Dear Ms. Jenson:
This letter is a follow-up to our scheduled meeting on August 23 which Mr. Weinberger
was una.ble to attend. As we begin working with you on the planning process to expand
our home loca.ted at 1340 Baldur Park Rd, Orono,there are a num�r of issues which we
ask that you,Mr. Weinl�rger and Mr. Barrett consider:
1. Council Resolution#1415, dated.September 1982,to wlaich you referred,is moot and
irrelevant in that the applicant never owned.or controlled a recorda.ble interest in our
property, Lot 30 together with its easement over Lot 31,yet he was trading
restrictions over Lot 30 in.exchange for variances benefiting proposed Lots 2 and 3 of
the replatting.
2. Of greater relevance, and more recent, is Council Resolution#2483 of August 1988
which concerns the closest neighboring residence at 1376 Baldur Pazk Rd. This
resolution granted lakeshore setback and hardcover variances to allow aew
construction 20 feet from the shoreline, hardcover of 30 percent in the 0- 75 ft. zone,
hardcover of 38.9 percent in the 75 -250 ft. zone,and total structural coverage
(house,deck, stairs, garage)of 2,771 sq. ft. or 20.6 percent of the lot azea.
3. We aze requesting permission to build structural coverage af 15 percent of our lot azea
as allowed by city ordinance. Followin�is an overview of the relevant facts:
• Lot 30,block 1,Baldur Pazk Rd. contains appro�ma�tely 22,000 sq. ft or.51
acre with an easement over Lot 31 (approxirnately 12,000 sq. ft.)for private
sewer purposes benefiting Lot 30.
� Our home on Lot 30, at its northerly foundation wall, is loca.ted 49.1 ft from
the 929.4(northerly)shoreline elevation,and with decks and gazage, contains
2,399 sq. ft. of structural hardcover,or approxunately 10.9 percent of the lot
azea.
• The 15 percent rule would allow an additiona1900 sq. ft. of structural
hardcover.

� The hardcover issue is mitigat�tti by our perpetual easement for private sewer
purposes over Lot 31, which c�ould be used for private :�torm sewer purposes.
• Tn addressing the lakeshare selback variance, we ask that yvu view the lot as
you would a corner lot, with side yard restrictions being; less than that of a
front yard. The current structt�re is located 49.1 ft frorr.�the northerly{side
yard) shoreline, and we would propose constructing no claser to the northerly
(side yard) shareline than the�xisting structure, although our clbsest aeighbor,
at 1376 Baldur Park Rd,, was allowed to build 20 ft. frc�m the same northerly
shoreline.
- It is our hope and goal to wark together vvith city staffto alleviate ,a demonstrable
hardship while preserving our properry ri�hts, anci to reach a mutu��lly agreeable solution
to these problems,

Staff(Mr. Weinberger, Mr. Gaffron, and mysel�have reviewed the street file for your address, as
well as the resolutions you referenced in your letter of August 24, 1999. We have concluded the
following:

1. The preliminary subdivision approved by the City Council in 1982 is relevant because it deals
directly with the land at Baldur Point,including what is now your lot. It also is an indication
of the City Council's thinking at that time. I am not saying that the"no additional hardcover"
will be what is ultimately enforced, but it is information the Planning Commission and the
City Council will consider. Generally, as a part of all variance applications,the history of
applications for the property is reviewed and included when relevant.
2. What was approved for 1376 Baldur Park Road is not of direct relevance to your situation.
I have reviewed the resolution, as well as the zoning file, and have found a number of
differences between your situation and the one at the neighboring lot, including lot size and
placement of the structure on the lot.
A. This lot is only 13,450 square feet(.3 acres)
B. The existing structure was located 20'from the lake,so the applicant was not allowed
to go closer to the lake, and the majority of the addition was located between the
house and the garage.
C. Overall hardcover was reduced on the site, from 30.4%to 30.0% in the 0-75' zone
and from 49.0%to 38.9%in the 75-250' zone.
D. This lot also includes the roadway from which you access your property,which limits
the lot.

3. Zoning Code Section 10.03, Subdivision 14(C)(attached)deals with Lot Coverage. It states
that regardless of lot azea,every lot is permitted up to 1500 square feet of structure,but lots
aze limited in that there can be no more than 15%structural coverage.
4. The Shoreland Ordinance was adopted in 1992, prior to your purchase of the home, and
therefore the conditions were in place.
5. The warranty deed attached to your homestead from within the City's street file (a copy has
been included)indicates you have an easement for a"private sewer system including septic
tanks and drainfield." In no way could the City interpret this to give you hardcover credit for
Lot 31.
6. There are no provisions within the Shoreland Ordinance that would a11ow the treahnent of
your lot as a"corner" lot with regards to the lakeshore setback.
I have also reviewed this with the City Attomey,regarding the use of the easement for private storm
sewer purposes. He concurs with Staff that the easement is for sanitary sewer purposes only. As I
staxed during the meeting,it is doubtful that any proposal to increase the footprint of the structure
on this property could receive a Staff recommendaxion of approval, based on e�cisting codes and
regulations. However, it is not Staff that makes the decisions on variance requests, we merely
recommend approval or denial based on the codes.

2.Tennis courts,patios,decks,and all similar"open" structures when
partially or fully enclosed by fences,railings or walls which extend more than 6' above grade level
(if any portion of such structures extends more than 6' above grade level,the entire structure shall
count toward lot coverage).
3. Pools, including pool basin and associated deck or patio areas,
regardless of whether such pool basin, deck,or patio is enclosed with a fence.

Re: Variance Resolution#4720
Dear Mr. Weinberger:
As you may remember, we were granted variances to construct a new home last
November with the condition of hooking up to city sewer. We have now waited another
year for a utility easement across the neighboring property, as promised by its owner, Mr.
Bill Franklin. Out of necessity, we are now proce�iing with the installation of an
approved, code compliant 3BR private sewer system which should be completed by the
end of the month.
As the Pla,nning Commission recommended approval of our plans upon installation of a
code compliant septic system, we ask that the variances be renewed for another 12
months without the condition of city sewer hookup.
As residents of Orono for the past nine years, we greaxly appreciate the quality of life
here, and would now like to praceed with our plans to accommodate our growing family,
If possible, we would like to bring this old business to City Council on October 28th.
