Ahern 7839 12th Avenue South Minneapolis, MN 55425 Re: Illegal Dock on Tract U,RLS No. 192 Dear Mr Ahern: It has come to the attention of the City that you have installed a dock on a small lot you own near the intersection of County Roads 15 and 51. The Orono Zoning Code since 1968 has prohibited the construction and use of accessory structures (including docks) without a principal structure on the property (See Section 10.03, Subd. 9(A) attached). Your dock on Tract U is illegal, and must be removed immediately. If it is not removed by August 1, 1997 the City will vigorously pursue its removal. This small lot contains no principal residence structure and there is no possibility that one could be constructed due to the small lot size and proximity to the lake. Further, you no longer own the property in Bay Ridge which historically provided the principal structure to which a dock on the lake side of Co. Rd. 15 would be accessory. I would refer you to a recent similar situation in which the Minnesota Court of Appeals upheld the City of Orono's right to enforce this ordinance (Richard Stodola vs City of Orono, 1994).
