periodic basis. The onsite sewage treatment system at the above address has been inspected and

City Ordinance 199 requires that each existing on-site sewage treatment system in Orono be inspected every two years.
The on-site sewage treatrnent system at the above address has been inspected and appears to fall into the categories checked below.

A permit must be issued to a licensed septic contractor prior to installation.
NOTICE TO INSTALLERS: Any changes to the approved plans must have prior approval of the
inspector(952-249-4600) Call for inspection 24 hours in advance.
ALL DRAINFIELD AREAS MUST BE FENCED OFF prior to building site excavation and
fencing must remain in place until final site grading. Approval to pour footings will not be granted
until the Inspections Department has verified the primary and alternate sites are protected.
NO VEHICULAR TRAFFIC OF ANY KIND is allowed within 20'of tested drainfield sites ever.

The abave site was tested on 10/9/O1 and it was determine that two sites d�.d
exist to inst�all two drianfields on.
In i.he prirr,3ry site a preesurized bed could be installe�l ��'�ile in the alterna��
site a preesurized ���� trench system could be used.
The average percolation rate was 22,5 min/in, and the depth to mottled soil was
at 3.5-3.8 ft.
The depth � of the pressurized mound would have to be 6-8 inches and the maximum
size of the �e�nd tiaould be 750 sq,ft. ( 30 ft. long by 25 ft, wide )
This size me�rrrd would accomadate a :� b`droom home ( 450 gal/day)

I have had no response from you to my letter of March 21, 1995 (copy attached) regarding the
provision of municipal sewer to your properties on Baldur Park Road. As noted in that letter, it is
likely that a portion of the cost would be borne by the owner of Lot 30,Mr. Puzak. In 1997 the City
will be requiring Mr. Puzak to abandon his existing septic system. Both you and he would benefit
from the extension of municipal sewer to a location near the buildable portions of your property.
I would appreciate if you would contact me at 473-7357 to discuss a possible joint sewer project to
serve your property as well as Mr. Puzak's property.

Re: Septic System Upgrade-Deadline Extension
Dear Mr. Puzak:
As we discussed in late July, it would be preferable if you could connect your residence to the
municipal sewer rather than construct a new septic system. For that reason, the deadline for
replacement of your septic system is hereby extended to December 31, 1997. It is the City's intent
to pursue an easement over Lots 21-29 in ord'er that sewer can be brought to your property.
We will keep in mind your proposal to help pay a portion of the cost to bring the sewer up to Lot 25,
where both your property and Franklin's property could individually connect. This would then leave
you with a 250'-300' connection.
I will again attempt to get a response from Mr. Franklin, but if this isn't fruitful, I will bring the
matter of easement condemnation to the City Council and City Attorney. I'll let you know where
things stand as this progresses.

Thank you for your phone call March 20th regarding your septic system and potential for
connecting to municipal sewer. I hope the following information will answer a number of your
questions:
1. Due to the recent moratorium on nonconforming septic system repairs, all
property owners who received a repair order in 1993, which includes you, will
now have until December 31, 1996 to.complete the appropriate systern upgrade.
2. On-site Systems Manager Steve Weckman and I have briefly discussed your
situation. We are not convinced, based on the required setbacks, soil and slope
conditions, among other factors, that a conforming septic system can be
constructed on your property (even when the easement area of Lot 31 is
included).
3. Attached is a copy of a letter sent to Mr. Franklin today, requesting that he
contact me to discuss extension of sewer to his property and/or providing an
easement for your individual connection. I will advise you of any response from
him.
4. If an easement for your individual connection can be obtained, completing the
connection would be entirely at your expense. While you would not have to pay
a "sewer connection charge" based on past assessment of your property, a Sewer
Availability Charge (SAC) of$850 and a connection permit of approximately �35
would be required. I have no idea what a contractor would charge to complete
your 500' connection, and due to the extreme length, it may require careful
design and installation.

5. It is still the City's position that the most logical way to provide sewer to your
properry would be a joint effort with Mr. Franklin that results in a pipe designed
and constructed to serve your residence as well as any potential future

