EMPLOYMENT AGREEMENT
AGREEMENT made this2d day of+e , 2017,by and between the CiTY OF
ORONO a Minnesota municipal corporation ("Employer"), and DUSTIN RIEF("Employee").
The parties agree as follows:
l. POSITION. Employer agrees to employ Employee as its City Administrator.
Employee agrees to serve as City Administrator in accordance with state statutes and City
ordinances and to perform such other legally pennissible and proper duties and functions as the City
Council shall from time to time assign.
2. PENSION PLAN. Employer shall contribute to PERA as required by State law for
Employee or an alternate pension plan, if selected by Employee,authorized by State law.
3. SALARY. Employer shall pay Employee a salary of$109,020.16(Step 3)per year
starting August 28,20l 7. Employee shall be given an initial performance review after six (6)
months and annually thereafter. Employee shall be eligible for a step increase at the initial six(6)
nonth review.
4. SENIORITY. Far purposes of employment benefits such as sick leave,vacation
leave,and the like, Employee will be credited with having completed six(6)years of employment
with the City upon his first day of employment.
5. SICK LEAVE. Effective upon Employee's first day of employment,Employee
shall be credited with six(6)days of accrued sick leave. Employee shall begin accruing sick leave in
accordance with the City's persoruiel policy after successfully completing six(6)months of
employment.

6. VACATIONS. Effective upon Employee's first day of employment, Employee
shall be credited with eight(8)days of accrued vacation. Employee shall begin accruing vacation
leave in accordance with the City's personnel policy after successfully completing six(6)months of
employment.
7. HOLIDAYS. Employer shall provide Employee the same holidays as enjoyed by
other non-union employees.
8. GENERAL INSURANCE. Employer will pay Employee$1,125.00 monthly
starting September 1,2017 through Deceinber 2017 as reimbursement for health care coverage.
Effective January l,2018, Employer shall provide Employee the same group hospital,medical,
dental, life and disability insurance benefits as provided to all other non-union employees.
9. DUES AND SUBSCRiPTIONS. Employer shall budget and pay the professional
dues and subscriptions for Employee which are necessary for Employee's continued participation in
national, regional,state and local associations necessary and desirable for Employee's continued
professional participation,growth and advancement.
10. PROFESSIONAL DEVELOPMENT. Employer shall budget and pay the travel
and subsistence expenses of Employee for professional and official travel,meetings and occasions
adequate to continue the professional development of Employee and to adequately pursue necessary
official and other committees thereof which Employee serves as a member. Employee shall use
ood judgment in his/her outside activities so he/she will not neglect his primary duties to the
E nployer.
11. CIVIC CLUB MEMBERSHIP. Employer recognizes the desirability of
representation in and before local civic and other organizations. Employee is authorized to become a

member of such civic clubs or organizations as deemed appropriate by him and at Employer's
expense.
12. AUTOMOBILE. Employee shall be reimbursed for any and all mileage expenses
the same as other non-union employees.
13. MOVING AND RELOCATION ALLOWANCE. Employer shall reimburse
Employee an amount not to exceed$9,500.00 for moving his household goods. Payment shall be
made upon receipt by the Employer of documentation that the expenses have been incurred and
deemed reasonable. In the event the Employee voluntarily resigns his position with the Employer
before completing five(5)years of employment, Employee shall reimburse Employer for moving
expenses as follows:
i) August 28,2017-August 28, 2018= $9,500.00
ii) August 29,2018 -August 28,2019= $7,500.00
iii) August 29,2019 -August 28,2020= $5,500.00
iv) August 29,2020-August 28,2021 = $3,500.00
v) August 29,2021 -August 28, 2022 $2,000.00
14. GENERAL EXPENSES. Employer shall reimburse Employee miscellaneous job
related expenses which it is anticipated Employee will incur from time to time when provided
appropriate documentation.
15. HOURS OF WORK. It is understood that the position of City Administrator
rcquires attendance at evening meetings and occasionally at weekend meetings. It is understood by
Employee that additional compensation and compensatory time shall not be allowed for such
additional expenditures of time. It is further understood that Employee may absent himself/herself
from the office to a reasonable extent in consideration of extraordinary time expenditures for
cvening and weekend meetings at other than normal working hours.

16. OUTSIDE EMPLOYMENT/CONSULTING. The City Administrator may not
engage in any other employment while employed by the City,on either a full-time or part-time
basis,either directly as an employee, independent contractor or through a corporation or other
entity.
17. TERMINATION BENEFITS. In the event that Employee is terminated by the
Employer during such time that Employee is willing and able to perform the duties of City
Administrator,then in that event,Employer agrees to pay Employee at the time of receipt of his last
pay check a luinp sum cash payment equal to three(3)months aggregate salary and to continue to
provide and pay for the benefits set forth in paragraph 8 for a period of three(3)months following
termination. However, in the event Employee is tenninated because of his malfeasance in office,
gross misconduct,conviction for a felony,or conviction for an illegal act involving personal gain to
Employee,then Employer shall have no obligation to pay the termination benefits.
Employer will elect to increase the severance by one(1)month for each year of service up
to a maximum of six(6)months.
If Employer at any tiine during the employment term reduces the salary or other financial
benefits of Employee in a greater percentage than across-the-board reduction for all non-union
employees,or if Employer refuses, following written notice,to comply with any other provisions of
this Agreement benefiting Employee or Employee resigns following a formal suggestion by
Employer that he resign,then Employee may,at his option,be deemed to be "tenninated" on the
effective date of Employee's resignation and the Employee shall also be entitled to receive the
termination benefits set forth above.

