DECLARATION OF RESTRICTIVE COVENANT
THIS DECLARATION OF RESTRICTIVE COVENANTS (the "Declaration"), is
made this/() day of j r , 2020, by the undersigned parties, representing all
of the owners in fee of the land hereinafter described, lying in Hennepin County, Minnesota.
WHEREAS, DBG, LLC, a Minnesota limited liability company, is the fee owner of real
property located at 4220 Chippewa Lane, Orono, Minnesota; and
WHEREAS, Charles Brookins Jr. and Amy Brookins, as joint tenants ("Brookins"),
hold a Contract Vendor's interest in the real property located at 4220 Chippewa Lane, Orono,
Minnesota, pursuant to the Contract for Deed dated May 10, 2019 and filed for record with the
Hennepin County Recorder on May 13, 2019 as Document No. Al 0658453; and
WHEREAS, the real property located at 4220 Chippewa Lane, Orono, Minnesota, is
legally described as: Lot 1, Block 1, Chippewa Second Addition, Hennepin County, Minnesota
("Subject Property"); and
WHEREAS, Brookins have applied to the City of Orono for Permit No. 20-000045 to
install a half bathroom including a sink and toilet in an accessory building; and
WHEREAS, the undersigned parties desire to impose upon and subject said land to
certain covenants, conditions, restrictions and reservations for the benefit of said land and its
present and future owners;
NOW, THEREFORE, the undersigned parties hereby declare, impose upon, create and
establish the following covenants, conditions and restrictions upon the Subject Property:
A. PROHIBITION ON USES.
I . Installation of any combination of fixtures requiring wastewater plumbing
that does not include a shower or bathtub shall be allowed in any accessory building,
subject to provision of municipal sanitary sewer or a conforming sewage treatment

system designed to handle the anticipated flows from such fixtures, and subject to the
property owner's executing a covenant providing that the accessory building will not be:
a. Used for a home occupation unless specifically approved by the
city or if allowed by this Code.
b. Used as a dwelling unless a guest house conditional use permit is
obtained.
C. Rented, leased or otherwise provided for use as a dwelling under
any circumstances.
B. RUN WITH THE LAND. The covenants and restrictions set forth in this
Declaration shall run with the land, shall be recorded with Hennepin County against the title to
the Subject Property, and shall be binding upon and inure to the benefit of the City and the
Declarant named herein, her successors, heirs, and assigns, and any other person or entity at any
time hereafter who shall become the owner of the land.
IN WITNESS WHEREOF, as of the day and year first hereinabove written, the parties
have executed this Declaration.
