Beiison, a single person, is the owner of the property located at 1290 Arbor Street within the City of Orono (hereiilafter the "City") and legally described as follows: Lots 7 & 8, Block 1, Crystal Bay Mimietonka, Hexulepin County, Minnesota (hereinafter the"property"); and WHEREAS, the applicants have niade application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-420 Subdivision B to allow a side street setback of 21.2' where a 50' setback is nonnally required. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Miruzesota: FINDINGS 1. This application was reviewed as Zoning File#04-3040. 2. T11e propei�ty is located in the RR-1B, One Family Rural Residential Zoning District which requires a niinimtun lot area of 2 acres and a minimuin lot width of Z00'. 3. The Planning Commissioii reviewed this application at a public hearing held on August 16, 2004 and recoinmended approval of the variance based on the following findings: a. The property has 12,809 s.f. (0.29 acre)in area and 100' in width. The property is witl�in the 500' — 1Q00' shoreland hazdcover zone. b. The side street is unimproved right-of-way,has been fenced and currently is being used as parkland for Crystal Bay Playground. Page 1 of 5 M'P- ' .�0,��. The proposed garage location will have no negative impacts on the parkland or the neighborhood. 4. Tlie City Co�uicil has considered this application including the findings and recominendation of the Planning Comniission, reports by City staff, comments by the applicants and the �ublic, and the effect of the proposed variance on the health, safety and welfare of the commuziity. 5. The City Council finds that the conditions existing otz tlus property are �eculiar to it and do not apply generally to other property in this zoning district; that graizting the variance would ilot adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a conveiiience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property i�ight of the applicants; and would be in keeping with the spirit and iiitent of the Zoiiing Code and Comprelzensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Sectioil 78-420 Subdivision B to allow a side street setback of 21.2' where 50' is nornially required, subject to the following conditions: 1. Council approval is based on the site plan subniitted by the applicants and annotated by City staff, attached to this Resolution as Exhibit A. Any amendmeilts to the site plan which are izot in conformity with City codes will require further Planning Commission and City Council review, 2. Hardcover in the 500-1000' zone shall be limited to 4,483 s.f. or 35% per the proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicants are advised that any fuiure requests to increase hardcover above the limited amounts or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover above the allowed limits will not likely be approved without concurrent reduction in existing hardcover. Applicants shall remove all plastic or fabric liner material from the decorative landscape beds on the property to ensure their pei-meability as non-hardcover surfaces. 4. Autllorities granted by this resolution run with the property not with the applicants, but are permissive only and niust be exercised by oUtairung a building pennit for the new construction within one year of the date of Council approval, or the variance will expire on that date (August 23, 2005). 5. Violarion of or non-compliance �vith any of the tenns and conditions of this resolution shall constitute a violation of the zoning code, shall automatically ternzinate any authority granted herein, and sl�all be punishable as a misdemeanor. 6. The undersigned applicants have read, uizderstood and hereby agree to the tenlls of this resolution aild on behalf of tlle applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
