HomeMy WebLinkAboutResolution 5717A RESOLUTION APPROVING THE PLAT OF DRAGONFLY HILL 2" ADDITION - FILE #06-3196 / #08-3342 ,1�0 ti J� CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 5 7 1 T A RESOLUTION APPROVING THE PLAT OF DRAGONFLY HILL 2"n ADDITION - FILE #06-3196 / #08-3342 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application by Patrick J. McNaughton and Lisa McNaughton, husband and wife, and Edward H. Hamm, single (hereinafter "Applicants") for a re -plat subdivision of private property located at 1391 Fox Street and 1401 Shoreline Drive and legally described as follows: 1391 Fox Street (McNaughton): Lot 1, Block 1 and Outlot A, BLUE HILL, Hennepin County, Minnesota 1401 Shoreline Drive (Haran): Lot 1, Block 2, DRAGONFLY HILL, Hennepin County, Minnesota (hereinafter "the Properties"); and WHEREAS, on July 24, 2006 the City Council adopted Resolution No. 5489 granting Preliminary Plat Approval for a re -plat of the Properties to detach Outlot A, Blue Hill from Lot 1, Block 1, Blue Hill, and combine said Outlot A with Lot 1, Block 2, Dragonfly Hill; and WHEREAS, the Applicants formally withdrew the lot area variance requests associated with the application prior to September 4, 2006, thereby invalidating the variance denials per condition (1) of Resolution No. 5489; and WHEREAS, on June 25, 2007 the City Council adopted Resolution No. 5631 granting a six month extension of the Effective Period of Preliminary Plat Approval to January 24, 2008; and Page 1 of 4 '1 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO, 5711 WHEREAS, Edward H. Hamm, as Trustee of the Trust of Edward H. Hamm u/d dated August 14, 1992, as amended and restated from time to time (hereinafter "Owner") has since acquired the McNaughton parcels and is now fee owner of the Properties; and WHEREAS, the Owner has completed or has agreed to complete all other requirements of the platting regulations of the City including: 1. Completion of all platting requirements of Preliminary Plat Resolution No, 5489. 2. Dedication on the plat of "drainage and utility easements" 10' along exterior property lines and 5' along the interior property line perimeter as required in Resolution No. 5489. 3. Provision to the City of a title opinion or other evidence of ownership satisfactory to the City Attorney and certified copies of all recorded easements currently affecting the Property. 4. Payment to the City of final plat review fees and legal review and filing fees in the amount of $530.00 as established within Resolution No. 5489. NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution No. 5489, the City Council of the City of Orono does hereby approve the residential plat of DRAGONFLY HILL 2ND ADDITION, Hennepin County, Minnesota subject to the following declarations and conditions: 1. No building permits will be allowed for either of the two new Lots resulting from the subdivision until such time that lot area variances are granted for each of the said Lots. 2. Access to the new Lot at 1401 Shoreline Drive shall be from Orono Lane as depicted on the preliminary plat, and said Lot shall be assigned an Orono Lane address uuon completion of the platting process. 3. Upon filing of the plat the City and the Owner shall take the necessary steps to extinguish the Special Lot Combination Agreement between Lot 1, Block 1, Blue Hill and Outlot A, Blue Hill. The City Clerk shall release the plat documents for filing only upon certification by the City Attorney and Planning Director that all requirements of the platting regulations have been satisfied. 5. The aforesaid plat shall be filed by the City of Orono with Hennepin County on or before July 14, 2008 together with a certified original copy of this resolution and executed copies of documents extinguishing the aforesaid Special Lot Combination Agreement. The approval granted by this Resolution shall expire if the conditions of this Resolution have not been met or the plat has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Adopted by the City Council of Orono this 14th day of January, 2008.
