I am writing this letter to inform you that the dock structure must be moved within 10 days or July 11, 1988. Dear Eugene Strommen: I would like to thank you and Charlie for all of the help and cooperation my wife and I received in regard to the recent complaint from 3490 Birch Lane. During Charlie's inspection July 11, 1988, he stated that we now satisfy your dock use area setback requirements. I am very happy to comply with the L.M.C.D. laws and codes and the laws of Orono. The new subject I wish now to discuss is the water inlet pipe shown to Charlie July 11 1988. This pipe ran from the house on 3490 Birch Lane into Lake Minnetonka. Once in the lake it crossed the extended property line into 1448 Baulder Park Road "Authorized Dock Use Area" . I wish to explain that the pipe in question was installed by owners of 3490 Birch Lane many years ago. Saturday when moving our dock in response to the first complaint, the propeller of our boat struck the pipe. This caused $137 dollars in damage to our boat. The boat damage will be taken up i^ court if she does ^ct �I�c� t� pay us. Saturday when we discovered the permanent pipe, we removed 36. 5 feet of pipe which extended into our authorized dock use area. I then informed your department of the offending pipe monday July 11. Tuesday July 12 the pipe in our dock use area was removed by 3490 Birch Lane. By my own inspection it appears the pipe was removed to just inside the 3490 Birch Lane dock use area. I now wish to ask that you make sure the permanently installed pipe be fully removed from Lake Minnetonka, which I may add is not a part of the land owners property. To be more explicit, I mean the pipe should be removed up to Lake Minnetonka shoreline, elevation 929.4 feet, National Geodetic Vertical Datum, which is L.M.C.D. recognised property. page 2 If this pipe is not removed i feel that it could possibly pose a danger to Lake Minnetonka swimmers and boaters that have a right to use the lake even inside 3490 Birch Lane's authorized dock use area. The right to use the lake is contrary to the present owner of 3490 Birch Lane. This was demonstrated clearly saturday, July 9 1988, when she called Orono police department to complain that the pipe we removed from Lake Minnetonka was on her property. The pipe was not on her property, but well within the lake boundries. If any of the above pertaining to property lines, Lake Minnetonka shoreline, authorized dock use area, L.M.C.D. inspections or other statements in this letter are not correct please inform me in writing so I can fully understand the rules pertaining to Lake Minnetonka. The owner of 1448 Baldur Park Road is Mrs. Coral Lawrence. Mrs. Lawrence has reported to me that there has been verbal harrasment from 3490 Birch Lane for over thirty years. She has authorized myself to act on her behalf. If verification is required she can be contacted for confirmation. Her phone number in minneapolis is 823-9300. Dear Eugene Strommen: The neighbor east of our property at 3490 Birch Lane has allowed her neighbor to enchroach in her authorized dock use area. His dock is whithin approximately two feet of our extended property line. Neither my wife nor I have ever given him permission to enchroach which is required. The regulation regarding that states he should not be closer than a minimum of ten feet. I would like that rule enforced on our eastern property line. The second item I would like to discuss is the matter of the permanently installed water pipe starting from on the 3490 Birch Lane property and extending fourty feet into lake Minnetonka. I first informed you of this problem in a letter dated July 18, 1988 . In that letter I stated that the pipe posed a potential hazard to people useing the lake. As far as I am able to determine the pipe should either be removed or the residents need a permit for this permenent instalation. Thank you for the time you have taken when you have stopped by I also hope that you attend to these matters as fast as you have answered her harrassment calls against us. Dear Jeanne Mabust: The neighbor east of our property at 3490 Birch Lane has a tree on the northwest corner of their property which has died. This tree is a definate hazard to us. Branches have broken off and dropped close to several of our guests. During storms we watch to see if has fallen onto one of our boats. I spoke with Lake Minnetonka Conservation District and they said I should tell the city of Orono. The ordinance does allow the City to ask private property owners to trim or remove plantings that block motorist's views at intersections ; this authority is specifically defined in the ordinance. I have reviewed your request with the City Attorney and he also concurs that the ordinances of the City of Orono do not govern plantings within private properties. I would suggest that you proceed as you suggested in that same letter by contacting your attorney to determine your rights in this matter. This tree started growing on his property many years ago. During the years �he tree has destroyed parts of my fence. The problem which will have a greater impact on myself is, the tree's root structure is now starting to destroy my garage. The tree this year has broken several cedar siding shingles. I intend to contact an attorney in the near future to persue the aspect of damages to my fence and to the garage, but that direction will not get the tree removed. What I would like to know is: 1. Is there an established procedure by the city or some other organization(s) that you think I should follow for: a. Getting the tree removed. b. Recovering damages to the fence and garage. 2 . If the City of Orono is the proper agency to contact, what are you going to do about the problem. I would like to have the response in writing. I am the neighbor bordering the West side of their property. It has come to my attention that there have been some issues presented by the City of Orono regarding height and setback requirements of the fence. Prior to the construction stage of the fence, Mr. Lawrence and I had worked closely together to determine that the new fence would be appealing to the eye as well as located properly on the lot. I went as far as paying to have my property surveyed. Mr. Lawrence has paid several thousand dollars to have this fence installed and making sure that is was done in a professional manner and cosmetically appealing for the neighborhood. I would like to say that I am very pleased with the new fence and that I feel that it has improved our property as well as reflects"Pride of Ownership" consistent to this neighborhood.
