the building permit application for
screeninD the proposed addition from the property to the south.
6. The building plans submitted for building permit will be reviewed to ensure compliance
with the City's buildina heiahf and number of stories regulations.

7. Authorities granted by this resolution run with the property not with the Applicants, but
are permissive only and must be exercised by obtaining a building permit for the new
construction and commencing construction of said project. A framing inspection must be
completed within one year of the date of Council approval, or the variance will expire on
that date (August 8, 2012).
8. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate an_y authority
granted herein, and shall be punishable as a misdemeanor.
9. The undersi�ned Applicants have read, understand and hereby a�ee to the terms of this
resolution and on behalf of the Applicants and the Applicants' heirs, successors and
:��:;�ssigns, hereby agree to the recordin� of this resolution in the chain of title of the