This is a follow up letter regarding the septic maintenance inspection conducted on Apri127, 2000.
It was found during the inspection thax the septic tanks are un.dersized according to cunent Orono
City Code. A septic system must utilize two septic tanks and each septic ta.nk must be a minimum
of 1000 gallons. It also appeared that the drainfield(s) are undersized and would not meet today's
standazds for drainfield sizing. Finally, the septic system is in the 75 foot setback to Lake
Minnetonka. According to City code, nothing is to be constructed within 75 feet of Lake
Minnetonka. e
Now, with a11 that said,there is a definite upside. A soil boring was conducted which indicated that
the seasonal watertable will be at least 70 inches below grade. It could even be deeper but this is
undetermined due to the fact that I hit a rock. The dra.infield is about 44 inches deep thus there is
a separation of at least 26 inches from the drainfield to the seasonal watertable. I was incorrect
when I informed you that a 24 inch sepa.ration is required. Any property located in the Shoreland
District(any property within 1000 feet of any lake)must meet the three foot separation requirement
regardless of when the septic system was installed. I apologize for any confusion this may have
caused.
Because there appeazs to be substantial separation to the seasonal watertable,connection to the City
sewer system does not need to happen immediately. The septic systems can continue to serve the
residence as long as there are no changes to the residence that would require the septic systems to
be enlarged to handle the additional capacity. An example ofthis would be a bedroom addition. The
existing septic systems cannot be altered(i.e.,made bigger)due to the fact that they do not meet the
75 foot setback to Lake Minnetonka. If major changes are to occur to the residence, connection to
the city sewer system would be the only acceptable altemative. I am aware of the issues regarding
your ability to connect to sewer.

In summary, even though the existing septic systems have substandazd tanks and dra,infields, the
systems can stay in use due to the fact that it appears as though the drainfields meet the sepazation
requirements to the water table. The systems can sta.y in use until fa.ilure occurs which means that
untreated sewage would be discharged to the ground surface. If the systems do fail, connection to
the city sewer wQuld be required. Also, if major remodeling were to occur to the residence,
connection to the city sewer system would be required.

I am writing as a follow-up to our telephone conversation yesterday during
which we discussed.the possibility of hooking up to city sewer. I began
discussing this with Mr. Mike Gaffron prior to my purchase of the property in
1993, nearly sig years ago. During the past six years, I have also attempted
several times each yeax to conta.ct the owner of the neighboring property, Mr.
William Franklin, to discuss upgrading my drivewap easement to one allowing
for utilities. Mr. Franklin does not respond.
My existing septic spstem has until recendy served adequately, however, I am
now forced to improve it. While an improved system should serve the
property adequatelp for at least another generation, I would much prefer to
have city sewer service, and since my property has already been assessed for city
sewer it seems onlp reasonable that it should be made available. Mr. Gaffron
suggested that the city could provide a utility easement along my existing
driveway through the use of eminent doma.i.n. Egtending the city sewer along
the existing driveway easement to Lot 29 would appear to be a reasonable
solution.
If the city could commit to egtending the sewer or at least to help upgrade my
easement, I could forgo the septic improvement. Please let me know if you
think a sewer hookup is feasible in the near future, or if I should go ahead with
the septic spstem improvement. Thank you for your help with this matter.

Summary �
� This residence is within the MUSA boundary and has a nonconforming septic system(due
to lack of 3' separation from water table identified by motrtling) which must be replaced by
12/31/95. There is no place on the property meeting the mini.mum criteria for system
replacement. Connection to City sewet is the only reasonable alternative.
Connection Issues .
The house sits on Lot 30 (see E�chibit A) and is owned by David Mess. The sewer in
.Baldur Park Road only extends up to Lot 21, about 500' from the house. William Franklin
owns Lots 21 through 29 and 31 through 33, all of wluch are vacant except for a detached
garage on Lot 28. Mr. Mess has a driveway easement through Lots 21-29, but not a sewer
easement. Mr. Franklin appazently has refused to grant Mess a sewer easement(see Eachibit B).
All of Lots 21 through 33 were owned by Gladys and Fred Olson at the time sewer was
installed in Baldur Pazk Road as part of the 1965-LS-1 project. Lot 21 was assessed front
footage, and Lot 30, with the house, was assessed one $225.00 sewer unit. A 19701etter to
Fred Olson confumed that the sewer was provided to the property and that he was already past
the deadline for connection. �
In 1974 Lots 21 through 29 and Lot 33 were sold by Olson. The history of property
ownership appears in Exhibit C.
Although the City has sent many letters demanding sewer connection and had many
discussions with the various property owners through the years, it can be argued that the
property technically has not been "served" by sewer since the intervening Lots 21-29 were sold
twenry yeazs ago.

� . The City for many years has been billing the Mess residence for both the annual septic
' � �charge and the quarterly sewer "available" charge. .The property owner brought this issu�e to
the City's attentian a few years ago but at that time it was apparently concluded that the dual
charges were appropriate since the property had always been considered by the City as being
served, and therefore the charges were an "incentive" to complete the connection. The property •
is apparently now being sold by Mess, with no resolve to the situation.
Staff Recommendation
Staff is proposing the following actions to resolve ttus matter once and for all:
1. Abate the 1993 sewer "available" quarterly charges and elimi.nate future such� �
chatges until the sewer is available. �
� 2. Continue the annual septic billing.
3. Staff to contact Mr. Franklin and determine whether he is interested in
cooperating with Mr. Mess by providing him an easement at a reasonable cost,
if any. Yt would seem to be to both parties' benefit to work together and install
a pipe that will serve both properties once Franklin or his successor develops the
vacant parcels. If Franklin and Mess resolve this, allow them to install (at their
cost) a pipe that would serve their needs, according to City standards.
4. Absent Franlclin's cooperation within the next ninety days, City to proceed with
condemnation of an easement and construction of a municipal sewer extension to
serve the existing house and the two or three probable additibnal units that might
eventually be allowed to develop on the point (remember that preliminary plat
approval for a total of three lots on the point was granted in 1982 but never
carried out). Assess one unit to the existing house and two or three units to
Franklin's pazcels. Include the costs of condemnation and construction in the
assessment. The basis for such a condemnation and sewer construction project

