The pool is on the lake side of our house in the 75 -250 zone. The pool is simply too much work to keep up! Mike, I wasn't sure if the questions below should be directed to you or Lyle or to Melanie, but I thought I would start with you. My questions are: 1. Do we need a permit to fill in the pool and, if so, what type of permit? You will need a demolition permit for filling in the excavation. All concrete from the pool must be removed from the property-it is not allowed to be buried on site. A demolition permit application is attached;and erosion control escrow is a/so required(see attached Zoning Permit Application). 2. We currently have a wood deck directly off the house which is just 14 inches above grade. We would possibly like to do a paver patio, at grade, out from the wood deck and where part of the pool is currently located. This would cover well less than half of the current pool area and would obviously result in a net reduction in total hardcover. � a. I assume we would need a permit to do this paver patio? A new patio would be covered under the Zoning Permit Application as a minor land alteration permit. The driveway permit box should be checked as well as we don't have a specific line item for a patio. b. What would the side yard set back be for the patio? The closest part of the existing concrete pool apron is about 13ft from the side property line. If the patio is at ground level it can be as c/ose as 2 feet to the lot line. 3. What is the side yard setback for a low deck that is less than 18 inches above grade? If that deck has no railing, it can be within 2 feet of/ot line. Once a deck reaches a height where it requires a railing(30") the total of deck and railing is 6'+in height and must meet the required 30'side setback. 4. What are the code requirements in regard to a gas fired fire pit? Can I find this type of information on your website? You should review this issue with Lyle Oman 952.249.4625. If additional hardcover or structure is included it will have to meet the 25%limit(see my response to#5 below)and setbacks may apply. 5. Would I need new hard cover calculations, if whatever l do is clearly a substantial reduction of hardcover? Currently, the entire pool and concrete apron are included as "hardcover", as required for hardcover calculations. We did a home expansion in 1996 and received a hardcover variance in November 1995 to 26.7°/o (instead of 25%) in the 75-250 zone. The hardcover should be calculated as well as the proposed plan shown on a survey. Depending on the degree of work proposed on the site—patio, grading, etc a new survey may not be necessary. In any case your plans should be shown to scale on the existing survey and coordinate with the hardcover calculations. As you have indicated the pool removal will exceed the addition of the patio I am making the assumption that 25% hardcover can be achieved easily. Is this accurate? If so, this type of hardcover change can be approved administratively without a variance under the Zoning Permit application process. 6. Would it be allowable to bury concrete (and no other waste), in the deep end of the pool hole? No. Thanks for your help.