IF Employee voluntarily resigns his position with Employer,Employee agrees to give thc:
Employer forty-five(45)days advance notice. If Employee voluntarily resigns his position with
L.iuployer, there shall be no termination pay due to Employee.
18. GENERAL CONDITIONS OF EMPLOYMENT. Nothing in this Agreement
shall prevent, limit or otherwise interfere with thc right of Employer to tenninate the services of
Employee at any time, for any reason, subject o lly to the pro-isions of this Ag-eement and statutory
rcquircmcnts. Furthcnnore, nothing in this Agrecment shall prevcnt, liinit or otherwise interfere
ith tl e right of Employee to resign at any tiine from his/l er position with En pLoyer, subject only
to the provisions of this Agrceinent.

This letter is to serve as my formal notice for resignation. I am resigning for personal reasons.
This notice will begin my transition period of 45 days with my last day at work being February 4, 2021. I
will be taking my floating holiday January 15, 2021 as well as vacation from February 5, 2021 to February
26, 2021. I am further requesting a reprieve of the repayment of moving expenses as laid out in my
Employment Agreement. I will work to keep all department heads informed and transition all duties
over to them for a seamless transition. I want to thank you and the community of Orono for allowing me
the honor of serving your citizens for the past 3 years. This will be an experience I remember. Thank you
again.

1. Purpose: Discuss and provide direction to staff on filling the City Administrator Position for
interim and long-term.
2. Background: City Administrator Dustin Rief submitted his resignation to the City Council
on December 22, 2020. Rief’s last day is February 4, 2021. The City has appointed an Interim
City Administrator previously, in the absence of a full time Administrato r. City Code Section 2-
102 states “t he mayor may appoint an acting administrator subject to concurrence of the
council at their next regular scheduled meeting. The appointment shall state the powers and
authority granted to the acting administrator.”
The City has utilized a search firm, previously, to conduct the solicitation and vetting process of
candidates for the City Administrator position. The typical application process can take fro m 6
months to a year before a new City Administrator is place. Ot her options may include advertising
and vetting of candidates by current staff.
3. Staff Recommendation: Staff is looking for guidance on an interim appointment for the
next council meeting effective February 5, 2021. Staff is also looking for guidance on beginning
the process of filling the position.

1. Purpose. This memo is intended to outline recommendations related to staffing the Community
Development Department.
2. Building Services. On December 18th, the Building Services committee (Mayor Walsh, Council
member Johnson) reviewed the three Building Service (Official/ Inspector) proposals. All three
proposed fees as a percentage of permit fees, which the committee rejected. As directed by the
committee, I have contacted MnSpect (the applicant the committee was most comfortable with)
for an hourly rate for the requested Building Services. As of this writing, I have not received a
response, other than an “out of office” reply.
At the same time, the Committee directed staff to prepare job descriptions for publication for both
the Building Official and Building Inspector. Once applications are received, the Committee may
evaluate candidates and hire one or both positions and contract with MnSpect as appropriate.
Based on 2019 fees received, hiring two positions would be less costly than the proposals.
Publication of these positions requires adjustment of the Building Inspector job description.
Community Development Reorg. Christine Mattson, Planning Assistant, submitted her
resignation on December 21st, her last day in the office is December 31st. With her resignation, I
view this as an opportunity to review the job descriptions to ensure that tasks are completed in an
efficient manner. Further, through the Union negotiations, it has come to our attention that one
planner would like to be considered as a senior planner. While no application or recommendation
for filling that role has occurred, it seems appropriate to review that description also. To those
ends, I propose changes to the Community Development Director, Senior Planner, City Planner,
Planning Assistant job descriptions, shown as tracked changes in the attached documents.
The changes to the job descriptions outlined above typically involves the Personnel committee.
Involving the personnel committee and the building services committee introduces a quorum of
the Council, potentially initiating an open meeting concern; this can be avoided with the Council
action proposed:

authorize the advertisement of the positions as proposed.

Position Title: Senior City Planner

Administers City zoning ordinances, land use controls and provides planning assistance to the
Planning Commission and City Council.
Supervision Received and Exercised
The Senior Planner reports to the Community Development Director. This position is not
responsible for supervising other positions, however, the Senior City Planner may guide the
work of the City Planner and Planning Assistant.
Examples of Work

Performs comprehensive reviews of complex variance, conditional use permit,
subdivision, PUD, and other land use applications. Prepares reports and makes
presentations to the Planning Commission and City Council on land use applications.
Provides follow-up to applications including written and verbal communication with
applicants, developers, engineers, architects, attorneys, realtors, etc. Drafts resolutions for
adoption by City Council.
Assists in the implementation of the City’s conservation design requirements.
Provides information to the public on all aspects of City planning and zoning ordinances
relating to residential and commercial development.
Identifies and develops amendments to the Zoning and Subdivision Codes as required,
and prepares reports and drafts ordinances for adoption by the City Council.