Dear Mr. Franklin:
Tax records indicate you are still the owner of Lots 21 - 29 and 31 - 33, Baldur Park. While
it has been some tune since we discussed your plans for this property, the question of
connecting the Frederick Puzak residence on Lot 30 to the sanitary sewer remains an item of
concem to the City.
As yc�u know, the City is likely to approve only a limited development of the portions of your
property located more than 75' from the lake. This "developable area" is generally on the very
high ground near the existing residence on Lot 30. In order to develop your property, City
sewer would have to be extended approximately 400' from its cunent location.
The potential clearly exists for a joint sewer extension project by you and the owner of Lot 30.
Both parties would seem to benefit from such an arrangement, since your neighbor would
presumably share in the cost of making the extension, reducing your costs; and he would benefit
by having the ability to connect to the sewer at such time his septic system must be replaced.
An alternative would be for you to grant a sewer connection easement for your neighbor to make
his own connection. This would not, however, seem to be the most efficient way to provide
sewer for the potential future development of the peninsula.

WHEREAS,it is proposed to install sanitary sewer to serve properties and to
assess the benefited properties for all of the cost of the improvement,pursuant to Minnesota
Statues, Chapter 429,at the end of Baldur Park Peninsula;and '
NOW,THEREFORE,BE IT RESOLVED by the City Council of Orono,
Minnesota,that the proposed improvement be referred to the City's engineering firm Bonestroo
Rosene and Anderlick Associates for study and that they aze instructed to report to the Council
with all convenient speed advising the Council in a preliminary way as to whether the proposed
improvement is feasible and as to whether it should best be made as proposed or in connection
with some other improvement,and the esti.mated cost of the improvement as recommended.
Adopted by the City Council at a regular meeting held on March 8, 1999 by a vote

Paul, Mike and I aze all of the opinion that the easement is for sanitary sewer purposes only,
however, the property owner is arguing that the easement says private sewer, which could mean
storm sewer,therefore if he has his lot drain to the easement,he can count the easement as a part of
hardcover calculations (he knows he can't build on it). The City's position is that it is for private
sanitary sewer only, and because he doesn't own the land, it cannot be counted towards his
hardcover, because the actual owner of the property would then lose his/her rights to count it as
hazdcover(even if they can't build on it).

to tell him that I've contacted you and gotten your opinion on the easement issue. I don't have the
actual easement document, although we may get to the point of needing it if he keeps azguing the
point.

Item Description: Baldur Pazk Peninsula Request for Sanitary Sewer Extension
We have received a letter from Mr. Fred Puzak requesting sanitary sewer service for his property.
He lives, in the last house, on the end of Baldur Park peninsula. This property is within the
MUSA and was supposed to have been connected to sewer as part of the 1965 IS #1 sewer .
project. The existing septic system is nonconforming due to a lack 3' separation from the water
table. Connection to sewer is the only reasonable alternative for this property. This issue is
_ complicated and has Ixen previously presented to the Council. I have attached the Council memo
from the November 29, 1993 meeting. This memo provides a good explanation of the history of
this project.
Both, Mr. Puzak and the City of Orono have been unsuccessful in numerous attempts to contact
the adjoining property owner, Mr. Bill Franklin. The involvement of Mr. Franklin is required to
complete this project. This issue needs to be resolved because of the poor condition of the existing
septic system.
Our recommendation is that the City start the process for an assessment sewer project to extend
sewer to the end of Baldur Park peninsula. This appears to be the best method for involving Mr.
Franklin in this project, and wil1 provide an official public hearing process for receipt of his
comments.
Mr Puzak suggested if the City could assist him in obtaining a sewer easement, he would be
willing to complete a private sewer service project to obtain sewer for his property. Our
recommendation is that a public sewer assessment project be completed to provide sewer service
to all of the properties at the end of the peninsula. With multiple property owners involved, the
best solution is for a public project to provide sewer service for all of the parcels
A preliminary subdivision approval was granted in 1982 for two lots on Mr. Franklin's property.
The final subdivision was never completed. Our recommendation is that this subdivision is a
rationale basis on which to conclude that this property be allowed a maximum of two sewer units.
For the assessment project the Puzak property could be assessed for one unit and the Franklin
property assessed for two units. This would be a fully assessed sewer project.
A copy of this Council information packet will be sent to both Mr. Puzak and to Mr. Franklin.
